【摘要】： 社區(qū)矯正是積極利用各種社會(huì)資源、整合社會(huì)各方面力量,對(duì)罪行較輕的、主觀惡性較小、社會(huì)危害性不大的罪犯或者經(jīng)過監(jiān)管改造、確有悔改表現(xiàn)、不致再危害社會(huì)的罪犯在社區(qū)中進(jìn)行有針對(duì)性管理、教育和改造的工作,是一種人道、高效、經(jīng)濟(jì)的罪犯處遇制度,被各國(guó)學(xué)者普遍認(rèn)為代表著犯罪矯正的未來走向。為此,社區(qū)矯正工作在世界各國(guó)全面展開,在歐美國(guó)家更是發(fā)展迅猛,已經(jīng)形成了一套完善的制度。我國(guó)是一個(gè)有著濃厚重刑主義傳統(tǒng)的國(guó)家,目前監(jiān)禁刑仍是我國(guó)刑罰體系的主體。雖然,經(jīng)過近幾年的理論探討與實(shí)踐摸索,我國(guó)也在加大社區(qū)矯正的工作力度,但總體發(fā)展水平仍比較低。在以人為本、構(gòu)建社會(huì)主義和諧社會(huì)、促進(jìn)中國(guó)和平崛起的大背景下,面對(duì)國(guó)際行刑領(lǐng)域,在具有監(jiān)禁刑無法比擬的巨大優(yōu)勢(shì)的社區(qū)矯正制度蓬勃發(fā)展的新形勢(shì)下,準(zhǔn)確定位社區(qū)矯正的內(nèi)涵,梳理社區(qū)矯正的源起,分析我國(guó)社區(qū)矯正實(shí)踐的現(xiàn)狀,并有針對(duì)性地予以法律完善,無疑將對(duì)我國(guó)司法制度的改革注入新的活力。本文選擇這一現(xiàn)實(shí)熱點(diǎn)議題,希望從理論層面和實(shí)踐層面兩個(gè)視角對(duì)我國(guó)的社區(qū)矯正作一介紹與論述,并從中考察現(xiàn)實(shí)中存在的問題,有針對(duì)性地提出筆者對(duì)完善我國(guó)社區(qū)矯正制度的構(gòu)想與建議。 從總體結(jié)構(gòu)上來看,本文共分為引言、正文和結(jié)語(yǔ)三個(gè)部分,主要內(nèi)容如下: 引言部分介紹了社區(qū)矯正的國(guó)際化趨勢(shì)、西方國(guó)家在這一領(lǐng)域的發(fā)展?fàn)顩r以及我國(guó)在此方面的實(shí)踐情況,引出了本文的研究?jī)?nèi)容——我國(guó)社區(qū)矯正制度的法律研究。 正文部分從四個(gè)方面展開了對(duì)社區(qū)矯正制度的法律探討。首先,明確了社區(qū)矯正的涵義、特征及價(jià)值;其次,從國(guó)外和國(guó)內(nèi)兩個(gè)角度梳理了社區(qū)矯正制度的源起;第三,考察了我國(guó)社區(qū)矯正制度的現(xiàn)狀;最后,提出了完善我國(guó)社區(qū)矯正制度的對(duì)策。 結(jié)語(yǔ)部分筆者指出,我國(guó)的社區(qū)矯正盡管起步較晚,但在國(guó)家的極力推廣下,社區(qū)矯正也在漸漸的被公眾所認(rèn)同。而且,我們已經(jīng)在社區(qū)矯正的實(shí)踐探索過程中邁出了堅(jiān)實(shí)的一步,社區(qū)矯正制度必定會(huì)有更長(zhǎng)足的發(fā)展。
[Abstract]:Community correction is the active use of all kinds of social resources, the integration of various social forces, the lesser crime, less subjective malignancy, less social harm to criminals, or after supervision and reform, there is indeed repentance. The work of targeted management, education and rehabilitation of criminals who will no longer harm society in the community is a humane, efficient and economic system for the treatment of criminals, which is generally considered by scholars of all countries to represent the future trend of crime correction. The work of community correction has been carried out all over the world, and has developed rapidly in Europe and America, and has formed a set of perfect system. China is a country with a strong tradition of heavy punishment. At present, the prison penalty is still the main body of the penalty system of our country. Although after several years of theoretical discussion and practice exploration, our country is also increasing the work of community correction, but the overall level of development is still relatively low. Under the background of building a harmonious socialist society and promoting the peaceful rise of China, in the new situation of the vigorous development of community correction system with incomparable advantages of imprisonment punishment, facing the international execution field, Accurately positioning the connotation of community correction, combing the origin of community correction, analyzing the current situation of community correction practice in China, and perfecting the law accordingly, There is no doubt that it will inject new vitality into the reform of our judicial system. This paper chooses this practical hot topic and hopes to introduce and discuss the community correction in our country from both theoretical and practical perspectives. From this point of view, the author puts forward some ideas and suggestions on how to perfect the system of community correction in our country. From the overall structure, this paper is divided into three parts: introduction, text and conclusion. The main contents are as follows:. The introduction introduces the internationalization trend of community correction, the development situation of western countries in this field and the practice of our country in this field, which leads to the research content of this article-the legal research of community correction system in our country. The main body part has launched the legal discussion to the community correction system from four aspects. First, has clarified the meaning, the characteristic and the value of the community correction; secondly, has combed the origin of the community correction system from the foreign and the domestic two angles; third, The present situation of community correction system in our country is investigated. Finally, the countermeasures to perfect the community correction system in China are put forward. In the conclusion part, the author points out that although the community correction in our country started relatively late, the community correction has gradually been accepted by the public under the vigorous promotion of the country. We have already taken a solid step in the practical exploration of community correction, and the community correction system will certainly have a great development.
