【摘要】： 生態(tài)資源是人類社會賴以生存和發(fā)展的基礎(chǔ),隨著工業(yè)社會的發(fā)展和人類改造自然能力的提高,繁榮經(jīng)濟的同時生態(tài)資源不斷被透支。生態(tài)資源的過度開發(fā)和利用,導(dǎo)致生態(tài)環(huán)境惡化,各種環(huán)境事故頻發(fā),大量人員傷亡和財產(chǎn)損失,人類的生存空間被破壞、生存安全受到巨大威脅。為了更好地保護生態(tài)環(huán)境、抵制和懲罰危害生態(tài)環(huán)境的行為,生態(tài)問題演變成社會問題,“生態(tài)犯罪”逐漸成為犯罪學(xué)上研究的新視點。研究一類犯罪現(xiàn)象產(chǎn)生、發(fā)展旨在有針對性地形成預(yù)防和控制該類犯罪的方法。對于生態(tài)犯罪的研究也是一樣,最終目的是為了更好的掌握生態(tài)犯罪的特點,形成有機系統(tǒng)的防控體系,建立人類的和諧家園。 文章的第一章從生態(tài)和生態(tài)犯罪的概念入手,形成了生態(tài)犯罪的完整概念并分析了生態(tài)犯罪的基本特征和主要表現(xiàn)形式,將生態(tài)犯罪與環(huán)境犯罪、破壞自然資源犯罪進行比較,明確生態(tài)犯罪的特點,展示生態(tài)犯罪概念研究的必要性和緊迫性,為后文的論述進行鋪墊。 文章的第二章從犯罪學(xué)角度和經(jīng)濟學(xué)角度對生態(tài)犯罪的原因進行分析,得出了“發(fā)展有誤、利益驅(qū)動、管理缺位、法律缺失、技術(shù)落后”五大具體原因。 根據(jù)這些原因,論文的第三章建立了一個生態(tài)犯罪防控的基本模式——“3A”模式。這一模式是生態(tài)犯罪防控過程中的基礎(chǔ),也是文章的精華,涵蓋了生態(tài)犯防控過程中應(yīng)該遵循的防控目標、防控的基本理念和防控的具體措施。這三個方面構(gòu)成一個統(tǒng)一的整體,互相依存、密不可分,并且體現(xiàn)了邏輯上的遞進關(guān)系。第三章重點對生態(tài)犯罪防控模式中的具體措施進行闡述。任何模式的功能都是需要通過具體方法來實現(xiàn)的,生態(tài)犯罪防控的具體措施可以分為三個方面:導(dǎo)向防控、決策防控和運行防控。導(dǎo)向防控中包括思想領(lǐng)域、政策領(lǐng)域和法制領(lǐng)域;決策防控中包括重大行政決策和一般管理決策;運行防控包括技術(shù)革新、生態(tài)督導(dǎo)和國際協(xié)作。這三種防控措施從三個不同的角度實現(xiàn)了對生態(tài)犯罪的立體式的防控。 文章緊緊環(huán)繞當代中國生態(tài)犯罪的現(xiàn)狀,從生態(tài)犯罪的概念、生態(tài)犯罪產(chǎn)生的原因和如何對生態(tài)犯罪進行防控三個方面對中國當前生態(tài)犯罪進行了防控的系統(tǒng)的論述,層層推進,形成了對生態(tài)犯罪及其防控系統(tǒng)而全面的研究成果。
[Abstract]:Ecological resources are the basis for the survival and development of human society. With the development of industrial society and the improvement of human's ability to transform nature, ecological resources are overdrawn while the economy is prosperous.The overexploitation and utilization of ecological resources leads to the deterioration of ecological environment, frequent occurrence of various environmental accidents, a large number of casualties and property losses, the destruction of human living space, and a great threat to the safety of human existence.In order to better protect the ecological environment, resist and punish the behavior that endangers the ecological environment, the ecological problem has evolved into a social problem, and ecological crime has gradually become a new perspective of criminology research.This paper studies the emergence of a class of crime and develops methods to prevent and control it.The study of ecological crime is the same, the ultimate purpose is to better grasp the characteristics of ecological crime, form an organic system of prevention and control system, and establish a harmonious home for human beings.The first chapter starts with the concept of ecology and ecological crime, forms the complete concept of ecological crime and analyzes the basic characteristics and main forms of ecological crime, and compares ecological crime with environmental crime and crime of destroying natural resources.Make clear the characteristics of ecological crime, show the necessity and urgency of the study of ecological crime concept, and pave the way for the following discussion.The second chapter analyzes the causes of ecological crime from the angle of criminology and economics, and concludes five specific reasons: "development is wrong, interest is driven, management is absent, law is missing, and technology is backward".According to these reasons, the third chapter establishes a basic model of ecological crime prevention and control-"3A" model.This model is the basis of the ecological crime prevention and control process, but also the essence of the article, covering the ecological crime prevention and control process should follow the prevention and control objectives, the basic concept of prevention and control and specific measures.These three aspects form a unified whole, interdependent, inseparable, and reflect the logical progressive relationship.The third chapter focuses on the specific measures of ecological crime prevention and control model.The function of any mode needs to be realized by concrete methods. The specific measures of ecological crime prevention and control can be divided into three aspects: guided prevention and control, decision prevention and control and operation prevention and control.It includes ideological field, policy field and legal field; decision prevention and control includes major administrative decision and general management decision; operation prevention and control includes technological innovation, ecological supervision and international cooperation.These three prevention and control measures from three different angles to achieve the prevention and control of ecological crime.Based on the concept of ecological crime, the causes of ecological crime and how to prevent and control ecological crime, the paper discusses the current ecological crime prevention and control system in China closely around the current situation of ecological crime in contemporary China, including the concept of ecological crime, the causes of ecological crime and how to prevent and control ecological crime.Layer by layer, the formation of ecological crime and its prevention and control system and comprehensive research results.
