【摘要】： 近年來(lái),行為人利用行駛的機(jī)動(dòng)車輛進(jìn)行搶奪財(cái)物的行為(俗稱“飛車搶奪”)是在我國(guó)各大中型城市出現(xiàn)的一種較為常見(jiàn)、性質(zhì)嚴(yán)重、手段惡劣、影響極壞的侵財(cái)型犯罪。由于“飛車搶奪”犯罪具有流動(dòng)區(qū)域大、逃離現(xiàn)場(chǎng)快、作案時(shí)間短、遺留證據(jù)少、取證抓捕難,對(duì)受害人的人身和財(cái)產(chǎn)傷害大等特點(diǎn),不僅嚴(yán)重侵犯了公民的財(cái)產(chǎn)權(quán)利,而且威脅到公民的人身安全,一直以來(lái),都是各級(jí)司法機(jī)關(guān)打擊的重點(diǎn),也是社會(huì)治安綜合治理的一個(gè)頑疾,已經(jīng)引起政府和社會(huì)各界的廣泛關(guān)注。 論文首先對(duì)“飛車搶奪”行為進(jìn)行概述,并對(duì)其行為特征、案件多發(fā)原因以及危害進(jìn)行分析,最后對(duì)公安機(jī)關(guān)如何對(duì)“飛車搶奪”犯罪進(jìn)行防范深入討論,提出了一系列的應(yīng)對(duì)策略,既有現(xiàn)象分析,也有法理討論,同時(shí)還有應(yīng)對(duì)策略,在一定程度上對(duì)打擊“飛車搶奪”犯罪起到了拋磚引玉的作用。
[Abstract]:In recent years, the behavior of people who use motor vehicles for robbery behavior (commonly known as the "robbery") in China's large and medium-sized city have a common, serious nature, means bad, very bad influence of crimes against property. Because of the "robbery crime" has a large flow area. Quickly fled the scene, crime time is short, the evidence left little evidence to arrest, the characteristics of the victim's personal and property damage, which not only infringes the property rights of citizens, and since the threat to the safety of the people, always are the focus of the fight against judicial organs at all levels, is a comprehensive social security treatment of diseases, has caused widespread concern of the government and the community.
This paper first gives an overview of the "robbery" behavior, and the behavior characteristics, the case of multiple causes and hazards are analyzed, finally to the public security organs of the "robbery" crime prevention in-depth discussion, put forward a series of strategies, both the phenomenon analysis, there are legal discussion, but also to deal with strategy, to a certain extent in the fight against the "robbery" crime played a valuable role.
