【摘要】： 被害人惡逆變犯罪是指曾經(jīng)遭受犯罪侵害的被害人,由于其合法權(quán)益受到犯罪行為侵犯,在不良心理的支配及其他因素的推動(dòng)下實(shí)施的犯罪行為。被害人惡逆變的案例在實(shí)際生活中屢屢可見,不僅改變了案件當(dāng)事人及其家人的人生軌跡,更對(duì)社會(huì)造成了嚴(yán)重的危害,是全社會(huì)的悲劇,理應(yīng)引起全社會(huì)的重視。本文希望通過對(duì)被害人惡逆變犯罪的現(xiàn)象、影響因素及其防治等的論述,增進(jìn)人們對(duì)惡逆變犯罪的了解,關(guān)注被害人、關(guān)注被害人惡逆變,并提出減少、遏制此類犯罪的有效措施。本文共分為四個(gè)部分,第一部分主要是對(duì)被害人惡逆變犯罪的概述:先界定惡逆變犯罪的主體——被害人的定義,并將其范圍確定為遭受犯罪行為侵害的自然人被害人;然后闡述惡逆變犯罪的概念、特點(diǎn)以及根據(jù)不同標(biāo)準(zhǔn)對(duì)其進(jìn)行的多種不同的分類,既是對(duì)被害人惡逆變犯罪現(xiàn)象的初步介紹,也為下面進(jìn)一步論述做準(zhǔn)備;論文的第二部分論述了影響惡逆變犯罪發(fā)生的諸多因素,包括被害人因?yàn)榉缸锴趾Χ馐芨鞣N損失這一直接或間接的誘因、被害人自身存在的情緒意志、氣質(zhì)性格和認(rèn)知等方面的消極心理因素以及作用于被害人的不良社會(huì)環(huán)境因素,為后文提出防治被害人惡逆變犯罪的措施提供依據(jù);第三部分筆者試圖從社會(huì)學(xué)和心理學(xué)角度,運(yùn)用相關(guān)理論對(duì)惡逆變犯罪的發(fā)生機(jī)制進(jìn)行解釋;最后第四部分在以上分析的基礎(chǔ)上從被害人自身和社會(huì)環(huán)境因素兩個(gè)大的方面提出預(yù)防和治理惡逆變犯罪的一些意見和建議。如建構(gòu)人們合理健康的心理結(jié)構(gòu)、培養(yǎng)其符合社會(huì)規(guī)范的行為方式,對(duì)受到傷害的被害人進(jìn)行心理援助,平復(fù)被害所帶來的心理傷害,必要時(shí)要進(jìn)行專業(yè)的心理治療,有針對(duì)性的加強(qiáng)法紀(jì)觀教育,增強(qiáng)被害人的法律意識(shí)等;努力構(gòu)建和諧穩(wěn)定的大環(huán)境,使人民群眾生活在安定的政治環(huán)境、良好的經(jīng)濟(jì)環(huán)境、文明的精神環(huán)境和公平的法治環(huán)境中,同時(shí)還要營(yíng)造良好互助的小環(huán)境,使個(gè)體能在溫馨的家庭環(huán)境、和睦的社區(qū)環(huán)境中成長(zhǎng)、生活。另外,在對(duì)實(shí)施了惡逆變犯罪的行為人的處遇上,原則上不能因?yàn)橹暗谋缓η楣?jié)減輕其罪責(zé),但也要綜合考量其犯罪時(shí)的精神狀態(tài)和具體實(shí)際情況,以法律為準(zhǔn)繩,做出輕重適度的判決。
[Abstract]:The crime of the victim's evil inversion refers to the victim who has been infringed by the crime and whose legitimate rights and interests have been infringed by the criminal act. Criminal acts carried out under the influence of bad psychology and other factors. The case of the victim's evil inversion is frequently seen in real life, which not only changes the life track of the party involved in the case and his family, but also changes the life course of the party involved in the case and his family. It is a tragedy of the whole society and should be paid attention to by the whole society. This paper hopes to discuss the phenomenon, factors and prevention of the crime of the victim's evil inversion. This article is divided into four parts: to promote people's understanding of the crime of evil inversion, to pay attention to the victims, to pay attention to the evil inversion of the victims, and to put forward effective measures to reduce and contain such crimes. The first part is an overview of the crime of the victim's evil inversion: firstly, the definition of the victim is defined as the subject of the crime of evil inversion, and the scope of the crime is defined as the victim of the natural person who has been victimized by the criminal act, and then the concept of the crime of the evil inversion is expounded. The characteristics and various kinds of classification according to different standards are not only a preliminary introduction to the criminal phenomenon of the victim's evil inversion, but also preparation for the following further discussion; The second part of the thesis discusses many factors that affect the occurrence of the crime of evil inversion, including the direct or indirect inducement of the victim to suffer various losses because of the crime infringement, the emotional will of the victim himself. The negative psychological factors such as temperament and cognition, as well as the negative social environmental factors acting on the victims, provide the basis for the measures to prevent and cure the crime of evil inversion of the victims. The third part tries to provide the basis from the angle of sociology and psychology. Using the relevant theories to explain the occurrence mechanism of the crime of evil inversion; In the last 4th part, on the basis of the above analysis, the author puts forward some opinions and suggestions on preventing and controlling the crime of evil inversion from the two aspects of the victims themselves and the social environment factors, such as the construction of people's rational and healthy psychological structure. To cultivate their behavior in accordance with social norms, to provide psychological assistance to the injured victims, to heal the psychological injuries caused by the victims, to carry out professional psychotherapy if necessary, and to strengthen the view of law and discipline education. Strengthen the victim's legal consciousness, strive to build a harmonious and stable environment so that the people can live in a stable political environment, a good economic environment, a civilized spiritual environment and a fair legal environment, At the same time, we should also create a small environment of good mutual assistance so that individuals can grow and live in a warm family environment and harmonious community environment. In principle, the crime should not be mitigated because of the previous circumstances, but the mental state and actual situation of the crime should be considered synthetically, and the law should be taken as the criterion to make a judgment of the degree of seriousness.
