【摘要】：20世紀(jì)七十年代以來，世界各國都在不斷地進(jìn)行刑罰制度的創(chuàng)新，嘗試用最有效、最人道、最文明的方式處理犯罪和犯罪人，社區(qū)矯正就是在這樣的背景下誕生的一種新的刑罰執(zhí)行方式。 作為與監(jiān)禁性刑罰方式相對的非監(jiān)禁性的刑罰執(zhí)行活動，社區(qū)矯正具有深刻的思想淵源，蘊(yùn)涵著人道和效益的價值理念，反映了世界各國刑罰制度由機(jī)構(gòu)性處遇轉(zhuǎn)向為社會處遇的發(fā)展趨勢，代表了國際刑罰方式由嚴(yán)厲走向?qū)捑彽内厔�。因此，社區(qū)矯正實施的深度和廣度已經(jīng)成為衡量一個國家文明程度的重要標(biāo)志之一。 社區(qū)矯正在我國還是一個新生事物，目前，我國正在已有本土經(jīng)驗的基礎(chǔ)上，對其進(jìn)行有益的探索與嘗試。從試行情況看，社區(qū)矯正在我國已取得了一定的積極的社會效果和法律效果�？梢灶A(yù)見，社區(qū)矯正在我國的構(gòu)建與實施，對于促進(jìn)我國刑罰制度改革，預(yù)防各類犯罪，維護(hù)國家長治久安，，具有極為重要的意義。毋庸諱言，這其中也還存在著一些不容忽視的問題，有待于我們進(jìn)一步探索，不斷修正和完善。 本文共分為四部分： 第一部分主要介紹了社區(qū)矯正的概念、本質(zhì)屬性及基本特征等基本理論問題，考察了國內(nèi)外社區(qū)矯正的歷史淵源與發(fā)展現(xiàn)狀； 第二部分從我國實行社區(qū)矯正的理論依據(jù)、法律依據(jù)和現(xiàn)實依據(jù)等方面分析論證了我國實行社區(qū)矯正的可行性及實行社區(qū)矯正對我國刑罰執(zhí)行的影響； 第三部分從社區(qū)矯正在我國的發(fā)展概況入手，結(jié)合我國社區(qū)矯正的實踐，分析總結(jié)了我國開展社區(qū)矯正試點所取得的經(jīng)驗和存在的問題； 第四部分從思想理念、制度構(gòu)建、法律監(jiān)督機(jī)制的完備等方面，對我國構(gòu)建和完善社區(qū)矯正進(jìn)行了初步的闡釋和探討，進(jìn)而提出了改革和完善的建議。
[Abstract]:Since the 1970s, every country in the world has been innovating its penal system, trying to deal with crime and criminals in the most effective, humane and civilized way.Community correction is a new way of penalty execution born under this background.As a non-custodial penalty execution activity, community correction has profound ideological origin and contains the value of humanity and benefit.It reflects the development trend of the penalty system of various countries in the world from the institutional situation to the social one, and represents the trend of the international penalty system from severe to lenient.Therefore, the depth and breadth of the implementation of community correction has become one of the important symbols to measure the civilization of a country.Community correction is still a new thing in our country. At present, our country is carrying on the beneficial exploration and attempt on the basis of the local experience.From the trial situation, community correction in our country has achieved some positive social and legal effects.It can be predicted that the construction and implementation of community correction in our country is of great significance in promoting the reform of our penal system, preventing all kinds of crimes, and maintaining the long-term stability of the country.Needless to say, there are still some problems that can not be ignored, which need to be further explored, revised and perfected.This paper is divided into four parts:The first part mainly introduces the concept of community correction, essential attributes and basic characteristics of the basic theoretical issues, inspected the historical origin and development of community correction at home and abroad.The second part analyzes the feasibility of carrying out community correction in our country and the influence of community correction on the execution of penalty from the aspects of theoretical basis, legal basis and practical basis of carrying out community correction in our country.The third part starts with the development situation of community correction in our country, combining with the practice of community correction in our country, analyzes and summarizes the experience and existing problems of carrying out the pilot project of community correction in our country.In the fourth part, the author expounds and discusses the construction and perfection of community correction in China from the aspects of ideology, system construction and the perfection of legal supervision mechanism, and then puts forward some suggestions for reform and perfection.
