【摘要】：長(zhǎng)期以來,我國(guó)煤炭企業(yè)采取了在煤炭礦區(qū)農(nóng)民賴以生存的土地上建礦經(jīng)營(yíng)的模式。這種"煤礦實(shí)體經(jīng)營(yíng)"模式存在的弊端是:在同一礦區(qū),地面和地下有兩個(gè)不同的經(jīng)營(yíng)實(shí)體——煤炭經(jīng)營(yíng)實(shí)體和農(nóng)業(yè)經(jīng)營(yíng)實(shí)體。他們往往在煤炭資源采空地面塌陷進(jìn)行賠償時(shí)產(chǎn)生利益沖突,同時(shí),采礦遺留下來的生態(tài)補(bǔ)償問題大多甩給了政府。在新的歷史時(shí)期,黨的十八屆三中全會(huì)通過的《中共中央關(guān)于全面深化改革若干重大問題的決定》和2016、2017年中央一號(hào)文件涉及"農(nóng)業(yè)供給側(cè)改革"的內(nèi)容給煤炭礦區(qū)土地產(chǎn)權(quán)制度改革指明了方向。推行中央關(guān)于土地所有權(quán)、承包權(quán)、經(jīng)營(yíng)權(quán)"三權(quán)分置"辦法,對(duì)維護(hù)礦區(qū)農(nóng)民土地承包經(jīng)營(yíng)權(quán)合法權(quán)益,發(fā)揮土地經(jīng)營(yíng)權(quán)的資本性作用,改革礦區(qū)土地?zé)o償供給制度,提高土地利用率、產(chǎn)出率,增加礦區(qū)農(nóng)民財(cái)產(chǎn)性收入有重要的意義。文章探索了煤炭礦區(qū)土地資源資本化運(yùn)作的模式,提出了煤礦經(jīng)營(yíng)實(shí)體向整個(gè)礦區(qū)經(jīng)營(yíng)實(shí)體轉(zhuǎn)化的思路。
[Abstract]:For a long time, the coal enterprises of our country have adopted the mode of building mine management on the land on which the farmers in coal mining areas depend for survival. The disadvantage of this mode of "coal mine entity management" is that it is in the same mining area. There are two different operating entities on the ground and underground-coal operational entities and agricultural operational entities. They often produce conflicts of interest when the ground collapses of coal resources are emptied for compensation, at the same time. The problem of ecological compensation left over from mining is mostly left to the government. In the new historical period, the CPC Central Committee's decision on several major issues of comprehensively deepening reform adopted by the third Plenary session of the 18 CPC Central Committee and 2016. The contents of the first document of the 2017 Central Committee concerning the "agricultural supply-side reform" have pointed out the direction for the reform of the land property rights system in coal mining areas, and the implementation of the central authorities' rights on land ownership and contracting. The "three rights separation" method of management right can protect the legal rights and interests of farmers' land contract management right in mining area, give play to the capital function of land management right, reform the system of free supply of land in mining area, and improve the utilization ratio of land and the rate of output. It is of great significance to increase the property income of farmers in mining areas. This paper explores the mode of capitalized operation of land resources in coal mining areas and puts forward the idea of transforming coal mine management entities into the whole mining area management entities.
