城中村改造中的項(xiàng)目融資模式探討

【摘要】:隨著城市的快速發(fā)展,城中村作為城市中的一種特殊聚落逐漸引起人們的注意。城中村改造得到了各級(jí)政府的高度重視,國(guó)內(nèi)外不少城市啟動(dòng)了城中村改造工作。城中村改造不是簡(jiǎn)單的拆舊建新,而是在城市統(tǒng)一規(guī)劃下對(duì)存量土地資源的有效整合,其實(shí)質(zhì)是調(diào)節(jié)政府、村民與房地產(chǎn)開發(fā)商三方相互關(guān)系,以達(dá)到利益均衡的博弈過(guò)程,它是城市化向縱深發(fā)展或向高級(jí)階段推進(jìn)的結(jié)果,是城市由初期的外延式擴(kuò)張向中后期內(nèi)涵式發(fā)展轉(zhuǎn)變的必然趨勢(shì),其實(shí)質(zhì)屬于“內(nèi)涵式城市化”或“城市的城市化”。城中村改造是一項(xiàng)復(fù)雜的系統(tǒng)工程,,涉及的因素較多,尤其是城中村改造的項(xiàng)目融資模式。城中村改造的的項(xiàng)目融資在各個(gè)城市的城中村改造中,形成了不同的模式。本次通過(guò)對(duì)國(guó)內(nèi)當(dāng)前不同融資模式的分析研究,結(jié)合員崗村的城中村改造,提出了村集體主導(dǎo),分階段改造,分期融資的模式。 具體來(lái)講就是城中村改造分為兩個(gè)階段,一個(gè)是土地整理階段;一個(gè)是土地拍賣階段。在土地整理階段,村集體通過(guò)市場(chǎng)競(jìng)爭(zhēng)引進(jìn)投資商,負(fù)責(zé)征地、拆遷、補(bǔ)償、安置、策劃整合土地,該投資商開展相應(yīng)工作所需要支付的利益從二期土地市場(chǎng)出讓的融資中按照相應(yīng)的比例予以支付。在土地拍賣階段,村集體對(duì)整理出來(lái)的土地通過(guò)政府進(jìn)行招拍掛,向市場(chǎng)融資。市場(chǎng)融資所得一部份用于償還在第一階段協(xié)助開發(fā)的投資商投入所得,一部分用于村集體物業(yè)的建設(shè)。并且在第二階段的土地出讓中,第一階段參與合作開發(fā)的投資商具有優(yōu)先所得權(quán)。即在相同條件下,前期合作的投資商可以優(yōu)先取得該村出讓的土地。這種模式既實(shí)現(xiàn)了改造項(xiàng)目自身的經(jīng)濟(jì)平衡,保證了城中村村民、集體的相關(guān)利益,又通過(guò)法定的途徑籌到了舊村改造的資金需求;政府同時(shí)也在不投入資金的情況下促進(jìn)了城市舊村的改造;對(duì)資金投入方而言,所需土地通過(guò)政府出讓的方式所得,自身的合法權(quán)益也有了法律保證。從而提出一種有效利用社會(huì)資金進(jìn)行城中村改造,使資金投入主體、城市改造方和政府三方共贏的新型項(xiàng)目融資模式。
[Abstract]:With the rapid development of cities, villages in cities as a special settlement gradually attracted people's attention.The reconstruction of urban villages has been highly valued by governments at all levels, and many cities at home and abroad have started the transformation of urban villages.The transformation of villages in the city is not simply to break down the old and build new ones, but to integrate the existing land resources effectively under the unified urban planning. Its essence is to regulate the relationship between the government, the villagers and the real estate developers, so as to achieve the game process of balancing the interests.It is the result of the urbanization to the deep development or to the advanced stage. It is the inevitable trend that the city changes from the initial extension expansion to the middle and late stage of the connotation development. Its essence belongs to the "implicit urbanization" or "the urbanization of the city".The transformation of village in city is a complex system engineering, which involves many factors, especially the project financing mode of village transformation in city.The project financing of urban village transformation forms different models in each city.Through the analysis and study of different financing modes in China and the transformation of the village in the city of Gugang village, this paper puts forward the mode of collective leading, phased transformation and phased financing of the village.Specifically, it is divided into two stages, one is land consolidation stage, the other is land auction stage.At the stage of land consolidation, village collectives introduce investors through market competition and are responsible for land requisition, demolition, compensation, resettlement, and planning and integration of land.The interests to be paid by the investor to carry out the corresponding work shall be paid in proportion to the financing of the second phase land market transfer.In the land auction stage, the village collective collated the land through the government auction hang, to the market financing.Some of the proceeds from market financing are used to repay the investment of investors who assisted in the development in the first stage, and part of the proceeds are used for the construction of village collective properties.In the second stage of land transfer, the investors involved in cooperative development in the first stage have the right of priority.That is, under the same conditions, pre-cooperative investors can first acquire the land sold in the village.This model not only realizes the economic balance of the reconstruction project itself, but also guarantees the relevant interests of the villagers and the collective, and raises the capital demand of the old village reconstruction through the legal channels.At the same time, the government also promotes the transformation of the old urban villages without investing funds; for the capital investors, the required land is acquired through the government transfer, and their legal rights and interests are also guaranteed by law.Thus, a new project financing mode is put forward, which is to make use of social funds effectively to transform villages in cities, and to make the capital invested in the main body, the city reconstruction party and the government.
