【摘要】：縱觀世界范圍內(nèi)的女性犯罪問題,女性犯罪率不斷攀升不再是哪個國家的個別現(xiàn)象,而是犯罪學領(lǐng)域所面臨的全球性社會問題。女性犯罪不但給眾多家庭造成了悲劇,而且對社會的危害程度日趨嚴重,成為影響經(jīng)濟發(fā)展、社會穩(wěn)定不可忽視的因素。 本文以女性犯罪為視角,在相關(guān)法學理論的指導下,通過文獻檢索和參考閱讀大量的關(guān)于女性犯罪的文章,運用比較、概括和總結(jié)相結(jié)合的方法,闡述了當前我國女性犯罪原因及矯治的一些理論和實踐問題。對女性犯罪原因進行深刻的分析,力求突破一些傳統(tǒng)的看法,多角度深刻的揭示女性犯罪的本質(zhì)原因,并進行有針對性矯治以防止女性犯罪人再犯,提高女性犯罪人的改造率,減少回歸社會后的重新犯罪現(xiàn)象,從而減少女性犯罪行為的發(fā)生。 論文主體部分三章進行論述。 第一章主要闡述了女性犯罪的概念,以及國、內(nèi)外犯罪學家對女性這一特殊犯罪群體犯罪的研究概況。并以具體數(shù)字為依托,分析、總結(jié)了當前女性犯罪的現(xiàn)狀及發(fā)展趨勢,闡述了女性犯罪在犯罪類型、手段、方法等方面的變化及女性犯罪的危害性。希望對女性犯罪現(xiàn)象有一個最初和直觀地了解。 第二章是對女性犯罪原因的剖析。在了解女性犯罪現(xiàn)狀后,本章在論述女性犯罪原因時,分別從生理因素、心理因素、社會家庭因素三個方面深入剖析導致女性犯罪的原因。在生理因素方面,分別從女性青春期生理發(fā)育的不可塑性、女性生理周期、女性生理發(fā)育過剩三方面論述了女性犯罪的生理原因;在論述女性犯罪的心理因素上,是從女性犯罪的攻擊性、隱蔽性、沖突性等特點論述女性犯罪受自私、貪婪、壓抑、虛榮、道德水平低、心理沖突等因素影響,并作了較詳盡的闡述;在造成女性犯罪的社會、家庭因素中,分別從社會經(jīng)濟因素、文化教育因素、不良文化誘惑、婚姻感情危機、家庭暴力、家庭貧困、家庭教育缺失等方面進行詳細論述。旨在通過對女性犯罪原因的剖析為女性犯罪的矯治提供方向。犯罪是一種極為復雜的社會現(xiàn)象,犯罪原因是一個多極、多層次的系統(tǒng),任何單一因素都引發(fā)不了犯罪,探究女性犯罪行為的發(fā)生,必需將生理、心理、社會家庭原因結(jié)合起來,任何一種犯罪行為的發(fā)生都是上述三種因素相互作用的結(jié)果。 第三章介紹了犯罪心理矯治的概念、理論及方法,并對國外心理矯治理論、方法進行了詳細介紹。在了解犯罪矯治理論、方法的前提下又著重論述了從心理治療角度對女性犯罪進行矯治,并簡要介紹了其他關(guān)于女性犯罪的矯治策略。通過以上具體方法的運用,對矯治女性犯罪產(chǎn)生實質(zhì)性作用。 女性犯罪呈不斷上升、發(fā)展趨勢,由此帶來的各種各樣的社會問題,沖擊著社會生活的各個環(huán)節(jié),對社會穩(wěn)定來說無疑是個危險的信號。女性犯罪有其自身的特點和原因,是社會犯罪的重要組成部分。本文通過研究女性犯罪的現(xiàn)狀、趨勢、原因,及女性犯罪的心理矯治方法,以期望降低女性犯罪率。
[Abstract]:Female crime problem throughout the world, women rising crime rate is not individual phenomenon which country, face global social problems but criminology field. Female crime not only caused the tragedy to many families, and the degree of harm to society become increasingly serious, affect economic development, social stability can not be ignored.
In this paper, from the perspective of female crime, guided by the theory of law, through the literature search and reading a lot of reference about the female crime of the article, using the comparative method, summarizes the combination of theory and practice, expounds some problems and the reasons of female crime treatment. Deeply analyzes the reasons of female the crime, and strive to break through some traditional views and multi angle reveals the essential reasons of female crime, and targeted treatment to prevent women offenders again, improve women offenders transformation rate, reduce to return the society after the crime, so as to reduce the occurrence of female crime.
The three chapter of the main part of the thesis is discussed.
The first chapter mainly introduces the concept, the female crime and the research situation inside and outside the country, committed by women a special criminal groups of crime. And with specific numbers to rely on analysis of current situation and developing trend of female crime is summarized, elaborated the female crime in the crime types, means, harmfulness and changes of women criminal methods and so on. Hope to have an initial and intuitive understanding of the female crime phenomenon.
The second chapter is the analysis of the reasons of female crime. To understand the status of women in crime, this article discusses why female crime, respectively from the physiological factors, psychological factors, the three aspects of social and family factors in-depth analysis of the causes of female crime. In the physiological factors, not plasticity respectively from the female puberty. The female physiological cycle, female physiological development of the three aspects discussed in excess of female crime physiology; in the female crime to the psychological factors, from attack, female crime concealment, characteristics of conflicts on female sex crimes by selfishness, greed, vanity, depression, low level of moral, psychological conflict and other factors influence, and made a more detailed elaboration; the cause of the female crime in social, family factors, separately from the social and economic factors, cultural factors and cultural education, bad temptation, marriage crisis, family violence, family Family poverty, lack of family education and other aspects are discussed in detail. This paper aims to analyse the reasons of female crime treatment for women of the crime to provide direction. Crime is an extremely complex social phenomenon, the cause of crime is a multipolar, multi-level system, any single factors are not the cause of crime, explore the behavior of the female crime there must be, physiological, psychological, social and family reasons together, any kind of crime occurs is the interaction of these three factors results.
The third chapter introduces the concept of crime psychology, the theories and methods of psychological correction foreign theory and method are introduced in detail. In the understanding of crime correction theory and method under the premise and focuses on the psychological management point of view from female crime correction, and briefly introduces other women about crime treatment strategies use. Through the above methods, have a substantial effect on the treatment of female crime.
Female crime is rising, the development trend, which has all sorts of social problems, the impact of all aspects of social life, the social stability is a dangerous signal. Female crime has its own characteristics and reasons, is an important part of social crime. Through the present status, the study of female crime trends that reason, psychological treatment methods and female crime, in order to reduce female crime rate.
