【摘要】： 在我國經(jīng)濟(jì)高速發(fā)展的同時,社會上相伴而生的一些負(fù)面現(xiàn)象,對未成年人形成了重大影響。由于未成年人缺乏對外來事物的明確地判斷與分析,很可能因不能明辨是非而作出違法犯罪行為,甚至是犯罪。這樣,很容易給自己、家庭、社會帶來惡劣影響。 未成年人違法犯罪類型相對集中,犯罪主體日趨低齡化。共同犯罪逐漸增多,在校學(xué)生和未成年女性違法犯罪增多。此外,由于未成年人易沖動、不理性,所以他們在作出違法犯罪行為時起因簡單、隨意性大。而且,近幾年,未成年人違法犯罪趨向成人化、智能化。和成人違法犯罪相比較,未成年人更具有重復(fù)性特點(diǎn)。 未成年人自身的生理、心理發(fā)育特點(diǎn)對其違法犯罪行為有重要影響。家庭功能不全、家庭教育方式不當(dāng)以及家長行為失范也是導(dǎo)致未成年人違法犯罪的重要原因。學(xué)校重智育、輕德育,教育方法不當(dāng)以及管理不到位都會導(dǎo)致未成年人違法犯罪率的上升。社會上的違法犯罪、貪污腐敗、不道德現(xiàn)象對未成年人形成了惡劣影響,是導(dǎo)致未成年人違法犯罪的重要原因。隨著網(wǎng)絡(luò)的發(fā)展,網(wǎng)絡(luò)不良信息已經(jīng)成為導(dǎo)致未成年人違法犯罪的重要方面。其他不良文化傳媒也是導(dǎo)致未成年人違法犯罪的主要原因。有些地方社區(qū)環(huán)境惡劣,對未成年人產(chǎn)生很壞的影響,甚至?xí)刮闯赡耆俗鞒鲞`法犯罪行為。 因此,在家庭預(yù)防中要作到:父母嚴(yán)格要求自己,最好子女的表率;父母還要運(yùn)用科學(xué)的教育方法。學(xué)校要作到:必須轉(zhuǎn)變重智育輕德育的觀念,改進(jìn)教育方法,加強(qiáng)學(xué)校管理。社會預(yù)防措施包括:加強(qiáng)全民道德教育,完善社會分配制度,消除兩極分化;加強(qiáng)對文化傳媒的監(jiān)督管理,凈化文化傳媒環(huán)境;加強(qiáng)社區(qū)綜合治理,改善社區(qū)環(huán)境。此外還要加強(qiáng)家庭、學(xué)校、社會的聯(lián)系溝通,構(gòu)筑立體防范體系。還要學(xué)習(xí)借鑒別的國家和地區(qū)的先進(jìn)經(jīng)驗(yàn),完善立法和司法制度,才能有效預(yù)防和減少未成年人違法犯罪。
[Abstract]:At the same time , in our country ' s high - speed development , there are some negative phenomena in society , which have great influence on minors . As a minor lacks the explicit judgment and analysis of the external affairs , it is likely that it is impossible to make illegal and criminal acts or even crime because of the lack of external affairs , so it is easy to bring about a bad influence on oneself , the family and society . The juvenile delinquency is relatively concentrated , the crime subject is becoming younger and younger . In addition , because the minors are more impulsive and irrational , they have a simple cause and great randomness in making a criminal act . Moreover , in recent years , the juvenile delinquency tends to be adult and intelligent . In recent years , the minor ' s illegal crime tends to be adult and intelligent . The characteristics of minors ' physical and psychological development have important influence on the behavior of minors . Family function is incomplete , family education mode is improper and parental behavior disorder is the important cause of juvenile delinquency . With the development of network , network bad information has become the main cause of juvenile delinquency . Therefore , in the prevention of family , parents are strict with their own and the best children ' s rate ; parents should also apply the scientific methods of education . The school needs to change the concept of weight - wise education , improve the education methods and strengthen the management of schools . Social protection measures include : strengthening the moral education of the whole people , improving the social distribution system , and strengthening the community comprehensive governance and improving the community environment . In addition , it is necessary to strengthen the communication between the family , school and society and build the three - dimensional prevention system . In addition , the learning and use of advanced experiences from other countries and regions should be made to improve the legislation and the judicial system in order to effectively prevent and reduce the delinquency of minors .
