【摘要】：家庭是社會(huì)的基礎(chǔ)組織形式,正是千千萬(wàn)萬(wàn)個(gè)家庭構(gòu)成了整體的社會(huì)。家庭與社會(huì)的不同之處在于,家庭由其成員間的親情、血緣來(lái)維系。家庭關(guān)系的和諧與家庭成員間的互愛(ài),構(gòu)成了現(xiàn)代社會(huì)文明的基石,而家庭暴力行為則是對(duì)家庭關(guān)系的破壞和對(duì)社會(huì)文明的損毀。家庭暴力是一個(gè)全球性的現(xiàn)象,無(wú)論是發(fā)達(dá)國(guó)家還是發(fā)展中國(guó)家,這種現(xiàn)象都不同程度的存在,而婦女是主要受害者。 家庭暴力問(wèn)題的提出,與20世紀(jì)女性人權(quán)意識(shí)的覺(jué)醒是分不開(kāi)的。從70年代起,婦女運(yùn)動(dòng)趨于國(guó)際化,開(kāi)始從理論和實(shí)踐上關(guān)注世界婦女的健康問(wèn)題,于此也揭開(kāi)了家庭暴力這層神秘的面紗。研究結(jié)果發(fā)現(xiàn),婦女因暴力受到傷害的最大威脅并非來(lái)自搶劫、強(qiáng)奸或其他原因造成的損傷,而是來(lái)自女性最親近的配偶的虐待,家庭暴力是婦女受到傷害的最主要的原因。由于傳統(tǒng)對(duì)女性的要求,許多婦女消極地忍受著這種暴力的摧殘,整個(gè)社會(huì)也以盡量回避的態(tài)度,不愿介入到家庭這一私人領(lǐng)域的暴力事件中,法律僅僅制裁那些世人無(wú)法容忍的極端行為。這種共識(shí)與沉默,使眾多的已婚婦女生活在家庭暴力中,這是世界各地普遍存在的現(xiàn)象。 這種現(xiàn)象長(zhǎng)期發(fā)展下去,很容易導(dǎo)致婦女基于反抗的“以暴抗暴”。“當(dāng)婦女對(duì)男性伴侶施以暴力時(shí),往往是一種自衛(wèi)手段,而且是因?yàn)殚L(zhǎng)期遭受另一方暴力和虐待而做出的反應(yīng)”。而婦女一旦做出這種反應(yīng),常常導(dǎo)致犯罪;另一方面,社會(huì)發(fā)展到今天,“婦女解放”、“男女平等”等觀念已深入人心,至少絕大多數(shù)國(guó)家和地區(qū)在法律上確認(rèn)了這一點(diǎn)。越來(lái)越多的婦女在越來(lái)越多的社會(huì)領(lǐng)域里,實(shí)現(xiàn)了自身的價(jià)值,經(jīng)濟(jì)上獲得了完全或者是一定的獨(dú)立。這樣,在家庭領(lǐng)域里,婦女的平權(quán)要求與男性的“保權(quán)”要求相沖突,如果雙方不能正確處理這種關(guān)系,很容易形成互相以暴力解決問(wèn)題的局面,或女性主動(dòng)實(shí)施家庭暴力。這兩種情況都可能導(dǎo)致女性家庭暴力犯罪。 女性家庭暴力犯罪在全球范圍內(nèi),已成為一個(gè)越來(lái)越嚴(yán)重的社會(huì)問(wèn)題。引起了國(guó)際社會(huì)的高度關(guān)注。這是因?yàn)榕宰鳛閯?chuàng)造人類(lèi)文明和推動(dòng)社會(huì)發(fā)展的一支偉大力量,其發(fā)展水平和權(quán)益實(shí)現(xiàn)程度是社會(huì)發(fā)展的重要指標(biāo),也是衡量社會(huì)進(jìn)
[Abstract]:The family is the basic organization of society, and it is the millions of families that make up the whole society. The difference between the family and society is that the family is made up of the affection of its members. The harmony of family relations and the mutual love among family members constitute the cornerstone of modern social civilization, and domestic violence is the destruction of family relations and the destruction of social civilization. Domestic violence is a global phenomenon. In both developed and developing countries, this phenomenon exists to varying degrees, and women are the main victims. The issue of domestic violence is inseparable from the awakening of women's awareness of human rights in 20th century. Since 70s, the women's movement has become international and began to pay attention to the health problems of women in the world, both in theory and in practice. The mystery of domestic violence has also been unravelled. The study found that the greatest threat to a woman's injury from violence is not from robbery, rape or other injuries, but from the abuse of a woman's closest spouse. Domestic violence is the main cause of women's injuries. Because of traditional demands on women, many women passively endure the violence and the whole society tries to avoid it. Unwilling to get involved in violence in the private sphere of the family, the law only punishes extreme acts that the world cannot tolerate. This consensus and silence have led many married women to live in domestic violence. This is a common phenomenon all over the world. The long-term development of this phenomenon can easily lead to women's "violence against violence", which is based on resistance. "when women commit violence against their male partners, it is often a means of self-defense." And it is the reaction of a woman who has been subjected to violence and abuse on the other side for a long period of time "... and when a woman does so, it often leads to crime; on the other hand, the concept of" emancipation of women "and" equality between men and women "has become deeply rooted in the hearts and minds of society as it develops today. At least the vast majority of countries and regions recognize this in law. More and more women realize their own value in more and more fields of society and gain complete or certain economic independence. In this way, in the field of the family, Women's equal rights demands conflict with men's "rights protection" demands. If the two sides do not properly handle this relationship, it is easy to create a situation in which each side solves the problem by violence. Or women actively commit domestic violence. Both situations can lead to female domestic violence crimes. The crime of female domestic violence has become an increasingly serious social problem all over the world. It has attracted a great deal of attention from the international community. This is because women are a great force in the creation of human civilization and in the promotion of social development, Its level of development and the degree of realization of its rights and interests are important indicators of social development and also a measure of social progress.
