【摘要】：我國近些年來持續(xù)的開展的“打黑除惡”行動,打掉了一部分的黑社會性質(zhì)組織,有利于保護人民的正常生活,維護社會的正常秩序。但是也讓我們認識到了黑社會性質(zhì)組織的發(fā)展速度,因其一些現(xiàn)象特性而警惕。“打黑除惡”一直作為一項專項斗爭而進行,一定程度上扼制了黑社會性質(zhì)組織的發(fā)展,但是另一方面這項斗爭是一種刑事手段的存在而并非作為長期而持久、詳細的列于刑事法律的進程中,其所要求的是在特定時間內(nèi)達到一定的結(jié)果,這樣導(dǎo)致的結(jié)果是“打則消,不打則漲”,為了保證“打黑除惡”專項斗爭的效果得以延續(xù),必須建立長效機制。本文總共分為三章對此進行論述,第一章為黑社會(性質(zhì))組織的概述,第一節(jié)簡要分析域外地區(qū),如日本、意大利、臺灣等地黑社會的現(xiàn)狀,以及域外打擊黑社會行動的特點,因域外黑社會的形成和發(fā)展都久于我國,其打擊黑社會的經(jīng)驗也較豐富具有值得我國借鑒之處;第二節(jié)以數(shù)據(jù)結(jié)合典型案例的方式分析我國當前黑社會性質(zhì)組織具有犯罪種類多樣化、分布范圍廣、尋求“保護傘”、再生能力快等特點,黑社會性質(zhì)組織產(chǎn)生、發(fā)展都有一定的規(guī)律可循,我國黑社會性質(zhì)組織的特點決定了我國“打黑除惡”的手段。第二章通過文獻資料分析的方法,分析我國“打黑除惡”專項斗爭的開展,全國范圍內(nèi)1983年至1986年,1996年至1997年,以及2000年以后的三次“打黑”斗爭和效果,以及具有特性的一些省市如廣東、重慶等地“打黑”斗爭的開展特點及效果。第三章從建立長效機制角度,分析延續(xù)我國“打黑除惡”斗爭效果的辦法,刑事立法方面結(jié)合《刑法修正案⺌八⺗》分析如何加大對黑社會性質(zhì)組織犯罪的懲處力度,司法方面注意兼顧被告人和被害人兩方面的權(quán)益。

Some phenomena of "anti evil" has been used as a special campaign to a certain extent, hinders the development of the underworld organization, but on the other hand, the struggle is a kind of criminal means have not as long lasting, detailed in the criminal law in the process of the requirements is to achieve certain results in a certain period of time, the result is "playing the news, don't play it up", in order to ensure the "crime crackdown" special struggle effect continues, must establish a long-term mechanism. This paper is divided into three chapters in this For this, the first chapter is the Underworld (nature) organization overview, the first section briefly analyzes the outside areas, such as Japan, Italy, Taiwan and other places of the underworld, and the characteristics of the extraterritorial triad action, due to the formation and development of foreign black society are long in our country, the triad of experience is also rich is worthy of our reference; the second part is the analysis of China's current Mafia Crime organization has a variety of data in the typical case, wide distribution, for "umbrella", the characteristics of the regeneration ability of fast, underworld organization, development has certain rules, characteristics the mafia has decided our country "crime crackdown" means. The second chapter through the analysis of the literature data, analysis of the special struggle in China "crime crackdown" carried out nationwide from 1983 to 1986, From 1996 to 1997, and after 2000 three "anti" struggle and effect, and has the characteristics of some provinces and cities such as Guangdong, Chongqing and other places to carry out the fight "anti" characteristics and effect. The third chapter from the angle of the establishment of long-term mechanism, analysis the continuation of China's "crime crackdown" struggle effect approach, combined with the criminal legislation "criminal law amendment? Eight? > analysis of how to intensify efforts to punish the crime of underworld organization, judicial pay attention to two aspects of the defendant and the victim's rights and interests.
