試論公安邊防部隊行政執(zhí)法中存在的問題及對策

【摘要】: 公安邊防部隊既是國家重要的軍事力量也是國家的行政執(zhí)法機關。公安邊防機關及其工作人員作為國家機關的重要組成部分,是國家意志的執(zhí)行者,人民利益的捍衛(wèi)者,履行著鞏固共產黨的執(zhí)政地位、維護國家長治久安和保障人民群眾安居樂業(yè)的三大政治社會責任。進一步規(guī)范公安邊防行政執(zhí)法權的行使,對推進依法行政,建立法治、文明、和諧的沿海沿邊社會環(huán)境起著極其重要的作用。目前邊防行政執(zhí)法中還存在著多方面問題,涉及行政執(zhí)法的各個環(huán)節(jié)和領域,要解決執(zhí)法權行使中存在的問題,要從邊防行政立法層面、行政執(zhí)法體制、監(jiān)督制約工作機制以及行政執(zhí)法人員素質等方面不斷進行完善. 一、公安邊防行政執(zhí)法概述 公安邊防行政執(zhí)法是指公安邊防機關及邊防警察為了實現邊防行政管理目的,依照法律賦予的職權并依法定程序,組織貫徹實施邊防行政法律規(guī)范的活動。內涵包括:(一)邊防行政執(zhí)法體現了國家的意志,權力來源與國家;(二)邊防行政執(zhí)法是一種法定權力,依法取得并在法定范圍內實施;(三)邊防行政執(zhí)法的主體是邊防機關及其所屬邊防警察;(四)邊防行政執(zhí)法作用于邊防警察行政管理范圍內,是針對警務關系中的行政相對人而實施的。 邊防行政執(zhí)法的特征包括四個方面:第一,內容的廣泛性;第二,權、責的統(tǒng)一性;第三,自由裁量性;第四,獨立性。其性質體現了人民的根本利益和意志。 邊防行政執(zhí)法的功能主要是維護沿海沿邊地區(qū)的社會秩序,保障公民、法人和其他組織的合法權益。 邊防行政執(zhí)法的基本原則為:(一)合法性原則;(二)執(zhí)法合理性原則;(三)執(zhí)法效率原則;(四)依法接受監(jiān)督原則。 二、當前邊防行政執(zhí)法中存在問題及原因分析 當前我國邊防行政執(zhí)法中主要存在以下幾個方面的問題:一是執(zhí)法不規(guī)范,執(zhí)法人員有法不依,執(zhí)法不嚴;二是執(zhí)法人員程序觀念不強,對行政執(zhí)法程序認識不夠,,缺乏程序的約束,有些行為違反法律明確規(guī)定的程序;三是執(zhí)法隊伍素質良莠不齊,整體素質有待提高;四是內部執(zhí)法監(jiān)督存在薄弱環(huán)節(jié);五是邊防行政立法滯后,直接困擾執(zhí)法工作。 造成邊防行政執(zhí)法中存在上述問題原因主要有以下幾個方面:一是立法體制因素,體現在立法出現分散或混亂,相關法律法規(guī)相對滯后,造成法律出現真空或處罰力度跟不上的問題;二是執(zhí)法主體因素,即邊防民警執(zhí)法觀念、法律素質以及政治文化素質尚不能適應現代社會發(fā)展及法律法規(guī)的要求;三是內部機制因素,在行政執(zhí)法方面還沒有突破定勢思維,缺乏創(chuàng)新體系,管理機制、內部監(jiān)督機制、警務保障機制等方面落后;四是外部因素,影響邊防行政執(zhí)法的外部因素,諸如當事人的不作為,情與法、權與錢的關系處理不當,外部行政干預的存在,社會監(jiān)督的效能不理想等。 三、邊防行政執(zhí)法中存在問題的解決對策 解決邊防行政執(zhí)法中存在的問題的對策主要是:一是樹立和強化邊防執(zhí)法人員的行政法治觀念;二是要強化程序意識,做到嚴格執(zhí)法程序;三是要加強執(zhí)法隊伍素質建設,提高執(zhí)法者的政治素質、業(yè)務素質、法律素質、文化和道德素質;四是加強行政執(zhí)法監(jiān)督制度建設,加大對行政違法行為的責任追究力度;五是完善邊防行政立法,使嚴格、公正、文明的邊防行政執(zhí)法有著更加可靠的基礎;六是完善行政執(zhí)法物質手段運行機制,努力消除違法執(zhí)法存在的經濟條件。
[Abstract]:The administrative law enforcement organs of public security frontier forces is an important military force is the state. Public security organs and their staff as an important part of the state organs, is the implementation of the national will, defenders of the interests of the people, to consolidate the ruling status of the Communist Party, maintain national long period of stability and security of the people live and work in peace of three major political social responsibility exercise. To further standardize the public security administrative law enforcement, to promote administration according to law, establish the rule of law, civilized, harmonious coastal social environment plays a very important role. At present, the border of administrative law enforcement still exist in many aspects, involving all links and fields of administrative enforcement, to solve the existing in administrative enforcement the problem, from the border to the level of administrative legislation, administrative law enforcement system, supervision mechanism and administrative law enforcement personnel quality etc. Continue to improve.
