【摘要】：截止 2002 年度,全世界吸毒的人數(shù)已達(dá) 8000 萬人以上,我國的吸毒人數(shù) 每年遞增,已超過 100 萬。全球化的毒品問題對人類的生存和發(fā)展構(gòu)成了重大 威脅,嚴(yán)重阻礙了我國社會主義精神文明和物質(zhì)文明建設(shè)。筆者撰寫本文,從 我國目前毒品犯罪的特點、規(guī)律和共生模式入手,總結(jié)我國禁毒工作中存在的 五大矛盾,并進行理性分析和思考,提出相應(yīng)的對策和方案。 文章通過三大部分進行論述: 第一部分:通過對我國毒品犯罪的特點、共生模式、犯罪市場和發(fā)展態(tài)勢 分析,揭示我國毒品犯罪的規(guī)律、嚴(yán)峻現(xiàn)實和發(fā)展趨勢。文章認(rèn)為,境外毒品 對我國“多頭入境,全線滲透”的總體態(tài)勢沒有根本改變,毒品犯罪逐漸集團化、 家族化、黑社會化、暴力化、職業(yè)化、區(qū)域化和高科技化。毒品問題導(dǎo)致了暴 力犯罪和黑社會犯罪上升和政治權(quán)力腐敗。但從毒品犯罪市場的分析來看,禁 毒不是一場無望斗爭,在洞悉毒品犯罪市場的要素和各環(huán)節(jié)的內(nèi)在規(guī)律后,通 過對毒品犯罪市場的控制,完全可以逐步減少毒品犯罪,最后達(dá)到禁毒的目的。 第二部分:圍繞我國禁毒工作中的一些觀念誤區(qū)和不當(dāng)做法進行分析和思 考,總結(jié)出禁毒工作中的五大矛盾:現(xiàn)實社會毒品的嚴(yán)重性與人們思想認(rèn)識不 1 WP=4 足之間的矛盾;毒品來源的多樣化與毒品控制傳統(tǒng)方式之間的矛盾;打擊毒品 犯罪的法律趨于嚴(yán)厲與實際打擊懲治力度不足之間的矛盾;越來越多的吸毒人 員被強制戒毒與醫(yī)療、矯治效果不明顯之間的矛盾;大眾傳媒對毒品宣傳教育 的積極作用與消極作用之間的矛盾。 第三部分:通過對毒品犯罪市場和禁毒工作中的矛盾分析,根據(jù)我國禁毒 工作的實際情況,總結(jié)前段時期內(nèi)禁毒工作的成就和不足,借鑒國外禁毒工作 的先進經(jīng)驗,指出今后一段時期內(nèi)禁毒工作的重心。筆者認(rèn)為,我國的禁毒方 針必須重新定位,將“四禁并舉、堵源截流、嚴(yán)格執(zhí)法、標(biāo)本兼治”的禁毒方針改 為“四禁并舉、堵源截流、全民防御、標(biāo)本兼治”的提法更為準(zhǔn)確。在打擊毒品犯 罪的立法方面,必須著眼于毒品預(yù)防和控制的立法優(yōu)化,制定統(tǒng)一的《毒品預(yù) 防法》和《戒毒法》。在毒品的預(yù)防和教育中,應(yīng)發(fā)揮學(xué)校和社區(qū)優(yōu)勢,完善 毒品預(yù)防和控制機制。最后提出對毒品犯罪共生模式和吸毒人員控制的具體方 案和加強對毒品犯罪打擊的國際合作。 筆者認(rèn)為,毒品問題在我國日趨泛濫,有其深刻的歷史原因和社會原因, 在社會變遷和重組時期,多種經(jīng)濟成分和分配方式并存,各種利益沖突日益擴 大,導(dǎo)致毒品問題錯綜復(fù)雜,禁毒工作任重而道遠(yuǎn)。然而,在與毒品的斗爭中, 只要形成科學(xué)的思想觀念,掌握毒品犯罪的特點、規(guī)律和發(fā)展態(tài)勢,妥善解決 禁毒工作中的各種矛盾,建立切實可行的毒品預(yù)防教育機制、禁毒機制和反吸 毒體系,各個擊破毒品的生產(chǎn)、運輸和消費環(huán)節(jié),中國的毒品犯罪和吸食問題 是完全可以得到控制的。

Five major contradictions, and rational analysis and thinking, put forward corresponding countermeasures and plans.
