現(xiàn)有工程安全責(zé)任體系與管理體系的悖論分析

[摘　要]　當(dāng)前工程建設(shè)安全管理在一定程度上存在“責(zé)任體系”與“管理體系”的悖論。一方面，工程安全責(zé)任體系以施工單位為核心，施工單位的安全管理責(zé)任最為繁重，應(yīng)承擔(dān)的法律責(zé)任也最為嚴(yán)厲；另一方面，工程安全管理實踐以建設(shè)單位為龍頭，但建設(shè)單位屢屢不遵循科學(xué)規(guī)律，盲目壓縮工期和造價。為解決這一悖論，應(yīng)進(jìn)一步明確建設(shè)單位和勘察設(shè)計、施工、監(jiān)理單位的法律屬性，強調(diào)建設(shè)單位就工程安全對社會公眾負(fù)責(zé)的理念和相應(yīng)的“監(jiān)督和注意責(zé)任”，為工程安全管理提供更好的制度環(huán)境。

Abstract: In the present construction industry conflict exsits between safety responsibility and management system. On one hand, the contractors have not only taken full and detailed management duties, but also severe legal responsibilities. Thus the safety responsibility system is established around of contractors. On the other hand, some of employers tend to unreasonably reduce the schedule and cost, which cause serious hidden trouble or even accidents. To resolve this conflict, the legal positions of employers, designers, contractors and consultants need to be redefined. The social responsibility and related supervision and notice duties should be emphasized for employers, so as to create a more reasonable institutional environment for construction safety management.
