【摘要】：由于超限超載運(yùn)輸嚴(yán)重破壞公路路面及其橋梁設(shè)施,造成國(guó)家交通規(guī)費(fèi)的大量流失,導(dǎo)致交通運(yùn)輸市場(chǎng)的惡性循環(huán)競(jìng)爭(zhēng),容易引發(fā)道路交通事故,危及人民群眾的生命財(cái)產(chǎn)安全,導(dǎo)致汽車工業(yè)的畸形發(fā)展,經(jīng)國(guó)務(wù)院批準(zhǔn),從2004年6月20日起,在全國(guó)范圍內(nèi),對(duì)超限超載車輛進(jìn)行集中治理。9年過(guò)去了,超限超載運(yùn)輸屢禁不止,收效有限,這說(shuō)明我國(guó)相關(guān)的法律還不完備,行政管理體制也存在諸多問(wèn)題,政府部門之間協(xié)調(diào)性、系統(tǒng)性差的缺陷,沒(méi)有形成有效的約束監(jiān)督機(jī)制等,影響了執(zhí)法機(jī)關(guān)、執(zhí)法人員高效、公正的執(zhí)法。 超限超載運(yùn)輸治理是交通綜合行政執(zhí)法的難點(diǎn),而且廣東省作為我國(guó)交通部的交通綜合行政執(zhí)法試點(diǎn)之一,以廣州市交通委員會(huì)綜合行政執(zhí)法局為案例分析,對(duì)全國(guó)的交通執(zhí)法改革有著重要意義。 本文利用公共政策、公共治理、公共管理等方面的理論,通過(guò)治理超限超載運(yùn)輸?shù)默F(xiàn)狀,梳理現(xiàn)階段公路交通行政執(zhí)法方面存在的問(wèn)題,從經(jīng)濟(jì)、體制、法律等方面著手討論,認(rèn)真分析影響治理效果的深層次原因,解讀治理超限超載運(yùn)輸相關(guān)法律法規(guī)的精神,嘗試提出行政管理體制的改革,并結(jié)合交通執(zhí)法工作實(shí)際,提出抓緊制定和完善相關(guān)配套哪些法規(guī),形成長(zhǎng)效機(jī)制,從而進(jìn)一步推動(dòng)交通依法行政工作的深入發(fā)展,切實(shí)提高政府部門公共交通服務(wù)和執(zhí)法水平。
[Abstract]:Owing to the severe damage to highway pavement and its bridge facilities caused by over - load transport , the serious loss of traffic regulations in the country is caused , which leads to a vicious circle of traffic accidents , which endangers the safety of life and property of the people . It has been approved by the State Council . Since June 20 , 2004 , there are many problems in China ' s related laws , such as the lack of coordination among government departments , the defects of systematic difference , and the lack of effective restriction monitoring mechanism , etc . , which has affected the law enforcement agencies and law enforcement officials in the enforcement of justice . Over - load transport is the difficulty of traffic integrated administrative law enforcement , and Guangdong Province , as one of the traffic integrated administrative law enforcement pilots in China , is of great significance to the reform of traffic law enforcement in the country . Based on the theory of public policy , public governance , public administration and so on , this paper discusses the problems existing in the administrative law enforcement of highway transportation through the management of the current situation of super - load transportation , analyzes deeply the reasons of influencing the governance effect , tries to put forward the reform of administrative management system , and puts forward the reform of administrative management system .
