【摘要】： 勞動(dòng)教養(yǎng)制度是在我國(guó)特定歷史條件下創(chuàng)設(shè)的一種政策性法律制度。認(rèn)真考察勞動(dòng)教養(yǎng)制度的歷史發(fā)展,其作為一種處罰措施,對(duì)于彌補(bǔ)刑法不足,維護(hù)社會(huì)安定起到了非常重要的作用,但在現(xiàn)行的實(shí)踐過程中,由于立法規(guī)定的疏忽,尤其是操作規(guī)范的缺損,勞動(dòng)教養(yǎng)制度在實(shí)施中存在諸多問題,特別是在我國(guó)政府簽署《公民權(quán)利和政治權(quán)利國(guó)際公約》以后,被勞動(dòng)教養(yǎng)人員的人權(quán)保障問題,再次受到中外學(xué)者專家的關(guān)注,勞動(dòng)教養(yǎng)制度的合法性、合理性和正當(dāng)性也不斷受到質(zhì)疑。筆者仔細(xì)分析勞動(dòng)教養(yǎng)制度,探討勞動(dòng)教養(yǎng)制度存在的主要問題,尋求改革的正確途徑和有效措施,以期完善我國(guó)的治安法制建設(shè),強(qiáng)化人權(quán)保障。 本文首先對(duì)勞動(dòng)教養(yǎng)制度進(jìn)行了簡(jiǎn)單概述,介紹了勞動(dòng)教養(yǎng)制度的概念、性質(zhì)以及歷史沿革,綜合我國(guó)勞動(dòng)教養(yǎng)制度的現(xiàn)狀,從而分析我國(guó)勞動(dòng)教養(yǎng)制度存在的主要問題。其次,由于勞動(dòng)教養(yǎng)要對(duì)被決定的勞動(dòng)教養(yǎng)人員采取限制人身自由,并強(qiáng)制勞動(dòng)的一種強(qiáng)制處罰方式,所以因此引發(fā)的人權(quán)保障問題便應(yīng)然而生,本文從勞動(dòng)教養(yǎng)與人權(quán)保障之間的關(guān)系出發(fā),分析勞動(dòng)教養(yǎng)制度與相關(guān)人權(quán)公約的沖突,論證了勞動(dòng)教養(yǎng)制度確有進(jìn)行改造的必要,同時(shí)本文就各國(guó)學(xué)者對(duì)勞動(dòng)教養(yǎng)制度存廢問題的討論,做了簡(jiǎn)單的概述。最后,本文通過以上對(duì)勞動(dòng)教養(yǎng)制度和人權(quán)保障的分析和論述,提出改造勞動(dòng)教養(yǎng)制度的可行性建議,并對(duì)我國(guó)勞動(dòng)教養(yǎng)制度進(jìn)行展望。
[Abstract]:The system of re-education through labor is a kind of policy-oriented legal system created under the specific historical conditions of our country. The historical development of the system of re-education through labor is carefully investigated, which, as a punishment measure, can make up for the insufficiency of the criminal law. The maintenance of social stability has played a very important role, but in the current practice process, due to the negligence of legislative provisions, especially the defects of operational norms, there are many problems in the implementation of the system of re-education through labor. Especially after the signing of the International Covenant on Civil and political Rights by our government, the issue of the protection of the human rights of reeducation through labour personnel has once again attracted the attention of scholars and experts at home and abroad, and the legality of the system of re-education through labour. The rationality and legitimacy of the system have also been questioned. The author carefully analyzes the system of re-education through labor, probes into the main problems existing in the system of re-education through labor, and seeks for correct ways and effective measures to reform in order to perfect the construction of the public security legal system in China. Strengthening the protection of human rights. Firstly, this paper gives a brief overview of the system of re-education through labor, introduces the concept, nature and historical evolution of the system of re-education through labor, and synthesizes the present situation of the system of re-education through labor in China. Then it analyzes the main problems existing in the system of reeducation through labor in our country. Secondly, due to the fact that reeducation through labour should be used to restrict the personal freedom of the decided reeducation through labour personnel and to impose a form of compulsory punishment of labor, Therefore, the problem of human rights protection should arise. From the relationship between reeducation through labour and human rights protection, this paper analyzes the conflict between the reeducation through labour system and the relevant human rights conventions, and demonstrates the necessity of reforming the reeducation through labour system. At the same time, this paper gives a brief summary of the discussion on the retention and abolition of the reeducation through labor system. Finally, through the above analysis and discussion on the reeducation through labor system and human rights protection, the paper puts forward some feasible suggestions for reforming the reeducation through labor system. And carry on the prospect to our country reeducation through labor system.
