【摘要】：進(jìn)入20 世紀(jì)90 年代以來,隨著計劃經(jīng)濟(jì)向市場經(jīng)濟(jì)的轉(zhuǎn)變,中國社會正在經(jīng)歷一場全面而深刻的社會變革,在這個過程中,社會資源重新配置,社會利益結(jié)構(gòu)重新調(diào)整,社會分層的結(jié)構(gòu)和機(jī)制發(fā)生急劇變化。同時當(dāng)代中國的犯罪率也明顯增長,尤其是1988 年以來,犯罪率持續(xù)大幅度上升,其增長幅度已超過美國自1960 年以來犯罪率增長的最大幅度。其中處于社會底層的流動人口犯罪、社會較高階層的白領(lǐng)犯罪問題尤為突出,犯罪率不斷上升,那么當(dāng)代中國犯罪在階層分布上有何特點,當(dāng)代中國犯罪是否有來自社會分層方面的原因,以及如何通過優(yōu)化社會分層的途徑去減少犯罪,都值得我們?nèi)パ芯?這也引起了我對當(dāng)代中國犯罪與社會分層的思考。 本文中,筆者主要以實證的方法,結(jié)合比較分析方法、社會分析方法,以當(dāng)代中國的歷史進(jìn)程為宏觀背景,對當(dāng)代中國犯罪的現(xiàn)狀和特點尤其是社會階層分布特點、犯罪的社會分層原因以及通過優(yōu)化社會分層的犯罪控制方式進(jìn)行了研究。當(dāng)然,由于搞實證研究,往往需要很強的社會統(tǒng)計學(xué)、心理學(xué)等方面的知識,而由于本人在這些方面的功底不足,有關(guān)實際操作問題難以深入細(xì)致。而且由于一些實際的困難,很難獲得第一手資料,這也正是本文在研究過程的難點。現(xiàn)將文章的主要內(nèi)容概述如下: 論文的第一部分主要對犯罪和社會分層的基本理論進(jìn)行了概述。分析了犯罪的概念和犯罪的類型、社會分層的概念、我國社會分層的現(xiàn)狀、以及犯罪與社會分層的相關(guān)關(guān)系。在第二部分中,介紹并分析了西方犯罪與社會分層的相關(guān)理論,這些理論主要有社會反常理論、標(biāo)簽理論、文化沖突理論、亞文化理論和批判犯罪學(xué)理論,雖然這些理論不能解釋各種類型的犯罪,但對我們研究犯罪與社會分層的相關(guān)性問題具有很好的借鑒意義。論文的第三部分分析了當(dāng)代中國犯罪的現(xiàn)狀與特點。主要表現(xiàn)為:一是犯罪率不斷上升,呈現(xiàn)出愈演愈烈的新的犯罪高峰趨勢;二是犯罪結(jié)構(gòu)發(fā)生改變,經(jīng)濟(jì)領(lǐng)域的犯罪顯著上升;三是犯罪方式呈現(xiàn)出多樣化和高科技化;四是犯罪階層不再以社會底層群體為主體,而是呈現(xiàn)一種多元化的格局。從當(dāng)代中國犯罪所表現(xiàn)出來的特點來看,可以得出的結(jié)論是:第一,
[Abstract]:Since the 1990s, with the transition from planned economy to market economy, Chinese society is undergoing a comprehensive and profound social transformation. In this process, social resources have been reallocated and the structure of social interests has been readjusted. The structure and mechanism of social stratification have changed dramatically. At the same time, the crime rate in contemporary China has also increased markedly, especially in the past 1988 years, when the crime rate has continued to rise by a large margin. Its growth rate has surpassed the largest increase in the crime rate in the United States since 1960 years. Among them, the floating population at the bottom of the society committed crimes, and the problem of white-collar crime in the higher social class was particularly prominent, with the crime rate constantly rising. Well, what are the characteristics of contemporary Chinese crime in terms of class distribution, whether contemporary Chinese crime is due to social stratification, and how to reduce crime by optimizing social stratification, all of which are worthy of our study. This also caused me to contemporary Chinese crime and social stratification thinking. In this paper, the author mainly uses the empirical method, the comparative analysis method, the social analysis method, taking the historical process of contemporary China as the macroscopic background, the present situation and the characteristic of the contemporary Chinese crime, especially the social stratum distribution characteristic. The reasons for social stratification of crime and the crime control methods by optimizing social stratification are studied. Of course, as a result of empirical research, strong knowledge of social statistics, psychology, and so on is often required. However, due to my lack of knowledge in these areas, it is difficult to make a thorough and detailed study of the practical operation problems. Moreover, due to some practical difficulties, it is very difficult to obtain first-hand information. This is also the difficulty of the research process in this paper. The main contents of this paper are summarized as follows:. The first part of the paper mainly summarizes the basic theory of crime and social stratification, analyzes the concept and types of crime, the concept of social stratification, the current situation of social stratification in China. In the second part, the author introduces and analyzes the theories of crime and social stratification in the west. These theories mainly include social anomaly theory, label theory, culture conflict theory, etc. Subcultural theories and critical criminological theories, although they do not explain all types of crime, But it is of great significance for us to study the correlation between crime and social stratification. The third part of this paper analyzes the present situation and characteristics of contemporary Chinese crime. Showing a new peak trend of crime; second, the crime structure has changed, the crime in the economic field has increased significantly; third, the crime mode is diversified and high-tech; fourth, the criminal stratum no longer takes the social bottom groups as the main body. From the characteristics of contemporary Chinese crime, we can draw the following conclusions: first,
