廣西北部灣區(qū)域經(jīng)濟(jì)一體化法制保障研究

【摘要】:北部灣經(jīng)濟(jì)區(qū)作為我國(guó)重點(diǎn)打造的新的中國(guó)經(jīng)濟(jì)增長(zhǎng)級(jí),其在國(guó)家經(jīng)濟(jì)戰(zhàn)略中的定位與珠江三角經(jīng)濟(jì)區(qū)、長(zhǎng)江三角經(jīng)濟(jì)區(qū)類似,但是最近幾年以來,北部灣經(jīng)濟(jì)區(qū)區(qū)域經(jīng)濟(jì)的發(fā)展規(guī)模遠(yuǎn)遠(yuǎn)沒有達(dá)到國(guó)家所預(yù)想的戰(zhàn)略高度。究其原因,除了廣西北部灣地區(qū)地處我國(guó)西南邊陲,本身經(jīng)濟(jì)基礎(chǔ)薄弱,基礎(chǔ)設(shè)施不完善等方面的原因外,還有一個(gè)重要的因素就是,北部灣經(jīng)濟(jì)區(qū)與長(zhǎng)江三角洲、珠江三角洲相比,其經(jīng)濟(jì)區(qū)區(qū)域內(nèi)市場(chǎng)統(tǒng)一度沒有長(zhǎng)江三角洲、珠江三角洲高;經(jīng)濟(jì)一體化的法制保障程度沒有長(zhǎng)江三角洲、珠江三角洲的保障好。市場(chǎng)的不統(tǒng)一、經(jīng)濟(jì)一體化的法制保障力度不夠,導(dǎo)致北部灣區(qū)域經(jīng)濟(jì)內(nèi)各行政區(qū)劃主體各自為政,不能有效的發(fā)揮統(tǒng)一市場(chǎng)的作用,不能信息互通、資源共享。本文旨在通過對(duì)國(guó)外比如歐盟等地區(qū)的區(qū)域經(jīng)濟(jì)一體化的法制保障進(jìn)程的考察、對(duì)比長(zhǎng)江三角洲、珠江三角洲等區(qū)域,為北部灣經(jīng)濟(jì)區(qū)區(qū)域經(jīng)濟(jì)一體化的法制保障的制度構(gòu)建提出一些自己的設(shè)想,以期能夠促進(jìn)廣西北部灣經(jīng)濟(jì)區(qū)區(qū)域經(jīng)濟(jì)的快速發(fā)展,同時(shí),也為我國(guó)區(qū)域經(jīng)濟(jì)一體化的建設(shè)提供經(jīng)驗(yàn)。在論文寫作過程中,我們充分利用經(jīng)濟(jì)法律知識(shí)的關(guān)系來探析經(jīng)濟(jì)一體化進(jìn)程中法制保障產(chǎn)生的必然性;運(yùn)用邊際成本的方法來研究區(qū)域一體化法制保障構(gòu)建的必然性;通過比較分析歐盟和我國(guó)的珠三角、長(zhǎng)三角地區(qū)的法制保障措施的做法,并結(jié)合廣西北部灣現(xiàn)實(shí)而設(shè)計(jì)出具體的法制保障模式。本文研究的重點(diǎn)是區(qū)域經(jīng)濟(jì)一體化法制保障模式的構(gòu)建,即如何在我國(guó)現(xiàn)有的法律制度的框架下,加強(qiáng)立法協(xié)作以實(shí)現(xiàn)區(qū)域經(jīng)濟(jì)的一體化;在不沖撞法律底線的前提下,設(shè)計(jì)出行之有效的、具有中國(guó)特色的區(qū)域經(jīng)濟(jì)一體化法制保障模式,為區(qū)域經(jīng)濟(jì)一體化的深入提供一種積極促進(jìn)性、事先安排性的法制保障環(huán)境。
[Abstract]:The Beibu Gulf Economic Zone, as a new economic growth level created by China, is similar to the Pearl River Delta Economic Zone and the Yangtze River Delta Economic Zone in the national economic strategy. However, in recent years, The development scale of the regional economy in the Beibu Gulf Economic Zone is far from the strategic height envisioned by the state. The reason is that, apart from the fact that the Beibu Gulf region of Guangxi is located in the southwest border of China, its own economic base is weak. In addition to the imperfect infrastructure, there is also an important factor: compared with the Yangtze River Delta and the Pearl River Delta, the Beibu Gulf Economic Zone has a lower degree of market unity than the Yangtze River Delta and the Pearl River Delta. The degree of legal protection of economic integration is not as good as that of the Yangtze River Delta and the Pearl River Delta, and the market is not unified, and the legal protection of economic integration is not strong enough, resulting in the main bodies of the administrative divisions of the Beibu Gulf regional economy acting in their own way. Unable to play the role of unified market effectively, unable to exchange information and share resources. The purpose of this paper is to compare the Yangtze River Delta by examining the legal guarantee process of regional economic integration in foreign countries, such as the European Union, etc. In the Pearl River Delta and other regions, some tentative ideas are put forward for the construction of the legal system of regional economic integration in the Beibu Gulf Economic Zone, in order to promote the rapid development of the regional economy in Guangxi Beibu Gulf Economic Zone, and at the same time, It also provides experience for the construction of regional economic integration in China. In the process of writing the paper, we make full use of the relationship of economic legal knowledge to explore the inevitability of legal guarantee in the process of economic integration. Using the method of marginal cost to study the inevitability of the construction of the legal guarantee of regional integration, through the comparative analysis of the measures of legal protection in the Pearl River Delta and the Yangtze River Delta in the European Union and China, Combining with the reality of Guangxi Beibu Gulf, the author designs a specific legal security model. The emphasis of this paper is on the construction of the legal security model of regional economic integration, that is, how to establish the legal security model in the framework of the existing legal system of our country. Strengthen the legislative cooperation to realize the integration of regional economy, design an effective legal guarantee mode of regional economic integration with Chinese characteristics without colliding with the legal bottom line, It provides an active and arranged legal protection environment for the deepening of regional economic integration.
