【摘要】：職務(wù)犯罪是腐敗最為嚴(yán)重的表現(xiàn)形式,它嚴(yán)重地侵蝕著國家政權(quán)的穩(wěn)定,阻礙著經(jīng)濟(jì)的健康發(fā)展,損害了黨和國家在人們?nèi)罕娭械牧己眯蜗蟆｜h和國家歷來重視反腐敗斗爭和預(yù)防職務(wù)犯罪工作,并將預(yù)防職務(wù)犯罪工作納入了黨和國家反腐倡廉建設(shè)的總體格局,以及懲治和預(yù)防腐敗體系建設(shè)的總體部署。筆者將通過對2010年廣西檢察機(jī)關(guān)查辦職務(wù)犯罪的基本情況、職務(wù)犯罪呈現(xiàn)的主要特點(diǎn)及發(fā)案原因、發(fā)展趨勢進(jìn)行分析,提出鞏固和完善懲治和預(yù)防職務(wù)犯罪的對策建議。全文主體為四大部分,約20000余字: 前言,簡要闡明選題的實(shí)際意義和理論意義。 第一部分廣西檢察機(jī)關(guān)查辦職務(wù)犯罪的基本情況。 第二部分廣西職務(wù)犯罪呈現(xiàn)的主要特點(diǎn)及發(fā)案原因分析。 第三部分廣西職務(wù)犯罪發(fā)展趨勢。 第四部分預(yù)防職務(wù)犯罪的對策。 文章首先對廣西檢察機(jī)關(guān)職務(wù)犯罪情況發(fā)案和查處總體情況及存在問題進(jìn)行介紹,在此數(shù)據(jù)材料基礎(chǔ)上對我區(qū)職務(wù)犯罪案件的主要特點(diǎn)、原因進(jìn)行全面分析,再從職務(wù)犯罪總體發(fā)案趨勢、發(fā)案性質(zhì)、發(fā)案領(lǐng)域、發(fā)案重點(diǎn)崗位與人群四個(gè)方面進(jìn)行預(yù)測,最后提出構(gòu)建懲治、監(jiān)督、預(yù)防職務(wù)犯罪的設(shè)想。本文側(cè)重從完善懲治、監(jiān)督、預(yù)防的機(jī)制建設(shè)等客觀方面提出見解,以構(gòu)筑嚴(yán)密的懲治和預(yù)防職務(wù)犯罪的執(zhí)法、監(jiān)督、預(yù)防綜合網(wǎng)絡(luò)。
[Abstract]:Official crime is the most serious form of corruption, which seriously erodes the stability of the state power and hinders the healthy development of the economy. It has damaged the good image of the party and the state among the masses. The party and state have always attached importance to the struggle against corruption and the prevention of job-related crimes, and have incorporated the work of preventing job-related crimes into the overall pattern of the party and the state in their efforts to combat corruption and advocate clean government. As well as the overall arrangement of the construction of the system of punishing and preventing corruption. The author will analyze the basic situation of the investigation and handling of duty crimes by Guangxi procuratorial organs in 2010, the main characteristics of duty crimes, the reasons for their occurrence, and the development trend. This paper puts forward countermeasures and suggestions to consolidate and perfect the punishment and prevention of job-related crimes. The main body of the thesis is four parts, about 20000 words:. The preface briefly expounds the practical and theoretical significance of the topic. The first part is about the investigation and handling of duty crimes by Guangxi procuratorial organs. The second part analyzes the main features of duty crime in Guangxi and the causes of the crime. The third part is the development trend of duty crime in Guangxi. The fourth part is the countermeasure of preventing duty crime. Firstly, the article introduces the general situation and existing problems in the investigation and handling of the crimes committed by the procuratorial organs in Guangxi. On the basis of the data, the paper makes a comprehensive analysis of the main characteristics and causes of the cases of duty crimes in our region. Finally, the author puts forward the idea of constructing punishment, supervision and prevention of job-related crimes. This paper focuses on perfecting punishment, supervision, and prevention of job-related crimes, and then forecasts from four aspects: the overall trend of crime committed by duty, the nature of crime, the field of crime, key posts and crowd. In order to construct the comprehensive network of punishing and preventing duty crime, the author puts forward some opinions on the construction of mechanism of prevention, such as the enforcement of law, supervision and prevention of duty crime.
