【摘要】： 近年來,變態(tài)殺人案件,尤其是系列變態(tài)殺人案件頻頻見諸報(bào)端,引起社會(huì)的普遍關(guān)注。雖然從數(shù)量上講,這類案件無法與其他犯罪,甚至無法與其他犯罪人實(shí)施的殺人案件“一較高低”,但是,其殺人動(dòng)機(jī)的模糊性、殺人手段的殘忍性、危害后果的嚴(yán)重性,卻讓全社會(huì)一次次地陷入巨大的恐慌中,人心惶惶,不可終日,且久久難以平復(fù)。 變態(tài)殺人案件的種種特殊性引起了筆者的關(guān)注,故特以此為選題,希望能夠從變態(tài)殺手特殊的人格角度出發(fā),通過其與常人及其他心理變態(tài)者的比較研究,總結(jié)出在變態(tài)人格控制下,這些變態(tài)殺手殺人的特點(diǎn)及其原因機(jī)制,并對(duì)隨后的偵查、矯治和預(yù)防措施提出自己的觀點(diǎn),以拋磚引玉,推動(dòng)學(xué)術(shù)研究和司法實(shí)踐的進(jìn)程。 本文共分為導(dǎo)論、上篇、中篇、下篇和結(jié)語五部分。 導(dǎo)論首先簡(jiǎn)要論述了本文的寫作背景和目的,在綜觀現(xiàn)有的研究成果和存在的問題后,通過對(duì)變態(tài)人格和其他變態(tài)心理的分析比較,指出對(duì)變態(tài)人格控制下的殺人行為進(jìn)行研究的主要原因及其重大意義。 上篇在對(duì)變態(tài)人格的定義及其分類進(jìn)行簡(jiǎn)要論述后,重點(diǎn)分析研究了變態(tài)人格控制下殺人行為的特點(diǎn),即,主要從殺人動(dòng)機(jī)的緣起、對(duì)作案時(shí)間地點(diǎn)的選擇、對(duì)作案對(duì)象的選擇、作案手法、案后反應(yīng)以及對(duì)罪責(zé)的認(rèn)識(shí)等方面,分析得出與常態(tài)人格者、精神病態(tài)心理患者相比,變態(tài)人格者在殺人前、殺人中及殺人后表現(xiàn)出來的重要特點(diǎn)。 中篇?jiǎng)t在上篇對(duì)變態(tài)人格控制下殺人行為的特點(diǎn)進(jìn)行論述的基礎(chǔ)上,深入一步,重點(diǎn)分析了其出現(xiàn)的原因。在具體分析的過程中,筆者主要是以變態(tài)殺手的成長(zhǎng)歷程為線索,從先天、后天生物因素、家庭、學(xué)校等生活環(huán)境因素和社會(huì)文化因素三個(gè)方面進(jìn)行了分析和探究,并在篇末將這些原因簡(jiǎn)化為一個(gè)公式列出。 下篇從防衛(wèi)社會(huì)的角度,重點(diǎn)探討了對(duì)變態(tài)人格控制下殺人行為的防范。筆者按照步步推進(jìn)的邏輯,首先論述了針對(duì)已經(jīng)實(shí)施殺人行為的變態(tài)人格者的防范措施——以犯罪人特征描述技術(shù)為主導(dǎo)的刑事偵查手段;之后,針對(duì)未出現(xiàn)殺人行為,但具有這種可能性的變態(tài)人格罪犯提出了特殊的矯治措施;最后,考慮到變態(tài)人格是變態(tài)人格控制下殺人行為出現(xiàn)的前提條件,而且變態(tài)人格一旦定型就很難改變,因此筆者特別提出了對(duì)變態(tài)人格已經(jīng)定型和雖未成型,但具有潛在危險(xiǎn)性的個(gè)體的預(yù)防措施。 結(jié)語則是對(duì)本文觀點(diǎn)的進(jìn)一步提煉和對(duì)學(xué)術(shù)研究及理論運(yùn)用的真切呼吁。
[Abstract]:In recent years, cases of abnormal homicide, especially a series of cases of perverted homicide, have been frequently reported in the press, which has aroused widespread concern in society. Although in terms of quantity, such cases cannot be compared with other crimes. They can't even "compare themselves" with the murder cases committed by other criminals, but the fuzziness of their motives, the cruelty of their means of killing, and the seriousness of the consequences of harming them make the whole society, time and again, fall into great panic and panic. Not all day, and for a long time difficult to calm down. The particularity of the abnormal murder case has aroused the author's attention, so the author chooses this as the topic, hoping to be able to proceed from the special personality angle of the abnormal killer, through its comparative study with the ordinary person and other psychopaths. Under the control of abnormal personality, this paper summarizes the characteristics of these abnormal killers and their cause mechanism, and puts forward their own views on the following investigation, correction and prevention measures in order to promote the process of academic research and judicial practice. This article is divided into five parts: the introduction, the first, the middle, the second and the conclusion. The introduction first briefly discusses the writing background and purpose of this paper, after reviewing the existing research results and existing problems, through the analysis and comparison of abnormal personality and other abnormal psychology, This paper points out the main reasons and significance of the research on the killing behavior under the control of abnormal personality. After a brief discussion on the definition and classification of abnormal personality, the first part focuses on the characteristics of homicide under the control of abnormal personality, that is, the choice of time and place of crime mainly from the origin of motive of murder. From the aspects of the choice of the target, the modus operandi, the post-case reaction and the understanding of the responsibility of the crime, it is concluded that, compared with the normal personality and the psychopathic psychopath, the abnormal personality is before the murder. The important characteristic of killing people and after killing people. On the basis of the exposition of the characteristics of homicide under the control of abnormal personality in the first part, the second part analyzes the reasons for its emergence. In the process of concrete analysis, the author mainly takes the growth course of the abnormal killer as the clue. This paper analyzes and probes into the three aspects of birth, acquired biological factors, family, school and other living environment factors and social and cultural factors, and simplifies these reasons into a formula at the end of the article. The second part focuses on the prevention of homicide under the control of abnormal personality from the point of view of defending society. First of all, the paper discusses the preventive measures against the abnormal personality who have already committed homicide-the criminal investigation means, which is dominated by the description of the criminal characteristics, and then, aiming at the absence of homicide, However, criminals with such a possibility have proposed special corrective measures; finally, considering that abnormal personality is a prerequisite for the occurrence of homicide under the control of abnormal personality, and that it is difficult to change abnormal personality once it is stereotyped, Therefore, the author puts forward the preventive measures for individuals with abnormal personality that have been shaped and have not been formed, but which are potentially dangerous. The conclusion is a true appeal for academic research and theoretical application.
