【摘要】：社區(qū)矯正制度作為一種重要的刑罰執(zhí)行方式，有助于社區(qū)矯正人員早日回歸社會(huì)，有利于提高刑罰教育改造質(zhì)量，有利于節(jié)約國家行刑資源，并且逐漸發(fā)展成為全世界范圍內(nèi)刑罰執(zhí)行的趨勢(shì)，是刑罰執(zhí)行方式的重要變革。本文主要采用文獻(xiàn)分析法和比較分析法，首先分析了國內(nèi)和國外社區(qū)矯正制度，然后找出我國社區(qū)矯正制度目前存在的問題，從而針對(duì)我國社區(qū)矯正制度，提出完善的對(duì)策和建議。發(fā)達(dá)國家的社區(qū)矯正制度已經(jīng)發(fā)展得很成熟了，如英國、美國、日本等，我國社區(qū)矯正制度發(fā)展時(shí)間還不長，，還存在著許多問題，我國現(xiàn)行社區(qū)矯正法律制度落后，群眾對(duì)社區(qū)矯正制度的認(rèn)識(shí)還不足，社區(qū)矯正工作人員缺乏專業(yè)的法律工作者，執(zhí)法人員結(jié)構(gòu)不合理，社區(qū)矯正監(jiān)管措施缺失。因此，通過對(duì)我國現(xiàn)行社區(qū)矯正制度的思考，完善我國社區(qū)矯正制度，從而推進(jìn)我國刑罰執(zhí)行方式的變革。 本文主要包括五章內(nèi)容。第一章是社區(qū)矯正的制度概述，主要從社區(qū)矯正的概念、法律特征和法律價(jià)值三個(gè)方面進(jìn)行分析。第二章主要闡述了社區(qū)矯正的歷史研究和發(fā)展，包括社區(qū)矯正在國外的歷史演進(jìn)和社區(qū)矯正在我國的歷史演進(jìn)。第三章是我國社區(qū)矯正制度的現(xiàn)狀及問題分析，首先從立法情況和我國主要省份社區(qū)矯正工作的情況分析了目前我國社區(qū)矯正的總體現(xiàn)狀，然后對(duì)我國社區(qū)矯正制度的問題和成因進(jìn)行了分析。第四章闡述了國外社區(qū)矯正制度的基本情況，以英國、美國和日本的社區(qū)矯正制度為例進(jìn)行基本情況的分析，通過對(duì)國外社區(qū)矯正制度的深入分析，提出對(duì)我國社區(qū)矯正的啟示和借鑒。第五章是本文的重點(diǎn)，提出完善我國社區(qū)矯正制度的對(duì)策，這一章主要從完善社區(qū)矯正的相關(guān)法律，建立社區(qū)矯正分類管理的內(nèi)容，增加針對(duì)未成年人罪犯社區(qū)矯正的專門條款，增加社區(qū)矯正人員的權(quán)利保障內(nèi)容，規(guī)范社區(qū)矯正機(jī)構(gòu)這五個(gè)方面提出完善我國社區(qū)矯正制度的對(duì)策。
[Abstract]:As an important way of penalty execution, community correction system is helpful for community correction personnel to return to society at an early date, to improve the quality of penalty education and reform, and to save national execution resources. And it has gradually developed into a worldwide trend of penalty execution, which is an important change in the way of penalty execution. This paper mainly uses literature analysis and comparative analysis to analyze the system of community correction both at home and abroad. Then find out the problems existing in the community correction system in our country, and then put forward some perfect countermeasures and suggestions for the community correction system in our country. The community correction system in developed countries has developed very well, such as the United Kingdom, the United States, Japan, and so on. The development of community correction system in our country is not long, there are still many problems, the current legal system of community correction in our country is backward, the masses' understanding of community correction system is still insufficient, and the community correction staff lack professional legal workers. The structure of law enforcement personnel is unreasonable and the supervision measures of community correction are lacking. Therefore, through thinking about the current community correction system in our country, we can perfect the system of community correction in our country, so as to promote the reform of the way of execution of penalty in our country. This paper mainly includes five chapters. The first chapter is an overview of community correction system, mainly from the concept of community correction, legal characteristics and legal value, the second chapter mainly describes the historical research and development of community correction. It includes the historical evolution of community correction in foreign countries and the historical evolution of community correction in China. Chapter three is the analysis of the current situation and problems of the community correction system in China. First of all, from the legislative situation and the situation of community correction in major provinces of our country, the overall situation of community correction in China is analyzed. Then it analyzes the problems and causes of the community correction system in our country. Chapter 4th expounds the basic situation of the community correction system abroad, taking the community correction system of the United Kingdom, the United States and Japan as an example to analyze the basic situation. Through the deep analysis of the foreign community correction system, this paper puts forward the enlightenment and reference to the community correction system in our country. Chapter 5th is the focus of this paper, and puts forward the countermeasures to perfect the community correction system in our country. To establish the contents of the classified management of community correction, to add special provisions for community correction of juvenile offenders, and to increase the content of the protection of the rights of community correction personnel, The countermeasures of perfecting the community correction system in China are put forward in the five aspects of standardizing the community correction institutions.