First, an overview of the administrative law enforcement of public security border defense
Public security administrative law enforcement refers to the public security organs in border areas and border border police in order to achieve the purpose of administrative management in accordance with legal powers and legal procedures, organize and carry out administrative law activities. The content includes: (a) the administrative enforcement of law reflects the will of the country, the source of power and the state; (two) frontier defense administration law enforcement is a kind of legal power, to make and implement in the legal scope; (three) the main border border is the administrative law enforcement organs and their respective border police; (four) the border of administrative law enforcement in the scope of Frontier defense police administration, according to police in the relationship between the administrative relative person and implementation.
The characteristics of border defense administrative enforcement include four aspects: first, the universality of content; second, the unity of rights and responsibilities; third, discretion; fourth, independence, which embodies the people's fundamental interests and will.
The function of frontier defense administrative law enforcement is to maintain the social order in the coastal areas and protect the legitimate rights and interests of citizens, legal persons and other organizations.
The basic principles of administrative enforcement of frontier defense are: (1) the principle of legality; (two) the principle of rationality of law enforcement; (three) the principle of efficiency of law enforcement; (four) accept the principle of supervision according to law.
Two, analysis of problems and reasons in the administrative law enforcement of frontier defense
The following problems mainly exist in the administrative enforcement of the border: law enforcement is not standardized, law enforcement laws, lax enforcement of the law enforcement personnel; two is the program is not strong, lack of understanding of administrative law enforcement procedures, the lack of procedural constraints, some violation of legal procedure; three is the quality of law enforcement personnel uneven in quality, the overall quality to be improved; four is the internal law enforcement supervision weaknesses; five is the lag of legislation of frontier defense administration directly influence law enforcement work.
The reason for the existence of the frontier in the administrative law enforcement mainly has the following several aspects: one is the legislative and institutional factors embodied in legislation appear scattered or confusion, relevant laws and regulations lag, resulting in a vacuum or punishment can not keep up the problem of law; law enforcement is the two main factors, namely the border police and law enforcement and legal quality political and cultural quality still can not adapt to the development of modern society and the requirements of laws and regulations; three is the internal factors in the aspect of administrative law enforcement is no breakthrough thinking, lack of innovation system, management mechanism, internal supervision mechanism, policing security mechanism is backward; four is the external factors, external factors influence the border of administrative law enforcement, not such as parties, and law, power and money dealing with the relationship between improper external administrative intervention, social supervision efficiency is not ideal.
Three, the solution to the problems in the border administration law enforcement
There are measures to solve the border problems in administrative enforcement of the main is: one is to establish and strengthen the administrative law enforcement personnel border; the two is to strengthen the awareness of procedures, strict enforcement procedures; the three is to strengthen the construction of the quality of law enforcement personnel, law enforcement to improve the political quality, professional quality, legal quality, cultural and moral qualities; four is to strengthen the administrative law enforcement supervision system construction, increase the administrative violations of accountability; the five is to improve the legislation of Frontier Defense Administration to make strict, fair, civilized border of administrative law enforcement has a more reliable; the six is to improve the administrative law enforcement means operation mechanism, eliminate the economic conditions of illegal enforcement efforts.
