【摘要】：涉農(nóng)職務(wù)犯罪是指法定義務(wù)的國(guó)家公職人員不履行或不正確履行管理涉農(nóng)公共事務(wù)的職責(zé),或利用公共職權(quán)為自己或他人謀取不當(dāng)利益,妨害國(guó)家對(duì)職務(wù)行為的管理,損害了農(nóng)民、農(nóng)村的利益,并應(yīng)受刑事處罰的行為�！叭r(nóng)”問(wèn)題,關(guān)系到社會(huì)主義新農(nóng)村建設(shè)的成敗,關(guān)系到全面建設(shè)小康社會(huì)的大局,也關(guān)系到整個(gè)國(guó)家的長(zhǎng)治久安,是我黨工作的重中之重。如何深入查辦涉農(nóng)職務(wù)犯罪,推進(jìn)農(nóng)村反腐倡廉建設(shè),切實(shí)維護(hù)廣大農(nóng)民利益,維護(hù)農(nóng)村社會(huì)和諧,具有重要現(xiàn)實(shí)意義。 當(dāng)前涉農(nóng)職務(wù)犯罪呈現(xiàn)主體復(fù)雜且具有群體化、合伙化樣態(tài)、手段多樣化、對(duì)象廣泛化的特點(diǎn)。涉農(nóng)職務(wù)犯罪產(chǎn)生的原因既有農(nóng)村干部法制觀念淡薄、制度管理不嚴(yán),特別是財(cái)務(wù)管理混亂所致,也有打擊不力,致使此類犯罪頻發(fā)。檢察機(jī)關(guān)查處涉農(nóng)職務(wù)犯罪要貫徹以人為本、嚴(yán)格執(zhí)法和統(tǒng)籌兼顧的原則,要打防結(jié)合,確立和完善預(yù)防涉農(nóng)職務(wù)犯罪新機(jī)制,有效遏制涉農(nóng)職務(wù)犯罪的發(fā)案率。
[Abstract]:Agriculture related crimes refers to the legal obligation of the public servants do not perform or improper performance of public affairs management of agriculture related duties, or the use of public power for themselves or others seek improper interests, disrupting the national management of the duty behavior, damage to the interests of farmers, rural areas, and shall be subject to criminal penalties for violations. The issue of agriculture, rural areas and farmers is related to the success or failure of building a new socialist countryside. It is related to the overall situation of building a well-off society in an all-round way and the long-term stability of the whole country. It is of great practical significance to thoroughly investigate the duty related crimes related to agriculture, promote the construction of anti-corruption in rural areas, safeguard the interests of farmers and maintain social harmony in rural areas.
