【摘要】：虐待部屬行為是指部隊中的各級首長及其他有權(quán)指揮他人的人員,濫用職權(quán),采取毆打、體罰等有損身心健康的手段,折磨、摧殘部屬的行為。虐待部屬情節(jié)惡劣,致人重傷、死亡或造成其他嚴(yán)重后果的,構(gòu)成虐待部屬罪。此類行為一般持續(xù)時間長,參與人員多,且有很強的隱蔽性,不易根除,被揭發(fā)后往往社會影響惡劣,嚴(yán)重敗壞軍隊形象。虐待部屬行為的發(fā)生既有實施者和受害者的個體原因,也有部隊管理教育和社會環(huán)境方面的原因。預(yù)防此類犯罪現(xiàn)象,必須實行綜合治理,完善思想政治教育制度和建立健全部隊各項管理制度。
[Abstract]:The behavior of subordinates of mistreatment refers to the acts of officers at all levels of the armed forces and other persons who have the authority to direct others, abuse of power, use of assault, corporal punishment, and other means harmful to physical and mental health, torture and destruction of subordinates. The maltreatment of subordinates is abominable, resulting in serious injuries. Death or other serious consequences shall constitute the crime of abusing subordinates. Such acts generally last for a long time, have a large number of participants, have a strong concealment and are difficult to eradicate, and are often found to have adverse social effects. Causing serious damage to the image of the armed forces. The abuse of subordinates is caused by the individual causes of the perpetrators and the victims, as well as by the causes of the management, education and social environment of the armed forces... the prevention of such criminal phenomena requires comprehensive management. We will improve the system of ideological and political education and establish and improve the management systems of the armed forces.
