【摘要】：本文基于保留區(qū)選劃的原因和分類(lèi),結(jié)合新一輪全國(guó)和省級(jí)海洋功能區(qū)劃編制,匯總和比較全國(guó)、省級(jí)保留區(qū)管控規(guī)定,分析了目前各省保留區(qū)個(gè)數(shù)、面積、岸線長(zhǎng)度、離岸距離等設(shè)置情況。據(jù)此,依據(jù)保留區(qū)內(nèi)涵將保留區(qū)劃分為五類(lèi),即功能待定區(qū)、發(fā)展預(yù)留區(qū)、整治修復(fù)預(yù)留區(qū)、保護(hù)緩沖區(qū)以及特殊功能預(yù)留區(qū),分別提出五類(lèi)保留區(qū)的使用管理要求和環(huán)境保護(hù)要求。最后,文章從保留區(qū)用�，F(xiàn)狀處理方式、開(kāi)發(fā)利用條件、用�；顒�(dòng)管理等方面提出政策建議�？傮w來(lái)說(shuō),保留區(qū)不允許隨意利用但并不完全禁止利用,在不改變海域自然屬性的前提下,當(dāng)用海活動(dòng)符合保留區(qū)用途及環(huán)境保護(hù)要求,不影響周邊海域功能正常發(fā)揮的情況下允許進(jìn)行開(kāi)發(fā)利用。
[Abstract]:Based on the reasons and classification of the selection of reserved areas, combined with the compilation of a new round of national and provincial marine functional zoning, and the collection and comparison of national and provincial regulations on control and control of reserved areas, this paper analyzes the number, area, length of shoreline in each province at present.Offshore distance and other settings.Accordingly, according to the connotation of reserved area, the reservation zoning is divided into five categories, namely, function undetermined area, development reservation area, renovating reserved area, protecting buffer zone and special function reservation area.The management requirements and environmental protection requirements of five types of reserved areas are put forward respectively.Finally, the paper puts forward some policy suggestions from the aspects of the present situation of using sea in reserved areas, the conditions of exploitation and utilization, the management of sea activities, and so on.Generally speaking, the reserved areas are not allowed to be used at will, but they are not completely prohibited. On the premise of not changing the natural attributes of the sea areas, when the use of the sea meets the requirements of the use of the reserved areas and the protection of the environment,Development and utilization are permitted if the function of the surrounding sea area is not affected.
