【摘要】： 在我國(guó)社會(huì)轉(zhuǎn)型時(shí)期,未成年人違法犯罪呈現(xiàn)出新的高發(fā)態(tài)勢(shì)和一系列新的特征,并已成為迫切需要解決的嚴(yán)重的世界性社會(huì)問(wèn)題。我國(guó)對(duì)違法犯罪未成年人的傳統(tǒng)矯正方法在新形勢(shì)下遇到了嚴(yán)峻挑戰(zhàn),已不能有效發(fā)揮矯正功能。社區(qū)矯正是當(dāng)今世界各國(guó)普遍采用的一種行之有效的矯正方式,而中國(guó)在此方面剛剛起步。未成年犯在生理、心理、認(rèn)知模式上都與成年犯有很大的區(qū)別和特殊性,導(dǎo)致未成年犯社區(qū)矯正具有社區(qū)矯正的共性之外,還具有區(qū)別于成年犯社區(qū)矯正的特點(diǎn)。作為一項(xiàng)新型的司法社會(huì)工作,目前我國(guó)試點(diǎn)省市中基本沒(méi)有確立適合未成年犯特點(diǎn)的社區(qū)矯正管理制度。在理論上和實(shí)際工作中對(duì)于未成年犯社區(qū)矯正的屬性、矯正對(duì)象的范圍確定、矯正模式(包括矯正主體、矯正項(xiàng)目、矯正方法)的構(gòu)建等方面,理論界和實(shí)際工作部門基本上也是一片空白。這樣不加選擇地與成年犯混同操作,既不利于提高未成年犯的矯正質(zhì)量,又影響了社區(qū)矯正工作的效率。因此,針對(duì)未成年人的心理和生理特點(diǎn),構(gòu)建具有中國(guó)特色的未成年犯的社區(qū)矯正體系以及進(jìn)一步完善未成年犯的社區(qū)矯正措施顯得十分必要。 作為一項(xiàng)初探性研究研究,本文以犯罪學(xué)、社會(huì)學(xué)、心理學(xué)、司法行政學(xué)、社會(huì)工作學(xué)等多學(xué)科的基礎(chǔ)知識(shí)為指導(dǎo),研究方法上采用了文獻(xiàn)法、比較研究法和若干實(shí)證調(diào)查綜合分析法。首先論證了當(dāng)前對(duì)未成年人罪犯推行社區(qū)矯正的必要性和緊迫性,接著分析了現(xiàn)有模式和矯正方式的不足,然后探討了可資借鑒的國(guó)外和港澳地區(qū)未成年犯社區(qū)矯正制度的理論和實(shí)踐經(jīng)驗(yàn),并對(duì)國(guó)內(nèi)具有代表性的上海和北京兩地的社區(qū)矯正模式和對(duì)未成年犯開(kāi)展社區(qū)矯正好的做法進(jìn)行了歸納。最后提出了構(gòu)建適合我國(guó)國(guó)情的未成年犯社區(qū)矯正體系的設(shè)想,提出了一系列新的觀點(diǎn),包括矯正主體的完善,矯正項(xiàng)目和矯正方法的創(chuàng)新,并結(jié)合具體工作提出了立法建議。
[Abstract]:In the transition period in China, juvenile delinquency showing a new trend of high incidence and a series of new features, and has become a serious global social problem to be solved urgently. Our tradition of juvenile delinquency correction methods encountered serious challenges in the new situation, has not been able to effectively correct function of community correction is an effective way of correction is widely adopted by many countries in the world, and China have just started in this area. Juvenile offenders in physiological, psychological, cognitive mode and adult with big difference and particularity, leading to juvenile community correction has the general character of community correction, also has the difference in community correction characteristics. As a new judicial social work, at present our country has not established the basic for the pilot provinces and cities in the characteristics of juvenile offenders community correction management system. In theory and Practice for juvenile offenders attributes of community correction, correction of the object scope, correction mode (including the subject of correction, correction, correction method) the construction, theoretical and practical work department basically is a blank. Such indiscriminate and adult offenders operation. Is not conducive to improving the quality of correction of juvenile offenders, and affect the efficiency of community correction. Therefore, according to the physiological and psychological characteristics of minors, construct China characteristics of juvenile community correction system and further improve the juvenile community correction measures is very necessary.
As a preliminary research, in this paper, criminology, sociology, psychology, judicial administration, social work and other basic disciplines of knowledge as a guide, the research methods used the literature method, comparative study method and several empirical investigation and comprehensive analysis method. Firstly, demonstrates the necessity of the implementation of community juvenile criminals correction and urgency, and then analyzes the shortcomings of existing models and methods of correction, and then discusses the reference of foreign and Hong Kong and Macao juvenile community correction system of theoretical and practical experience, and the representative of the domestic Shanghai and Beijing two community correction and community correction for juvenile offenders good it is also summarized. Finally put forward the building suitable for China's construction of community correction system of juvenile offenders, put forward a series of new ideas, including the improvement of the subject of correction, The innovation of the correction project and the correction method, and put forward the legislative proposal in combination with the specific work.
