【摘要】：2016年G20杭州峰會(huì)通過的《G20全球投資政策指導(dǎo)原則》是國際社會(huì)首次在多邊機(jī)制下就全球投資規(guī)則的制訂達(dá)成共識。在全球多邊投資體制缺失的情況下,它的提出填補(bǔ)了國際經(jīng)濟(jì)治理的空白,是多邊投資規(guī)制的歷史性突破�！吨笇�(dǎo)原則》提出的九項(xiàng)原則涵蓋了國際投資體制的所有核心要素及板塊(包括投資準(zhǔn)入、投資保護(hù)及待遇、投資促進(jìn)與便利化、投資爭端解決機(jī)制),并納入了新一代國際投資規(guī)則的核心要素,為改革現(xiàn)行國際投資協(xié)定體系提供了政策指引,也為構(gòu)建一個(gè)更加平衡、更有利于可持續(xù)發(fā)展的全球投資體制提供了基本框架。中國應(yīng)繼續(xù)發(fā)揮自己獨(dú)特的作用和影響,積極推動(dòng)《指導(dǎo)原則》的落實(shí)與推廣,確保未來國際投資體制朝著開放、透明、更有利于可持續(xù)發(fā)展的方向發(fā)展。一方面,中國可以"中國方案"在多邊框架內(nèi)積極推進(jìn)現(xiàn)行國際投資協(xié)定體系改革及未來全球投資體制的構(gòu)建,改善全球經(jīng)濟(jì)治理;另一方面,推進(jìn)自己的外資管理體制及投資協(xié)定網(wǎng)絡(luò)的改革,建立中國新一代投資體制,通過制度創(chuàng)新造就"中國范式",為未來全球投資體制的構(gòu)建樹立樣板。通過創(chuàng)建和推廣國際投資治理的"中國方案"和"中國范式",中國將在21世紀(jì)新一代國際投資體系建設(shè)中發(fā)揮引領(lǐng)作用,為完善全球經(jīng)濟(jì)治理作出積極的貢獻(xiàn)。
[Abstract]:The G20 Global Investment Policy guiding principles adopted by the G20 Hangzhou Summit in 2016 is the first time that the international community has reached consensus on the formulation of global investment rules under a multilateral mechanism. In the absence of a global multilateral investment system, its proposal fills the gap in international economic governance, The nine principles set forth in the guiding principles cover all the core elements and sectors of the international investment regime (including investment access, investment protection and treatment, investment promotion and facilitation, (a) the Investment dispute settlement Mechanism, which incorporates the core elements of the new generation of international investment rules, provides policy guidance for the reform of the existing international investment agreement system, and provides a more balanced approach, A global investment regime that is more supportive of sustainable development provides the basic framework. China should continue to play its unique role and influence, actively promote the implementation and promotion of the guiding principles, and ensure that the future international investment system is open, transparent and more conducive to sustainable development. On the one hand, China can actively promote the reform of the current IIAS system and the construction of the future global investment system within the multilateral framework to improve global economic governance; On the other hand, we should promote the reform of our own foreign investment management system and investment agreement network, establish a new generation investment system in China, create the "China paradigm" through institutional innovation, and set a model for the construction of the global investment system in the future. Through the establishment and promotion of the "China Plan" and "China Paradigm" of international investment governance, China will play a leading role in the construction of a new generation of international investment system in the 21st century, and will make positive contributions to the improvement of global economic governance.
