【摘要】：在我國社會轉(zhuǎn)型時期，，未成年人違法犯罪呈現(xiàn)出新的高發(fā)態(tài)勢和一系列新的特征，已成為迫切需要解決的社會問題。我國對未成年犯的傳統(tǒng)矯正方法在新形勢下遇到了嚴峻挑戰(zhàn)，已不能有效發(fā)揮矯正功能。社區(qū)矯正是當今各國普遍采用的一種行之有效的矯正方式，而中國在此方面剛起步。未成年犯在生理、心理、認知模式上都與成年犯有很大的區(qū)別和特殊性，因此區(qū)分未成年犯與成年犯社區(qū)矯正很重要。作為一項新型的司法社會工作，目前我國試點省市中基本沒有確立適統(tǒng)一的未成年犯社區(qū)矯正管理模式。實踐中與成年犯混同操作的現(xiàn)象很常見，這不利于提高未成年犯的矯正質(zhì)量，又影響了社區(qū)矯正工作的效率。因此，針對未成年人的心理和生理特點，構(gòu)建具有中國特色的未成年犯社區(qū)矯正體系以顯得十分必要。
[Abstract]:In the period of social transformation, juvenile delinquency presents a new trend of high incidence and a series of new characteristics. It has become a social problem that needs to be solved urgently. The traditional correction methods of juvenile delinquents in our country have met with severe challenges under the new situation. Community correction is a kind of effective correction method which is widely used in many countries nowadays, but China has just started in this respect. Juvenile offenders are in physiology and psychology. Cognitive models are very different from adult offenders and particularity, so it is very important to distinguish juvenile offenders from adult offenders. As a new type of judicial social work, it is very important to distinguish juvenile offenders from adult offenders. At present the pilot provinces and cities in China have not established a suitable unified management mode of juvenile delinquents community correction. In practice the phenomenon of mixed operation with adult offenders is very common which is not conducive to improving the correction quality of juvenile offenders. Therefore, it is necessary to set up a community correction system with Chinese characteristics according to the psychological and physiological characteristics of minors.
