【摘要】：職務犯罪屬于高層化、智能化、跨國化、復雜化的犯罪,具有隱蔽性、行業(yè)性、群體性等特點,偵破工作存在四難：由人到事,判斷難；主體特殊,突破難；一對一交易,取證難；言詞證據多,固證難,是法律與權力、根本利益與局部利益的對抗性較量。因此,建設一支業(yè)務素質強、科技含量高、廉潔意識好、反應速度快、敢于硬碰硬的職務犯罪偵查人才隊伍,是做好職務犯罪偵查工作的重要基礎和保障。對職務犯罪偵查能力的構建和應用,目前理論上眾說紛紜,實踐中要求不一。在明確職務犯罪偵查能力概念和特殊性的基礎上,對其所應包含的內容進行重新厘定和構建,進一步豐富職務犯罪偵查能力的理論研究并為提升職務犯罪偵查能力提供指引。應對職務犯罪偵查能力進行明確的歸類劃分,第一層次可劃分為偵查人員個體偵查能力和檢察機關組織保障能力：對個體偵查能力和組織保障能力還可進行第二、第三層次的劃分。相對應的,影響和制約職務犯罪偵查能力提升的因素也可劃分為偵查個體因素和組織保障因素。提升職務犯罪偵查能力關鍵在于實踐應用,每一項具體的職務犯罪偵查能力都應有其切實可行的提升對策和途徑。 本文在結構上由引言、正文和結束語構成。正文分四大部分。 第一部分主要從職務犯罪偵查能力不同于其他刑事偵查能力的角度進行論述。首先是層層深入明確偵查、職務犯罪偵查、偵查能力、職務犯罪偵查能力的概念,通過比較,分析職務犯罪區(qū)別于普通刑事犯罪的特殊性,然后在前面論述的基礎上,指出職務犯罪偵查能力相對于普通刑事犯罪偵查能力所應具有的特殊要求。 第二部分從重新厘定職務犯罪偵查能力的構建并作分類的角度進行論述。這部分是作者重點關注的地方,也是本論文最重要的內容之一。在對目前幾種論述職務犯罪偵查能力的主要學說觀點進行分析評論的基礎上,作者就當前反腐形勢下職務犯罪偵查能力應包括的內容進行了詳細構建,并結合工作實踐需要對所應具有的偵查能力進行了分類,例如職務犯罪偵查能力第一層次應劃分為偵查人員個體偵查能力和檢察機關組織保障能力；偵查人員個體偵查能力第二層次應劃分為基礎素質、發(fā)現犯罪能力、揭露犯罪能力和證明犯罪能力等職務犯罪偵查能力；基礎素質第三層次又可劃分政治素質、業(yè)務素質、心理素質和身體素質等。 第三部分主要論述了當前制約和影響職務犯罪偵查能力提升的因素。影響和制約職務犯罪偵查能力提升的因素也應相應劃分為偵查人員個體因素和組織保障因素。 最后一部分主要論述了職務犯罪偵查能力的具體應用。這是本論文最有價值的內容。主要是結合職務犯罪偵查能力在理論上的劃分,結合工作需要和實踐中積累的經驗,對每項職務犯罪偵查能力的具體應用提出切實可行的措施和路途。
[Abstract]:Job-related crimes belong to high-level, intelligent, transnational and complicated crimes. They have the characteristics of concealment, industry, group, etc. There are four difficulties in the investigation work: difficult to judge from people to things, special subjects to break through, one-to-one transactions, etc. It is difficult to obtain evidence; if there is much evidence in words, it is difficult to establish proof. It is a confrontational contest between law and power, fundamental interests and local interests. Therefore, building a team with strong quality of business, high scientific and technological content, good sense of integrity, and fast reaction speed, It is an important foundation and guarantee to do a good job in the investigation of job-related crimes. There are different theories about the construction and application of the investigative ability of job-related crimes. On the basis of defining the concept and particularity of the investigation ability of duty crime, the contents should be redefined and constructed. Further enrich the theoretical research of duty crime investigation ability and provide guidance for improving the duty crime investigation ability. The first level can be divided into the individual investigative ability of investigators and the organizational support ability of procuratorial organs: the second and third levels of the ability of individual investigation and organizational support can also be divided. The factors that influence and restrict the improvement of the investigation ability of duty crime can also be divided into individual factors and organizational guarantee factors. The key to enhance the investigation ability of duty crimes lies in the practical application. Each specific duty crime investigation ability should have its feasible promotion countermeasure and the way. The structure of this paper is composed of introduction, text and conclusion. The text is divided into four parts. The first part mainly discusses from the angle that the duty crime investigation ability is different from other criminal investigation ability. The first part is to define the concepts of duty crime investigation, duty crime investigation, duty crime investigation ability and duty crime investigation ability through comparison. This paper analyzes the particularity of the distinction between the duty crime and the ordinary criminal crime, and then points out the special requirements of the duty crime investigation ability relative to the ordinary criminal investigation ability on the basis of the previous discussion. The second part discusses from the angle of redefining the construction and classification of the investigation ability of duty crime. This part is the focus of the author's attention. It is also one of the most important contents of this thesis. The author has made a detailed construction of the contents that should be included in the investigation ability of duty crime under the current anti-corruption situation, and has classified the investigative ability according to the needs of the work practice. For example, the first level of investigation ability of duty crime should be divided into individual investigative ability of investigators and the ability of organization and guarantee of procuratorial organs; the second level of individual investigative ability of investigators should be divided into basic qualities to discover criminal ability. The third level of basic quality can be divided into political quality, professional quality, psychological quality and physical quality. The third part mainly discusses the factors that restrict and influence the promotion of the investigation ability of duty crime, and the factors that influence and restrict the promotion of the investigation ability of duty crime should be divided into individual factors and organizational guarantee factors. The last part mainly discusses the specific application of duty crime investigation ability. This is the most valuable content of this paper. It mainly combines the theoretical division of duty crime investigation ability, combined with the work needs and the accumulated experience in practice. To each duty crime investigation ability concrete application puts forward the feasible measure and the road.
