【摘要】： 本文共分三個(gè)部分,共三萬(wàn)三千余字。作者以犯罪學(xué)、刑法學(xué)為視野,結(jié)合自身工作實(shí)踐,對(duì)當(dāng)前國(guó)內(nèi)的網(wǎng)絡(luò)賭博犯罪展開(kāi)研究。 第一章主要研究網(wǎng)絡(luò)賭博犯罪的一般性問(wèn)題。作者首先簡(jiǎn)要地?cái)⑹隽酥袊?guó)賭博的歷史沿革和國(guó)內(nèi)禁賭所采取的態(tài)度,即把一般情節(jié)的賭博行為認(rèn)定為違法行為,規(guī)定在治安管理處罰法之中,把嚴(yán)重情節(jié)的賭博行為認(rèn)定為犯罪行為,規(guī)定在刑法之中,這奠定了作者對(duì)于網(wǎng)絡(luò)賭博犯罪研究的法律基礎(chǔ)。由于網(wǎng)絡(luò)賭博犯罪是一種新型的賭博犯罪,然后作者將網(wǎng)絡(luò)賭博犯罪與一般傳統(tǒng)賭博犯罪進(jìn)行比較研究,結(jié)合網(wǎng)絡(luò)賭博犯罪同時(shí)也是一種網(wǎng)絡(luò)工具犯罪的特點(diǎn),提出作者對(duì)于網(wǎng)絡(luò)賭博犯罪的概念,分析了網(wǎng)絡(luò)賭博犯罪相比傳統(tǒng)賭博犯罪不同的特點(diǎn)、類型以及特殊的危害性。之后,作者又簡(jiǎn)要地?cái)⑹隽司W(wǎng)絡(luò)賭博犯罪的發(fā)展現(xiàn)狀以及國(guó)內(nèi)查處的一些典型案例,用以說(shuō)明網(wǎng)絡(luò)賭博犯罪在中國(guó)的蔓延之勢(shì),采取有效措施打擊和防控網(wǎng)絡(luò)賭博犯罪已經(jīng)迫在眉睫。 第二章主要研究網(wǎng)絡(luò)賭博犯罪的原因。作者分析了研究網(wǎng)絡(luò)賭博犯罪原因的意義,并從個(gè)體、社會(huì)兩方面綜合歸納了網(wǎng)絡(luò)賭博的犯罪原因。這一章為過(guò)渡性章節(jié),主要為第三章網(wǎng)絡(luò)賭博犯罪的防控對(duì)策做鋪墊。 第三章主要研究網(wǎng)絡(luò)賭博犯罪的防控對(duì)策,這也是本篇論文的重點(diǎn)章節(jié)。作者主要從網(wǎng)絡(luò)賭博犯罪的法律防控、網(wǎng)絡(luò)賭博犯罪的網(wǎng)絡(luò)警務(wù)、網(wǎng)絡(luò)賭博犯罪的社會(huì)治理三個(gè)方面提出對(duì)網(wǎng)絡(luò)賭博犯罪的防控對(duì)策。在網(wǎng)絡(luò)賭博犯罪的法律防控一節(jié),作者通過(guò)對(duì)網(wǎng)絡(luò)賭博犯罪的管轄、網(wǎng)絡(luò)賭博的犯罪構(gòu)成、網(wǎng)絡(luò)賭博犯罪的法律適用以及網(wǎng)絡(luò)賭博犯罪的法律治理四點(diǎn),分別予以研究。在網(wǎng)絡(luò)賭博犯罪的網(wǎng)絡(luò)警務(wù)一節(jié),作者從網(wǎng)絡(luò)賭博犯罪的偵查、網(wǎng)絡(luò)賭博犯罪的證據(jù)(主要是電子證據(jù))以及網(wǎng)絡(luò)監(jiān)管、技術(shù)的加強(qiáng)三點(diǎn)予以展開(kāi)分析。在第三節(jié)網(wǎng)絡(luò)賭博犯罪的社會(huì)治理中,作者通過(guò)對(duì)網(wǎng)絡(luò)倫理道德的建設(shè)、青少年網(wǎng)民的特殊預(yù)防、網(wǎng)絡(luò)賭博犯罪的綜合治理以及打擊網(wǎng)絡(luò)賭博犯罪的國(guó)際、地區(qū)合作四點(diǎn)予以論述。 尾論部分,作者預(yù)測(cè)了網(wǎng)絡(luò)賭博犯罪存在的長(zhǎng)期性,并提出建立網(wǎng)絡(luò)賭博犯罪長(zhǎng)效研究機(jī)制的結(jié)論。
[Abstract]:This paper is divided into three parts, more than 33,000 words. The author takes criminology and criminal law as the visual field, combining with his own work practice, carries out the research on the current domestic network gambling crime. The first chapter mainly studies the general problems of the crime of network gambling. Firstly, the author briefly describes the history of gambling in China and the attitude adopted by the domestic gambling ban, that is, the general plot of gambling behavior is regarded as an illegal act. Stipulate that in the Law on punishment for Public Security Administration, gambling with serious circumstances shall be regarded as a criminal act and stipulated in the Criminal Law, This laid the legal foundation for the author to study the crime of network gambling. Because the crime of network gambling is a new type of gambling crime, then the author compares the crime of network gambling with that of the general traditional gambling crime. Combined with the characteristic that network gambling crime is also a kind of network instrument crime, the author puts forward the concept of network gambling crime, analyzes the different characteristics, types and special harmfulness of network gambling crime compared with traditional gambling crime. The author also briefly describes the current situation of the development of network gambling crime and some typical cases investigated and dealt with in China to illustrate the spreading trend of the network gambling crime in China. It is urgent to take effective measures to crack down and prevent and control the network gambling crime. The second chapter mainly studies the reason of the crime of network gambling. The author analyzes the significance of studying the reason of the crime of network gambling, and sums up the crime reason of network gambling synthetically from two aspects of individual and society. This chapter is a transitional chapter. Mainly for the third chapter network gambling crime prevention and control countermeasures. The third chapter mainly studies the prevention and control countermeasure of the network gambling crime, which is also the key chapter of this thesis. The author mainly from the network gambling crime legal prevention and control, the network gambling crime network police, the author mainly from the network gambling crime prevention and control, the network gambling crime network police, In the section of legal prevention and control of network gambling crime, the author through the jurisdiction of the network gambling crime, the network gambling crime constitution, The legal application of network gambling crime and the legal administration of network gambling crime are studied separately.
