【摘要】：在倡導(dǎo)刑事一體化的今天，對(duì)犯罪控制的重心逐漸由事后的刑罰處罰向事前和事中的預(yù)防轉(zhuǎn)移。也正因?yàn)槿绱�，犯罪預(yù)防越來(lái)越成為國(guó)家和社會(huì)關(guān)注的焦點(diǎn)，學(xué)術(shù)界與實(shí)務(wù)部門關(guān)于這方面的研究和探索力度也逐漸加強(qiáng)。在犯罪預(yù)防的探索中，職務(wù)犯罪預(yù)防因?yàn)槠洫?dú)特性和相對(duì)重要性越來(lái)越受到關(guān)注，以至于成為一門相對(duì)獨(dú)立的研究方向。再者，隨著社會(huì)主義市場(chǎng)經(jīng)濟(jì)的深入進(jìn)行和政治體制改革的開展，職務(wù)犯罪大量增加，大案要案頻發(fā)，逐漸成為影響改革開放和社會(huì)主義現(xiàn)代化建設(shè)的重要因素。但是，以往單純的刑罰打擊并沒(méi)能有效遏制職務(wù)犯罪的多發(fā)勢(shì)頭，而職務(wù)犯罪預(yù)防因?yàn)槠涫虑翱刂频奶匦院途C合治理的特征越來(lái)越顯示出其控制職務(wù)犯罪的優(yōu)越性，為黨和國(guó)家高度的重視。 本文通過(guò)對(duì)諸多職務(wù)犯罪預(yù)防理論研究現(xiàn)狀的研習(xí)，分析了我國(guó)湖南省職務(wù)犯罪現(xiàn)狀特點(diǎn)和職務(wù)犯罪的成因，依據(jù)新形勢(shì)下我國(guó)現(xiàn)的新思維，以期能為我國(guó)的職務(wù)犯罪預(yù)防機(jī)制增添一份新鮮活力。全文共分五個(gè)部分： 第一章作為緒論部分簡(jiǎn)要闡釋本文的選題背景和意義，并就國(guó)內(nèi)外專家學(xué)者對(duì)職務(wù)犯罪預(yù)防機(jī)制的相關(guān)研究成果進(jìn)行介紹和述評(píng)，在此基礎(chǔ)上闡明本文研究的思路和方法、主要內(nèi)容和可能的創(chuàng)新點(diǎn)。 第二章是相關(guān)概念的闡釋。主要對(duì)職務(wù)犯罪、機(jī)制和職務(wù)犯罪預(yù)防機(jī)制的概念進(jìn)行了界定。這是本文的基礎(chǔ)，從最基本的概念出發(fā)，為后文的論述鋪路。 第三章通過(guò)對(duì)湖南省職務(wù)犯罪的現(xiàn)狀進(jìn)行分析，深入地把握湖南省職務(wù)犯罪預(yù)防的特點(diǎn)并分析職務(wù)犯罪的成因。 第四章分析職務(wù)犯罪預(yù)防機(jī)制現(xiàn)狀和問(wèn)題。借鑒國(guó)外在此方面好的理論和做法，立足現(xiàn)狀，分析利弊，找出問(wèn)題所在，，為后文提出對(duì)策打下基礎(chǔ)。 第五章對(duì)完善職務(wù)犯罪預(yù)防機(jī)制提出對(duì)策建議。這是本文的重點(diǎn)和難點(diǎn)，主要從四個(gè)方面進(jìn)行論述：完善權(quán)力體制和結(jié)構(gòu)、建立權(quán)力監(jiān)督體系、規(guī)范權(quán)力運(yùn)行機(jī)制、嚴(yán)格權(quán)力主體的選用。本章的目的在于對(duì)完善職務(wù)犯罪預(yù)防機(jī)制提供一定的理論幫助，用以指導(dǎo)實(shí)踐。
[Abstract]:In today's advocacy of criminal integration, the focus of crime control has gradually shifted from punishment after the event to prevention in advance and in matters. Because of this, crime prevention has become the focus of national and social concern. In the exploration of crime prevention, the prevention of job-related crimes has attracted more and more attention because of its uniqueness and relative importance. As a result, it has become a relatively independent research direction. Moreover, with the deepening of the socialist market economy and the development of the political system reform, job-related crimes have increased substantially, and major and important cases have occurred frequently. It has gradually become an important factor affecting the reform, opening up and socialist modernization drive. However, in the past, the simple punishment has not been able to effectively curb the tendency of job-related crimes. The prevention of job-related crime, because of its characteristics of prior control and comprehensive management, shows more and more advantages of controlling the crime of duty, which is attached great importance to by the Party and the country. Based on the study of the present situation of duty crime prevention theory, this paper analyzes the characteristics of duty crime and the causes of duty crime in Hunan Province, and according to the new thinking of our country under the new situation, In order to add a fresh vitality to the crime prevention mechanism of our country, the thesis is divided into five parts:. The first chapter, as an introduction, briefly explains the background and significance of this paper, and introduces and reviews the relevant research achievements of domestic and foreign experts and scholars on the prevention mechanism of job-related crime. On this basis, it clarifies the ideas and methods of this study. Main content and possible innovation points. The second chapter is the explanation of related concepts. It mainly defines the concepts of duty crime, mechanism and prevention mechanism of duty crime. This is the foundation of this paper, which paves the way for the following discussion from the most basic concept. The third chapter analyzes the present situation of duty crime in Hunan province, deeply grasps the characteristics of duty crime prevention in Hunan province and analyzes the causes of duty crime. Chapter 4th analyzes the present situation and problems of duty crime prevention mechanism, draws lessons from the good theories and practices of foreign countries in this respect, analyzes the advantages and disadvantages of the present situation, finds out the problems, and lays a foundation for the following article to put forward the countermeasures. Chapter 5th puts forward countermeasures and suggestions to improve the prevention mechanism of job-related crimes. This is the focus and difficulty of this paper, which is mainly discussed from four aspects: perfecting the power system and structure, establishing the power supervision system, standardizing the power operation mechanism, The purpose of this chapter is to provide some theoretical help to perfect the duty crime prevention mechanism and to guide the practice.
