【摘要】：社交網(wǎng)站符合現(xiàn)代人生活方式和信息時(shí)代發(fā)展趨勢，，因此在互聯(lián)Web2.0的時(shí)代背景下，正以較快的速度在發(fā)展。社交網(wǎng)絡(luò)業(yè)務(wù)也已經(jīng)成為熱門的互聯(lián)網(wǎng)業(yè)務(wù)。信息時(shí)代人們追求信息獲得途徑的高效和便捷，追求信息之間的自由、分享和互動，這些決定了社交網(wǎng)絡(luò)的產(chǎn)生。而信息在社交網(wǎng)站上的傳播以及社交網(wǎng)絡(luò)社會特性決定了社交網(wǎng)絡(luò)犯罪的產(chǎn)生。人類生存范圍的拓寬，生活方式的豐富固然是人類孜孜以求的結(jié)果，但任何事物都有著兩面性，社交網(wǎng)絡(luò)犯罪就是我們面對的隱患與困擾。它不僅會影響人們的正常生活而且還會影響到整個(gè)社會的穩(wěn)定。社交網(wǎng)站是滋生各種各樣社交網(wǎng)絡(luò)犯罪的溫床，例如Face book、人人網(wǎng)等。社交網(wǎng)絡(luò)犯罪的高發(fā)態(tài)勢以及社交網(wǎng)絡(luò)特有的虛擬性、超時(shí)空性、隱蔽性、信息的快速流動性、社會信息與財(cái)富的高度聚集性等特點(diǎn)決定了預(yù)防打擊社交網(wǎng)絡(luò)犯罪的復(fù)雜性。 社交網(wǎng)絡(luò)犯罪的研究在我國尚處于起步階段。本文試圖通對SNS社交網(wǎng)絡(luò)犯罪發(fā)生原因的探索，提出懲治對策，以期為我國打擊SNS社交網(wǎng)絡(luò)犯罪的研究和預(yù)防提供借鑒。本文分為三個(gè)部分：社交網(wǎng)絡(luò)犯罪的概述部分、社交網(wǎng)絡(luò)犯罪的原因部分、社交網(wǎng)絡(luò)犯罪的預(yù)防和懲治部分。第一部分社交網(wǎng)絡(luò)犯罪的概述部分，從社交網(wǎng)絡(luò)犯罪概念界定著手，對社交網(wǎng)絡(luò)犯罪理論進(jìn)行介紹和梳理，就社交網(wǎng)絡(luò)犯罪與傳統(tǒng)的網(wǎng)絡(luò)犯罪以及計(jì)算機(jī)犯罪進(jìn)行深入的比較研究，突出社交網(wǎng)絡(luò)犯罪的特殊性，最后分析了幾類典型的社交網(wǎng)絡(luò)犯罪。第二部分社交網(wǎng)絡(luò)犯罪的原因部分，分別從社交網(wǎng)絡(luò)犯罪成本原因、道德倫理原因、本體脆弱性原因三個(gè)方面探討了社交網(wǎng)絡(luò)犯罪的成因。第三部分社交網(wǎng)絡(luò)犯罪的預(yù)防和懲治部分，在分析和研究日本和歐美等國在打擊社交網(wǎng)絡(luò)犯罪方面的對策和實(shí)踐基礎(chǔ)上，重點(diǎn)研究我國對社交網(wǎng)絡(luò)犯罪的預(yù)防和懲治，以期對我國打擊社交網(wǎng)絡(luò)犯罪進(jìn)上綿薄之力。
[Abstract]:Social networking sites conform to modern life style and the development trend of the information age, therefore, in the context of the era of interconnected Web2.0. Social network business has also become a hot Internet business. In the information age, people pursue the efficient and convenient access to information, the freedom, sharing and interaction between information. These determine the emergence of social networks. And the spread of information on social networks and social characteristics of social networks determine the emergence of social network crime. The richness of the way of life is the result of human endeavor, but everything has two sides. Social network crime is the hidden trouble and trouble that we face. It will not only affect people's normal life but also affect the stability of the whole society. Social network is the breeding ground of all kinds of social network crime. Such as Face, Renren.com, etc. The high incidence of social network crime and the unique social network virtual, space-time, hidden, rapid mobility of information. The high concentration of social information and wealth determines the complexity of preventing and combating social network crime. The study of social network crime in China is still in its infancy. This paper attempts to explore the causes of social network crime in SNS, and puts forward countermeasures to punish it. This paper is divided into three parts: the overview of social network crime, the reasons for social network crime. The first part of the overview of social network crime, starting with the definition of social network crime, the theory of social network crime is introduced and combed. Social network crime and traditional network crime as well as computer crime in-depth comparative study, highlighting the particularity of social network crime. Finally, it analyzes several typical social network crime. The second part of the social network crime reasons, respectively from the cost of social network crime reasons, moral and ethical reasons. The causes of social network crime are discussed in three aspects: the third part is the prevention and punishment of social network crime. On the basis of analyzing and studying the countermeasures and practices of Japan, Europe and the United States and other countries in the fight against social network crime, this paper focuses on the prevention and punishment of social network crime in China. With a view to cracking down on our social network crime into a modest force.
