【摘要】： 社會(huì)的安定和諧是我國(guó)當(dāng)前最大的目標(biāo)。一個(gè)和諧的社會(huì),經(jīng)濟(jì)的發(fā)達(dá)和文化的發(fā)展固然重要,但是最重要的應(yīng)當(dāng)是安定的秩序,能夠保證人民安居樂業(yè)的秩序。因此,打擊犯罪,維護(hù)治安是保證這一目的實(shí)現(xiàn)的有力手段和措施。目前我國(guó)違法犯罪的人員構(gòu)成中,刑釋解教人員占據(jù)了相當(dāng)?shù)谋壤?而且他們的再犯罪往往呈現(xiàn)出惡性化、集團(tuán)化、犯罪手段成熟化等特征,一些大案要案的主犯大多是刑釋解教人員。這儼然構(gòu)成了對(duì)社會(huì)治安和人民生命財(cái)產(chǎn)安全的重大威脅,應(yīng)當(dāng)對(duì)其進(jìn)行嚴(yán)厲的打擊;然而,任何社會(huì)現(xiàn)象背后總是由多種綜合因素造成的,如果只是一味的強(qiáng)調(diào)打擊,往往難以起到降低刑釋解教人員再犯罪率的效果。 “川壅而潰,傷人必多;是故為川者,決之使導(dǎo)”。正如治水一般,筑壩堵水只能起一時(shí)之效,卻埋藏下了一個(gè)重大的隱患,只有疏浚河道,使之排入江河湖海,才能從根本上解決問題�，F(xiàn)實(shí)中,我們經(jīng)常忽視對(duì)刑釋解教人員再犯罪的內(nèi)在原因分析,忽視在立法上對(duì)這種現(xiàn)象進(jìn)行規(guī)制和對(duì)刑釋解教人員進(jìn)行保護(hù),忽視在實(shí)踐中對(duì)刑釋解教人員的幫扶和改造。面對(duì)日益嚴(yán)峻的刑釋解教人員再犯罪問題,必須采取防治相結(jié)合的辦法,對(duì)刑釋解教人員再犯罪的原因加以深刻分析,找出問題的關(guān)鍵并制定相應(yīng)的改革措施;對(duì)刑釋解教人員加以正確引導(dǎo),讓他們能夠重新樹立正確的世界觀和人生觀;對(duì)刑釋解教人員加以有效幫扶,讓他們的再次融入社會(huì)的過程更加順利;對(duì)刑釋解教人員的改造過程和措施進(jìn)行反思,找出我國(guó)在對(duì)違法犯罪人的矯正進(jìn)程中存在的問題,并制定相應(yīng)對(duì)策;探討建立復(fù)權(quán)制度和前科消滅制度的可行性和具體制度的運(yùn)行機(jī)制,對(duì)刑釋解教人員加以立法保護(hù),讓他們能夠在再社會(huì)化過程中避免很多障礙和歧視。
[Abstract]:Social stability and harmony is the greatest goal of our country at present. A harmonious society, economic development and cultural development are important, but the most important thing should be a stable order. Therefore, cracking down on crime and maintaining public order are the effective means and measures to ensure the realization of this goal. Released release of prisoners occupy a considerable proportion, and their reoffending often presents the characteristics of malignancy, collectivization, mature means of crime and so on. Most of the major criminals in some major cases are released from prison, which constitutes a major threat to public security and the safety of people's lives and property, and should be severely dealt with; However, any social phenomenon is always caused by a variety of comprehensive factors. "when the river is overrun, it will hurt a lot; Just like harnessing the water, the dam and water shutoff works only for a while, but there is a major hidden danger, only dredging the river course so that it can be discharged into rivers, lakes and seas. In reality, we often ignore the analysis of the internal causes of the reoffending personnel, ignore the legislation to regulate this phenomenon and protect the released prisoners. In the face of the increasingly serious problem of reoffending, we must adopt the method of combining prevention and cure. The causes of the reoffending of released prisoners are deeply analyzed to find out the key of the problem and to formulate the corresponding reform measures. To give correct guidance to the released prisoners so that they can re-establish the correct world outlook and outlook on life; (B) to provide effective support to released prisoners and to facilitate their reintegration into society; This paper reflects on the reform process and measures of the released prisoners, finds out the problems existing in the process of rectifying the offenders, and formulates the corresponding countermeasures. This paper probes into the feasibility of establishing the system of reinstatement and elimination of criminal record and the operating mechanism of the concrete system, and gives legislative protection to the released and released prisoners so that they can avoid many obstacles and discrimination in the process of re-socialization.
