【摘要】：隨著城鄉(xiāng)規(guī)劃理論的不斷發(fā)展,公眾參與已經(jīng)被認(rèn)為是城鄉(xiāng)規(guī)劃決策具有合法性和科學(xué)性的重要基礎(chǔ)。2008年的新版城鄉(xiāng)規(guī)劃法為規(guī)劃公開、公眾的知情權(quán)、公眾參與的方式和程序等問題提供了法律層面的依據(jù)與保障,使我國的城鄉(xiāng)規(guī)劃公眾參與的制度建設(shè)取得了巨大進(jìn)步。然而,無論是從實踐效果還是保障體系上看,目前我國的公眾參與還存在諸多問題,總體上停還留在比較初級的階段。與此同時,以計算機(jī)網(wǎng)絡(luò)和移動網(wǎng)絡(luò)為代表的新媒體的發(fā)展和普及,使得借助新媒體進(jìn)行的非程序性的公眾參與層出不窮,對原本的城鄉(xiāng)規(guī)劃公眾參與制度產(chǎn)生了重大影響。 在近年來大量的公眾通過新媒體參與城鄉(xiāng)規(guī)劃的案例中,本文選取廈門“PX項目”事件和南京“梧桐樹”事件兩個典型個案進(jìn)行調(diào)查研究。通過梳理兩個案例中公眾參與的過程,發(fā)現(xiàn)新媒體時代的城鄉(xiāng)規(guī)劃公眾參與的兩方面特點：(1)非程序性參與中公眾占據(jù)主導(dǎo)地位；(2)程序性參與仍然是實現(xiàn)規(guī)劃決策的必要方式。 在認(rèn)識現(xiàn)象基礎(chǔ)上,文章進(jìn)一步從程序性和非程序性參與兩方面歸納了新媒體時代城鄉(xiāng)規(guī)劃公眾參與的一般模式,并指出其中蘊含的公眾參與中政府與公眾的互動關(guān)系演變趨勢。針對這一公眾參與模式,思辨地探討了其中存在的問題。研究指出,在新媒體時代的背景下,非程序性參與只能作為程序性參與的有益補(bǔ)充。城鄉(xiāng)規(guī)劃的公眾參與不應(yīng)僅局限在程序性參與層面,也應(yīng)當(dāng)鼓勵公眾通過新媒體這一非程序性的方式表達(dá)訴求。同時,應(yīng)注意規(guī)避過度的非程序性參與對城鄉(xiāng)規(guī)劃正常運轉(zhuǎn)的干擾。 最后,通過借鑒《深圳城市總體規(guī)劃(2010-2020)》修編中的公眾參與和英國E-Participation技術(shù)在曼徹斯特東部新區(qū)的實踐與應(yīng)用的成功經(jīng)驗,文章嘗試從完善法律保障、優(yōu)化參與程序、搭建基于新媒體的城鄉(xiāng)規(guī)劃信息發(fā)布和公眾參與平臺、構(gòu)建“上”、“下”有機(jī)銜接的參與格局四個方面提出新媒體時代完善城鄉(xiāng)規(guī)劃公眾參與制度的策略。
[Abstract]:With the continuous development of urban and rural planning theory, public participation has been regarded as an important basis for the legitimacy and scientific nature of urban and rural planning decisions. The methods and procedures of public participation provide the legal basis and guarantee, and make great progress in the system construction of public participation in urban and rural planning in China. At present, there are still many problems in public participation in our country. On the whole, the stoppage is still at a relatively preliminary stage. At the same time, the development and popularization of new media, represented by computer networks and mobile networks, It makes the non-procedural public participation with the new media emerge in endlessly, which has a great impact on the original urban and rural planning public participation system. In recent years, there have been a large number of cases of public involvement in urban and rural planning through new media, This paper selects two typical cases of "PX Project" in Xiamen and "Indus Tree" in Nanjing to investigate the process of public participation in the two cases. It is found that the public participation in urban and rural planning in the new media era is still a necessary way to realize planning decision. The two characteristics of public participation in urban and rural planning are as follows: (1) the public occupies a dominant position in non-procedural participation. On the basis of cognitive phenomenon, the article further sums up the general mode of public participation in urban and rural planning in the new media era from two aspects: procedural and non-procedural participation. It also points out the evolution trend of the interaction between the government and the public in the process of public participation. In view of this mode of public participation, this paper discusses the existing problems. The study points out that under the background of the new media era, The public participation in urban and rural planning should not only be limited to the level of procedural participation, but also encourage the public to express their demands through the new media. Attention should be paid to avoiding the interference of excessive non-procedural participation in the normal operation of urban and rural planning. Finally, based on the successful experience of public participation in the revision of Shenzhen City Master Plan 2010-2020 and the practice and application of the E-Participation technology in the new area of eastern Manchester, this paper tries to perfect the legal protection and optimize the participation procedure. This paper puts forward the strategies of perfecting the system of urban and rural planning public participation in the new media era from four aspects: the information release and public participation platform of urban and rural planning based on new media, and the participation pattern of "above" and "under".
