【摘要】：中國海上油氣資源豐富,發(fā)展?jié)摿薮�。探索合理的海上油氣礦業(yè)權(quán)出讓制度改革路徑,可有效促進我國對深海油氣的開發(fā),助力能源革命戰(zhàn)略的推進。英國有著豐富的海上油氣勘探開發(fā)經(jīng)驗,其合理的油氣礦業(yè)權(quán)出讓制度可為我國提供借鑒和參考。為此,采用規(guī)范分析、實證分析和經(jīng)驗制度分析相結(jié)合的方法,從油氣開發(fā)的國家戰(zhàn)略和法律體系、礦業(yè)權(quán)出讓的主要制度設計等方面,對英國的海上油氣礦業(yè)權(quán)出讓制度進行了剖析。進而提出了我國海上油氣礦業(yè)權(quán)出讓制度的發(fā)展路徑及改革建議:(1)從完善油氣礦業(yè)權(quán)出讓的頂層制度設計、建立油氣區(qū)塊的信息庫制度、優(yōu)化制度中程序設計、加強評委資質(zhì)管理等4個方面著手,建構(gòu)完善的油氣礦業(yè)權(quán)出讓體系;(2)放寬海上油氣礦業(yè)權(quán)的勘查開發(fā)門檻,鼓勵多種主體、國際、資本與技術(shù)間的聯(lián)合開發(fā)與聯(lián)合投標;(3)設置海上油氣開發(fā)的監(jiān)管機構(gòu);(4)設置跨部門的企業(yè)信用積分體系。
[Abstract]:China is rich in offshore oil and gas resources and has great potential for development. Exploring a reasonable reform path of offshore oil and gas mining right transfer system can effectively promote the development of deep-sea oil and gas in China and promote the strategy of energy revolution. Britain has rich experience in offshore oil and gas exploration and development, and its reasonable system of oil and gas mining right transfer can provide reference and reference for our country. Therefore, we adopt the methods of normative analysis, empirical analysis and empirical institutional analysis, from the aspects of the national strategy and legal system of oil and gas development, the main institutional design of mining right transfer, etc. This paper analyzes the transfer system of offshore oil and gas mining rights in Britain. Furthermore, the paper puts forward the development path and reform proposal of China's offshore oil and gas mining right transfer system. (1) in order to perfect the top-level system design of oil and gas mining right transfer, to establish the information base system of oil and gas blocks, and to optimize the program design in the system, To strengthen the quality management of the judges and to construct a sound system for the transfer of oil and gas mining rights to relax the threshold for exploration and development of offshore oil and gas mining rights, and to encourage a variety of main bodies and the international community, The joint development between capital and technology and joint bidding. (3) setting up a regulatory body for offshore oil and gas development. (4) setting up a cross-sector credit scoring system for enterprises.
