【摘要】：恐怖主義犯罪是當(dāng)今國際社會(huì)普遍關(guān)注的熱點(diǎn)問題。特別是“9.11”事件后, 預(yù)防和懲治恐怖主義犯罪日益成為國際社會(huì)和各國政府關(guān)注的重點(diǎn)問題。由于恐 怖主義犯罪具有國際性、跨國性、有組織性、活動(dòng)方式多樣性和危害嚴(yán)重性等特 征,在制止和打擊恐怖主義犯罪方面,國際社會(huì)的應(yīng)變措施往往顯得滯后,世界 各國的刑事法律對策和非法律性措施也遠(yuǎn)未達(dá)到適應(yīng)的程度。如何有效地預(yù)防和 懲治恐怖主義犯罪,已經(jīng)成為當(dāng)今國際社會(huì)和各國政府迫切需要解決的現(xiàn)實(shí)問題, 也是目前國際刑法學(xué)界亟待深入研討的重大課題。本文擬從恐怖主義犯罪的法律 概念界定入手,通過對恐怖主義犯罪的歷史發(fā)展、產(chǎn)生根源以及國際社會(huì)制止和 打擊恐怖主義犯罪的立法和實(shí)踐的研究探討,揭示恐怖主義犯罪的性質(zhì)和危害, 從國際、國內(nèi)兩個(gè)層面提出有針對性的預(yù)防和懲治國際恐怖主義犯罪的法律對策。 本文共分5章。第1章是關(guān)于國際恐怖主義犯罪的概述,主要論述了國際恐 怖主義犯罪的定義、犯罪構(gòu)成要件和幾種主要的犯罪類型。第2章概括了國際恐 怖主義犯罪的歷史發(fā)展及當(dāng)代特征,深入分析了恐怖主義問題產(chǎn)生和發(fā)展的社會(huì) 根源。第3章至第5章是本文的主體部分。其中第3章從國際社會(huì)、各國國內(nèi)兩 個(gè)層面,分別研究考察了制止和打擊國際恐怖主義犯罪的立法與實(shí)踐:第4章重 點(diǎn)論述了加強(qiáng)國際社會(huì)懲治恐怖犯罪應(yīng)采取的法律對策;第5章在分析我國關(guān)于 恐怖主義犯罪立法現(xiàn)狀的基礎(chǔ)上,提出了相應(yīng)的建議和措施。
[Abstract]:The crime of terrorism is a hot issue in the international community.In particular, after the events of 11 September,The prevention and punishment of terrorist crimes have become the focus of attention of the international community and governments.Because of fear.Terrorist crimes are international, transnational, organized, diverse and serious.When it comes to preventing and combating terrorist crimes, the contingency measures of the international community are often lagging behind.The criminal legal countermeasures and non-legal measures of various countries have not reached the level of adaptation.How to effectively prevent andThe punishment of terrorist crimes has become an urgent and realistic problem for the international community and governments.It is also an important subject that the international criminal law field needs to discuss in depth.This article intends to start with the law of terrorist crime.Starting with the definition of the concept, through the historical development of the crime of terrorism, the root causes and the international community to stop andResearch and discussion on legislation and practice of combating terrorist crimes, revealing the nature and harm of terrorist crimes,This paper puts forward legal countermeasures to prevent and punish the crime of international terrorism from two aspects of international and domestic.This paper is divided into five chapters.Chapter 1 is an overview of the crime of international terrorism, which mainly deals with international terrorism.Definition of terrorist crime, elements of crime and several main types of crime.Chapter 2 summarizes international terrorismThe historical development and contemporary characteristics of terrorist crimes, and the in-depth analysis of the emergence and development of the problem of terrorism in society.Root causeChapters 3 to 5 are the main part of this paper.Chapter 3 from the international community, countriesThe legislation and practice of suppressing and combating the crime of international terrorism are studied respectively in chapter 4The article discusses the legal countermeasures that should be taken to strengthen the international community to punish terrorist crimes.On the basis of the current situation of terrorism crime legislation, the corresponding suggestions and measures are put forward.
