【摘要】：區(qū)域法治建設(shè)是當(dāng)前我國乃至全世界的一個(gè)熱點(diǎn)問題，而山東半島藍(lán)色經(jīng)濟(jì)區(qū)是國家的一個(gè)重點(diǎn)扶持的區(qū)域，本文將二者結(jié)合，研究的是該經(jīng)濟(jì)區(qū)的區(qū)域法治建設(shè)問題。 藍(lán)色經(jīng)濟(jì)區(qū)區(qū)域法治建設(shè)的程度直接影響到該區(qū)域的發(fā)展?fàn)顩r，關(guān)系到我國區(qū)域協(xié)調(diào)發(fā)展形勢(shì)，關(guān)系到我國“依法治國”方略的實(shí)現(xiàn)，這些都是選取本課題作為研究對(duì)象的主要原因。中外學(xué)者對(duì)半島藍(lán)色經(jīng)濟(jì)區(qū)和區(qū)域法治建設(shè)開展了深入研究，但將兩者聯(lián)系起來進(jìn)行探討的研究則較少，，這為本文的研究提供了可能性。 馬克思主義的經(jīng)典理論、制度經(jīng)濟(jì)學(xué)的相關(guān)理論、法律經(jīng)濟(jì)學(xué)的相關(guān)理論和規(guī)制經(jīng)濟(jì)學(xué)的相關(guān)理論都為半島藍(lán)色經(jīng)濟(jì)區(qū)進(jìn)行區(qū)域法治建設(shè)的提供了理論依據(jù),本文對(duì)其進(jìn)行梳理和整合，以此作為本課題的理論指導(dǎo)。而從實(shí)踐層面來看，區(qū)域法治建設(shè)能夠營造藍(lán)色經(jīng)濟(jì)區(qū)良好的發(fā)展環(huán)境、為其提供發(fā)展的制度基礎(chǔ)、實(shí)現(xiàn)該經(jīng)濟(jì)區(qū)科學(xué)高效的管理、有效調(diào)控和規(guī)制該經(jīng)濟(jì)區(qū)的發(fā)展；當(dāng)然，在藍(lán)色經(jīng)濟(jì)區(qū)發(fā)展的過程中也暴露了不少問題：立法與政策的關(guān)系不協(xié)調(diào)、執(zhí)法方面各自為政以及司法方面的地方保護(hù)主義，這些都制約著該區(qū)域的穩(wěn)定健康發(fā)展。因此，無論是達(dá)到預(yù)期目的還是消除不利因素，藍(lán)色經(jīng)濟(jì)區(qū)的區(qū)域法治建設(shè)都不可或缺。 以山東省雄厚的經(jīng)濟(jì)基礎(chǔ)、穩(wěn)定和諧的政治局面、悠久的歷史文化為客觀條件，同時(shí)借鑒國內(nèi)外其他地區(qū)的法治實(shí)踐經(jīng)驗(yàn)，結(jié)合半島藍(lán)色經(jīng)濟(jì)區(qū)區(qū)域法治建設(shè)的現(xiàn)狀，本文嘗試從加強(qiáng)區(qū)域立法、建立司法協(xié)作機(jī)制、完善法律監(jiān)督體系、加強(qiáng)信訪體系建設(shè)、培育現(xiàn)代法律文化五個(gè)方面探討半島藍(lán)色經(jīng)濟(jì)區(qū)區(qū)域法治建設(shè)的路徑，繼續(xù)發(fā)揮有利條件的推動(dòng)作用，盡量減少不利因素的干擾，實(shí)現(xiàn)半島藍(lán)色經(jīng)濟(jì)區(qū)區(qū)域法治建設(shè)的宏偉目標(biāo)。
[Abstract]:The construction of regional rule of law is a hot issue in our country and the world at present, and the blue economic zone of Shandong Peninsula is an important area supported by the state. This paper combines the two to study the construction of regional rule of law in this economic zone.The degree of the rule of law in the blue economic zone has a direct impact on the development of the region, on the coordinated development situation of the region in our country, and on the realization of the general plan of "governing the country according to law" in our country.These are the main reasons for choosing this subject as the object of study.Chinese and foreign scholars have carried out in-depth research on the blue economic zone of the peninsula and the construction of regional rule of law, but less research has been done on the connection between the two, which provides the possibility for the research of this paper.The classical Marxist theory, the relevant theory of institutional economics, the relevant theory of legal economics and the relevant theory of regulatory economics all provide the theoretical basis for the construction of regional rule of law in the Peninsula Blue Economic Zone.This paper combs and integrates it as the theoretical guidance of this subject.From a practical point of view, the construction of regional rule of law can create a good development environment for the blue economic zone, provide the institutional basis for its development, realize the scientific and efficient management of the economic zone, and effectively regulate and regulate the development of the economic zone; of course,In the course of the development of the blue economic zone, many problems have been exposed: the disharmony between the legislation and the policy, the separate execution of the law and the local protectionism in the judicial aspect, all of which restrict the stable and healthy development of the region.Therefore, the construction of the regional rule of law in the blue economic zone is indispensable, whether to achieve the expected goal or to eliminate the unfavorable factors.Taking Shandong Province's solid economic foundation, stable and harmonious political situation, long history and culture as objective conditions, and drawing lessons from the practice of law in other regions at home and abroad, combining with the current situation of the construction of the rule of law in the region of the Peninsula Blue Economic Zone,This paper attempts to explore the path of regional legal construction in the Blue Peninsula Economic Zone from five aspects: strengthening regional legislation, establishing judicial cooperation mechanism, perfecting legal supervision system, strengthening the construction of petition system and cultivating modern legal culture.We should continue to play the role of promoting favorable conditions, reduce the interference of unfavorable factors as far as possible, and realize the grand goal of building the rule of law in the region of the peninsula blue economic zone.
