【摘要】：未成年人犯罪是現(xiàn)在世界各國普遍關(guān)注的一個(gè)社會(huì)問題,我國也不例外。特別是改革開放以來,我國未成年人犯罪日趨嚴(yán)重,未成年人已經(jīng)上升成為我國犯罪的主體,并且其社會(huì)危害性非常大。據(jù)統(tǒng)計(jì)表明,20世紀(jì)80年代以來,我國的未成年人犯罪在刑事犯罪案例中所占的比例呈逐年上升趨勢,90年代以后,雖然未成年人犯罪的總體情況呈下降趨勢,但是在未成年人犯罪中嚴(yán)重危害社會(huì)治安的犯罪比例卻逐年上升。未成年人犯罪同成人犯罪不同,它有其自身的特點(diǎn),并且趨向于智能化、成人化、暴力化,農(nóng)村未成年人犯罪、毒品犯罪,網(wǎng)絡(luò)犯罪日益增加。未成年人犯罪的原因是多方面的,也是錯(cuò)綜復(fù)雜的,既有自身原因,也有家庭、學(xué)校、社會(huì)的原因等。本文通過對(duì)監(jiān)管場所未成年犯的調(diào)查與訪談,對(duì)比分析出未成年人犯罪的一系列原因,針對(duì)這一系列原因,在加強(qiáng)預(yù)防未成年人犯罪的同時(shí),就如何從家庭、學(xué)校、人際關(guān)系、社會(huì)綜合治理方面結(jié)合我國實(shí)際情況提出一些對(duì)未成年犯在監(jiān)管場所進(jìn)行教育矯治的可行性對(duì)策。對(duì)策有重視家庭的中心作用；鞏固學(xué)校這一培養(yǎng)造就一代新人的陣地,加強(qiáng)學(xué)校教育；為未成年人營造一個(gè)良好的人際關(guān)系網(wǎng)；搞好社會(huì)綜合治理和社區(qū)矯治�？刂茖�(duì)策有對(duì)犯罪未成年人進(jìn)行必要的刑事處罰,并注重處罰效果；加強(qiáng)對(duì)犯罪未成年犯在監(jiān)管場所的教育改造,提高管教水平,對(duì)刑釋解教的青少年做好社會(huì)幫教工作。
[Abstract]:Juvenile delinquency is a social problem which is concerned by all countries all over the world, and China is no exception. Especially since the reform and opening up, juvenile delinquency in our country is becoming more and more serious. Minors have become the main body of crime in China, and its social harm is very great. Statistics show that since 80s of the 20th century. The proportion of juvenile delinquency in criminal cases in China has been increasing year by year since 1990s, although the overall situation of juvenile delinquency is declining. However, the proportion of juvenile delinquency that seriously endangers social security has increased year by year. Juvenile delinquency is different from adult crime, it has its own characteristics, and tends to intelligent, adult, violent. Juvenile delinquency in rural areas, drug crimes, network crimes are increasing. The causes of juvenile delinquency are various and complex, both for their own reasons, but also for families and schools. Through the investigation and interview of juvenile offenders in the place of supervision, this paper compares and analyzes a series of causes of juvenile delinquency, aiming at these reasons, while strengthening the prevention of juvenile delinquency. About how to go from family, school, relationships. According to the actual situation of our country, the author puts forward some feasible countermeasures of education and correction of juvenile delinquents in the place of supervision, which has the central role of paying attention to the family; To consolidate the school, which is the front of cultivating a new generation of students, and to strengthen the school education; To build a good interpersonal network for minors; Do well the society comprehensive management and the community corrects. The control countermeasure has to carry on the necessary criminal punishment to the crime minor, and pays attention to the punishment effect; We should strengthen the education and reform of juvenile delinquents in the place of supervision, improve the level of discipline, and do a good job in helping and educating young people who have been released from prison.
