【摘要】：家庭是社會的基本單元，無論社會處于何種動蕩和暴力中，人們都愿意相信家庭是遠離暴力的安全港灣。然而，事實并非如此。家庭暴力的存在由來已久，但由于家庭暴力發(fā)生在家庭內(nèi)部，遠離公眾視線，很難被外界知曉。直到20世紀(jì)70年代，家庭暴力問題才開始日益受到國際社會的關(guān)注。各種調(diào)查和研究表明，家庭暴力是各國普遍存在的。其中，，婦女和兒童是家庭暴力的主要受害對象。但是，由于家庭暴力所固有的特點以及其成因，使家庭暴力在被確認為犯罪的情形下，使法律在干預(yù)公共領(lǐng)域的暴力外，對家庭暴力卻缺少全面的主動和全面的介入，使家庭暴力得不到應(yīng)有的關(guān)注和司法救濟。本文從分析家庭暴力的概念和成因入手，探討家庭暴力的司法救濟不力的原因，從而提出如何完善對家庭暴力的司法救濟。
[Abstract]:The family is the basic unit of society, no matter what social turbulence and violence, people are willing to believe that the family is a safe haven away from violence. However, this is not the case. The existence of domestic violence has a long history. However, because domestic violence occurs within the family and is far from the public eye, it is difficult to be known to the outside world until 1970s. Domestic violence has only begun to receive increasing attention from the international community. Various surveys and studies show that domestic violence is widespread in various countries. Among them, women and children are the main victims of domestic violence. Because of the inherent characteristics of domestic violence and its causes, domestic violence is recognized as a crime, and the law, in addition to interfering with violence in the public sphere, lacks a comprehensive active and comprehensive intervention in domestic violence. So that domestic violence can not get due attention and judicial relief. This paper analyzes the concept and causes of domestic violence, and discusses the reasons for the lack of judicial remedy of domestic violence. Thus, how to improve the judicial remedy of domestic violence is put forward.
