【摘要】:最低工資標(biāo)準(zhǔn)是國家通過一定立法程序所規(guī)定的、為保障勞動者在履行必要的勞動義務(wù)后應(yīng)獲得的維持勞動力再生產(chǎn)的最低工資收入的一種法律形式。最低工資標(biāo)準(zhǔn)的高低,不僅對收入分配有一定影響,還對就業(yè)、產(chǎn)業(yè)結(jié)構(gòu)、區(qū)域經(jīng)濟(jì)發(fā)展和農(nóng)村勞動力轉(zhuǎn)移等重要問題有著很大的影響,只有制定合理的最低工資標(biāo)準(zhǔn),才能發(fā)揮最低工資制度的最大效果。如果制定的最低工資標(biāo)準(zhǔn)不合理,會造成勞動力資源的浪費或過度使用,最終影響經(jīng)濟(jì)發(fā)展和人民生活的提高,這項制度存在就會受到質(zhì)疑。 我國于1994年正式實施最低工資制度。但由于我國是一個人口大國,經(jīng)濟(jì)發(fā)展水平較為低下,導(dǎo)致最低工資標(biāo)準(zhǔn)在制定和實施方面存在著很多的問題:宣傳和執(zhí)行力度不夠,很多工人,,尤其是農(nóng)民工并不知道;最低工資的配套法律也不健全,導(dǎo)致最低工資的制定和實施并不規(guī)范;最低工資制定規(guī)則不合理,導(dǎo)致最低工資的標(biāo)準(zhǔn)十分低下;工會等代表工人利益的機(jī)構(gòu)能力有限,在最低工資的制定和執(zhí)行中呼聲太小。因此對最低工資標(biāo)準(zhǔn)制度的研究具有非常重要的現(xiàn)實意義。 論文首先對國內(nèi)外最低工資標(biāo)準(zhǔn)制度的研究現(xiàn)狀、我國最低工資標(biāo)準(zhǔn)制度實施的現(xiàn)狀等問題進(jìn)行了闡述,對最低工資標(biāo)準(zhǔn)制度產(chǎn)生的歷史背景、發(fā)展軌跡以及其在我國的實踐進(jìn)行了介紹。并在此基礎(chǔ)上對國外最低工資標(biāo)準(zhǔn)制度和我國最低工資標(biāo)準(zhǔn)制度概況進(jìn)行了分析。介紹美國、印度以及巴西等國家最低工資制度的制定背景、發(fā)展歷史、實施狀況以及發(fā)展特點。對我國最低工資標(biāo)準(zhǔn)制度制定的目標(biāo)、特點、實施效果以及最低工資標(biāo)準(zhǔn)與勞動力市場關(guān)系進(jìn)行了詳細(xì)的分析和評述。目的在于,通過對國際、國內(nèi)最低工資標(biāo)準(zhǔn)制度的概述分析我國最低工資標(biāo)準(zhǔn)制度存在的問題和原因,總結(jié)、歸納國外最低工資標(biāo)準(zhǔn)制度中的經(jīng)驗和特點,并進(jìn)一步提出完善我國最低工資標(biāo)準(zhǔn)制度的建議和措施。
[Abstract]:The minimum wage standard is a kind of legal form that the state stipulates through a certain legislative procedure, in order to ensure that the laborer should obtain the minimum wage income after performing the necessary labor obligation to maintain the labor reproduction. The level of minimum wage not only has a certain impact on income distribution, but also has a great impact on such important issues as employment, industrial structure, regional economic development and rural labor force transfer, etc. Only a reasonable minimum wage standard is formulated. In order to give full play to the maximum effect of the minimum wage system. If the minimum wage is not reasonable, it will lead to the waste or overuse of labor resources, and ultimately affect the economic development and the improvement of people's life, and the existence of this system will be questioned. China formally implemented the minimum wage system in 1994. However, because our country is a large country with large population and low level of economic development, there are many problems in the formulation and implementation of minimum wage: the propaganda and enforcement are not enough, many workers, especially migrant workers, do not know; The supporting laws on the minimum wage are also not perfect, resulting in the establishment and implementation of the minimum wage is not standardized; the minimum wage setting rules are unreasonable and the minimum wage standards are very low; and the capacity of trade unions and other institutions representing the interests of workers is limited. The call for a minimum wage is too low. Therefore, the study of the minimum wage system has a very important practical significance. At first, the paper expounds the research status of the minimum wage standard system at home and abroad, the current situation of the implementation of the minimum wage standard system in China, and the historical background of the minimum wage standard system. The development track and its practice in China are introduced. On the basis of this, the paper analyzes the foreign minimum wage standard system and China's minimum wage standard system. This paper introduces the background, history, implementation and characteristics of the minimum wage system in the United States, India and Brazil. This paper makes a detailed analysis and comment on the goal, characteristics, implementation effect and the relationship between the minimum wage standard and the labor market in China. The purpose of this paper is to analyze the problems and causes of the minimum wage standard system in our country by summarizing the international and domestic minimum wage standard system, and to sum up the experience and characteristics of the foreign minimum wage standard system. And further put forward the suggestion and measure of perfecting our country minimum wage standard system.
