【摘要】： 黑社會(huì)性質(zhì)犯罪是一個(gè)復(fù)雜的社會(huì)現(xiàn)象，現(xiàn)階段，黑社會(huì)性質(zhì)犯罪組織在我國(guó)的滋生和發(fā)展，正日益成為我國(guó)嚴(yán)重的社會(huì)治安問(wèn)題。本文運(yùn)用比較與實(shí)證的方法，就我國(guó)的黑社會(huì)性質(zhì)犯罪進(jìn)行了比較全面的探討和論述。文章主要包括以下幾個(gè)方面的內(nèi)容：一、黑社會(huì)性質(zhì)組織的概念及特征。在文章的這一部分，先對(duì)黑社會(huì)、黑社會(huì)組織及特征等相關(guān)問(wèn)題進(jìn)行了闡述，后對(duì)我國(guó)黑社會(huì)性質(zhì)組織的概念和特征做了深入論述，并詳細(xì)論述了黑社會(huì)性質(zhì)組織與黑社會(huì)組織、恐怖組織、普通犯罪集團(tuán)、單位犯罪以及幫派落后組織之間的關(guān)系。二、深入論述了黑社會(huì)性質(zhì)組織犯罪的特征。主要是從黑社會(huì)性質(zhì)犯罪的群體性、經(jīng)濟(jì)性、組織性、壟斷性、職業(yè)性、腐蝕性、掩飾性以及暴力性等方面進(jìn)行論述的。三、深入剖析了黑社會(huì)性質(zhì)組織犯罪的成因。主要從歷史、經(jīng)濟(jì)、思想及心理基礎(chǔ)、外部社會(huì)條件、境外黑社會(huì)勢(shì)力滲透、政治腐敗、基礎(chǔ)工作等方面分別進(jìn)行了闡述。四、就黑社會(huì)性質(zhì)犯罪的發(fā)展趨勢(shì)進(jìn)行了具體的論述和預(yù)測(cè)。五、提出了對(duì)黑社會(huì)性質(zhì)犯罪的具體的防治對(duì)策。其中提出在嚴(yán)厲打擊黑社會(huì)性質(zhì)犯罪的過(guò)程中，公安機(jī)關(guān)的反黑職能應(yīng)從隊(duì)伍建設(shè)、情報(bào)信息、加強(qiáng)協(xié)作及偵辦取證等方面進(jìn)行強(qiáng)化。最后，，就國(guó)內(nèi)外對(duì)黑社會(huì)性質(zhì)犯罪的立法及認(rèn)定問(wèn)題進(jìn)行了論述。
[Abstract]:The crime of underworld is a complicated social phenomenon. At present, the breeding and development of criminal organization of underworld nature in our country is increasingly becoming a serious social security problem in our country. This article mainly includes the following aspects: first, the concept and characteristics of the underworld nature organization. In this part of the article, first, to the underworld, The related problems such as the underworld organization and its characteristics are expounded, and the concept and characteristics of the underworld nature organization in our country are discussed in depth, and the underworld nature organization and the underworld organization, the terrorist organization, the ordinary criminal group are discussed in detail. The relationship between the unit crime and the backward organizations of gangs. Secondly, the characteristics of the organized crimes of the underworld nature are discussed in depth. It is mainly from the aspects of group, economy, organization, monopoly, profession and corrosiveness of the underworld crimes. From the aspects of history, economy, thought and psychology, external social conditions, infiltration of foreign triad forces, political corruption, The basic work and other aspects are expounded respectively. Fourthly, the development trend of the underworld crime is discussed and forecasted concretely. This paper puts forward some concrete countermeasures to prevent and cure the crime of the underworld nature. In the course of cracking down on the crime of the underworld character severely, the anti-triad function of the public security organ should be based on the construction of the contingent and the information of information. Finally, this paper discusses the legislation and identification of the crime of underworld nature at home and abroad.
