【摘要】：水上客運(yùn)安全事關(guān)人民群眾出行便捷和生命安全,是水上安全生產(chǎn)工作的重中之重,客運(yùn)安全歷來是城市公共安全的重要組成部分,是保障城市安全運(yùn)行,切實(shí)維護(hù)人民群眾生命財(cái)產(chǎn)安全的落腳點(diǎn)。水上客運(yùn)交通事故不僅僅威脅著人命財(cái)產(chǎn)安全,還對水域環(huán)境、生態(tài)資源等造成損失。國內(nèi)外一系列水上客運(yùn)事故不斷向我們敲響著安全警鐘,結(jié)合近年來上海港水上客運(yùn)的蓬勃發(fā)展和水上客運(yùn)旅客量的大流量現(xiàn)狀及增長態(tài)勢,一旦發(fā)生水上客運(yùn)事故,將造成多方面的重大損失和嚴(yán)重后果,因此,水上客運(yùn)被列為海事部門所轄水域及海區(qū)的重大危險(xiǎn)因素。 本文通過對上海港水上客運(yùn)發(fā)展形勢和管理現(xiàn)狀進(jìn)行研究分析,對現(xiàn)行的水上客運(yùn)相關(guān)的海事法律法規(guī)進(jìn)行梳理,查找和分析目前影響上海水上客運(yùn)安全的重大危險(xiǎn)因素,利用綜合安全評估的理念,從影響“水上客運(yùn)危險(xiǎn)因素”的環(huán)節(jié)即“人-船機(jī)-環(huán)境-管理-貨”五個(gè)方面著手,梳理與水上客運(yùn)相關(guān)的物流運(yùn)輸鏈和利益關(guān)系鏈,分析與水上客運(yùn)相關(guān)的制衡關(guān)系、合作關(guān)系、責(zé)任關(guān)系以及義務(wù)關(guān)系,并根據(jù)分析結(jié)果結(jié)合公共管理的理念,提出解決問題的方法及建議,落實(shí)責(zé)任方和責(zé)任,打造“責(zé)任鏈”,并從“防、堵、查、救、糾”五個(gè)環(huán)節(jié)制定水上客運(yùn)隱患防控措施,編織“安全網(wǎng)”,制定水上客運(yùn)隱患防控措施,努力實(shí)現(xiàn)隱患排查、科學(xué)評估和綜合治理,提高水上客運(yùn)安全服務(wù)水平
[Abstract]:The safety of passenger transport on water relates to the convenient travel and safety of the people, and is the most important part of the work of water safety production. Passenger transport safety has always been an important part of urban public safety, and it is also the guarantee of the safe operation of the city.To ensure the safety of people's lives and property.Water passenger traffic accidents not only threaten the safety of life and property, but also cause losses to the water environment and ecological resources.A series of maritime passenger transport accidents at home and abroad are constantly ringing the safety alarm to us. In the light of the booming development of Shanghai Port passenger transport on water in recent years and the present situation and increasing trend of large volume of passenger passengers on the water, once there is an accident of passenger transport on the water,Water passenger transport is listed as a major risk factor in the waters and sea areas under the jurisdiction of the maritime department.Based on the research and analysis of the development situation and management status of Shanghai Port passenger transport on water, this paper combs the existing maritime laws and regulations related to maritime passenger transport on the water, and finds out and analyzes the major risk factors affecting the safety of passenger transport on water in Shanghai at present.Based on the concept of comprehensive safety assessment, this paper analyzes the logistics transportation chain and interest relationship chain related to maritime passenger transport from five aspects: "man-ship, machine-environment, management-cargo", which affect the risk factors of "passenger transport on water".This paper analyzes the relationship of checks and balances, cooperation, responsibility and obligation related to passenger transport on water. According to the analysis results and the concept of public management, it puts forward the methods and suggestions to solve the problem, and implements the responsibility and responsibility.To create a "chain of responsibility", and from "prevent, block, investigate, rescue and correct" five links to formulate prevention and control measures for hidden dangers of passenger transport on water, weave "safety nets", formulate preventive and control measures for hidden dangers of passenger transport on water, and strive to realize the investigation of hidden dangers,Scientific evaluation and comprehensive management to improve the safety service level of passenger transport on water
