【摘要】：近些年來(lái),在我國(guó)經(jīng)濟(jì)體制轉(zhuǎn)軌和社會(huì)轉(zhuǎn)型的大背景之下,縣域經(jīng)濟(jì)的發(fā)展可謂是成效卓著,與此同時(shí),自上世紀(jì)80年代以來(lái)實(shí)施的“市管縣”體制所造成的消極影響卻日漸突出,并成為束縛縣域經(jīng)濟(jì)發(fā)展的體制性因素。而“擴(kuò)權(quán)強(qiáng)縣”改革可以促進(jìn)縣域經(jīng)濟(jì)的快速與健康發(fā)展,因此,其逐漸成為理論界備受關(guān)注的話題,其具體改革實(shí)踐也已然成為一個(gè)時(shí)代潮流。在山西省實(shí)施資源型經(jīng)濟(jì)轉(zhuǎn)型改革試驗(yàn)中,山西省借鑒外省改革經(jīng)驗(yàn),以“先行先試”的政策為指引,開(kāi)展了“擴(kuò)權(quán)強(qiáng)縣”改革的探索之路,并且已取得了一定的成效。但是,從法律角度來(lái)看,無(wú)論是基礎(chǔ)理論還是法律實(shí)踐均顯得薄弱,因此,有必要加強(qiáng)研究。本文采用規(guī)范分析法和對(duì)比分析法對(duì)“擴(kuò)權(quán)強(qiáng)縣”和“市管縣”“省直管縣”予以了規(guī)范分析。采用文獻(xiàn)分析法梳理了與“擴(kuò)權(quán)強(qiáng)縣”改革有關(guān)相的理論及改革實(shí)踐。通過(guò)實(shí)證分析法分析了山西省擴(kuò)權(quán)強(qiáng)縣改革的現(xiàn)狀,并以此提出了相應(yīng)的法律對(duì)策。本文除引言和結(jié)論以外,共分為四個(gè)部分：第一部分概括地闡述了擴(kuò)權(quán)強(qiáng)縣改革的基本理論。在厘清“擴(kuò)權(quán)強(qiáng)縣”、“強(qiáng)縣擴(kuò)權(quán)”以及“省直管縣”相關(guān)概念的基礎(chǔ)上,界定了三者之間的關(guān)系。并以此分析了“擴(kuò)權(quán)強(qiáng)縣”改革的理論基礎(chǔ)。第二部分從實(shí)證分析出發(fā),對(duì)山西省“擴(kuò)權(quán)強(qiáng)縣”改革的具體事項(xiàng)予以經(jīng)濟(jì)法分析,明確了改革的積極效應(yīng)。第三部分從法學(xué)視角出發(fā),重點(diǎn)剖析了山西省“擴(kuò)權(quán)強(qiáng)縣”改革中存在的問(wèn)題,并揭示了改革困境的原因。第四部分探討了山西省“擴(kuò)權(quán)強(qiáng)縣”改革的法律對(duì)策。提出了對(duì)山西省“擴(kuò)權(quán)強(qiáng)縣”改革具體的法制對(duì)策�？傊�,本文通過(guò)對(duì)山西省“擴(kuò)權(quán)強(qiáng)縣”改革相關(guān)法律問(wèn)題的探討,從法律視角分析認(rèn)為,山西省“擴(kuò)權(quán)強(qiáng)縣”改革應(yīng)與山西省“綜改試驗(yàn)區(qū)”形成互動(dòng),抓住“先行先試”這一良好機(jī)遇,將“擴(kuò)權(quán)強(qiáng)縣”改革的進(jìn)行納入法治軌道上來(lái)。
[Abstract]:In recent years, under the background of economic system transition and social transformation in our country, the development of county economy can be described as remarkable, at the same time, Since the 1980s, the negative influence caused by the "city governing county" system has become more and more prominent, and has become an institutional factor constraining the development of county economy. The reform of "expanding power and strengthening counties" can promote the rapid and healthy development of county economy. Therefore, it has gradually become a topic of great concern in the theoretical circle, and its specific reform practice has become a trend of the times. In the course of carrying out the reform experiment of resource-based economy in Shanxi Province, Shanxi Province used the experience of other provinces for reference, guided by the policy of "first try first", and carried out the exploration of the reform of "expanding power and strong counties", and has achieved certain results. However, from the legal point of view, both the basic theory and the legal practice are weak, so it is necessary to strengthen the research. In this paper, normative analysis and comparative analysis are used to analyze "expanding the power of strong counties" and "the cities and counties" and "the provinces directly in charge of counties" to carry out the normative analysis. This paper combs the theory and practice related to the reform of "expanding power and strong county" by literature analysis. This paper analyzes the current situation of the reform of the expanding and powerful counties in Shanxi Province by means of empirical analysis, and puts forward the corresponding legal countermeasures. In addition to the introduction and conclusion, this paper is divided into four parts: the first part generalizes the basic theory of expanding power and strengthening county reform. On the basis of clarifying the related concepts of "expanding power and strengthening county", "strong county expanding power" and "managing county directly by province", the relationship between them is defined. On this basis, it analyzes the theoretical basis of the reform of "expanding power and strengthening counties". In the second part, from the empirical analysis, the concrete items of the reform of "expanding power and strong counties" in Shanxi Province are analyzed by economic law, and the positive effect of the reform is clarified. The third part, from the angle of law, analyzes the problems existing in the reform of "expanding power and strong counties" in Shanxi Province, and reveals the reasons for the difficult situation of reform. The fourth part discusses the legal countermeasures of the reform of "expanding power and strong counties" in Shanxi Province. This paper puts forward specific legal countermeasures for the reform of "expanding power and strong counties" in Shanxi Province. In a word, through the discussion of the legal problems related to the reform of "expanding power and strong counties" in Shanxi Province, this paper analyzes from the legal perspective that the reform of "expanding and strengthening counties" in Shanxi Province should interact with the "comprehensive reform experimental area" of Shanxi Province. Seize the good opportunity of "try first" and bring the reform of "expanding power and strong counties" into the track of rule by law.
