巴馬生態(tài)旅游可持續(xù)發(fā)展問題及法律對策研究

【摘要】：生態(tài)旅游在當(dāng)今旅游業(yè)中已成為一個熱點(diǎn),受到各國政府的重視和關(guān)心,越來越多的人認(rèn)為二十一世紀(jì)是生態(tài)旅游世紀(jì),是未來旅游發(fā)展的方向。聯(lián)合國將2002年定為“國際生態(tài)旅游年”,同年5月,世界生態(tài)旅游峰會在加拿大魁北克召開,大會發(fā)表了《魁北克生態(tài)旅游宣言》,旨在積極促進(jìn)生態(tài)旅游發(fā)展,圍繞主題年曾舉辦一系列區(qū)域性的生態(tài)旅游研討和培訓(xùn)活動,生態(tài)旅游因此迅速崛起,成為旅游業(yè)中的熱門。2009年,國家旅游局將宣傳口號確定為“2009中國生態(tài)旅游年”,經(jīng)過一年的宣傳和努力,生態(tài)旅游更加深入人心。溫家寶總理在政府工作報(bào)告特別提到：中國實(shí)施以人為本、全面、協(xié)調(diào)和可持續(xù)的科學(xué)發(fā)展觀,需要大力發(fā)展循環(huán)經(jīng)濟(jì)。這是可持續(xù)發(fā)展理論在我國的具體化的實(shí)施舉措,在旅游產(chǎn)業(yè)的發(fā)展中也要適應(yīng)可持續(xù)發(fā)展的需要,實(shí)現(xiàn)旅游業(yè)的可持續(xù)發(fā)展。在眾多的旅游可持續(xù)發(fā)展的探索模式中,生態(tài)旅游是目前影響范圍最廣的一種。 隨著社會經(jīng)濟(jì)的發(fā)展和居民生活水平的提高,參與生態(tài)旅游活動、回歸自然,欣賞自然已成為現(xiàn)代生活方式的一個重要特征。借此契機(jī),巴馬大力發(fā)展生態(tài)旅游業(yè)。巴馬是著名的世界長壽之鄉(xiāng),蘊(yùn)藏著豐富的生態(tài)旅游資源,具有發(fā)展生態(tài)旅游的優(yōu)勢。目前,巴馬生態(tài)旅游的發(fā)展正在由開發(fā)階段向管理階段過渡的階段,但由于生態(tài)旅游法制建設(shè)的滯后,現(xiàn)今的巴馬生態(tài)旅游發(fā)展面臨著很多問題。本文基于巴馬發(fā)展生態(tài)旅游的現(xiàn)實(shí)背景,結(jié)合巴馬發(fā)展生態(tài)旅游的情況,深入分析了巴馬發(fā)展生態(tài)旅游所面臨的問題,并提出具有針對性的法律對策,對巴馬生態(tài)旅游的開發(fā)與管理研究進(jìn)行了有益探索,目的在于對從法律角度實(shí)現(xiàn)巴馬生態(tài)旅游可持續(xù)發(fā)展進(jìn)行探討,以期對巴馬生態(tài)旅游可持續(xù)發(fā)展有所裨益。 本文研究方法主要采取兩種方式,一是理論研究與實(shí)證研究相結(jié)合的方法。首先研究生態(tài)旅游的概念、可持續(xù)發(fā)展的概念、生態(tài)旅游旅游可持續(xù)發(fā)展的內(nèi)涵與要求這些基本理論,在此基礎(chǔ)上,以巴馬生態(tài)旅游為案例進(jìn)行實(shí)證研究。二是文獻(xiàn)調(diào)查與實(shí)地調(diào)查相結(jié)合的方法。文獻(xiàn)調(diào)查是在查詢、整理和分析文獻(xiàn)資料的基礎(chǔ)上,明確研究問題的范圍與框架。實(shí)地調(diào)查則是對巴馬生態(tài)旅游發(fā)展中產(chǎn)生的各種經(jīng)驗(yàn)和問題進(jìn)行查證。文獻(xiàn)調(diào)查與實(shí)地調(diào)查相結(jié)合,保證了本文的理論價值和實(shí)際應(yīng)用價值。 本文在生態(tài)旅游的理論基礎(chǔ)上對巴馬開展生態(tài)旅游,實(shí)現(xiàn)生態(tài)旅游可持續(xù)發(fā)展的法制建設(shè)方面進(jìn)行分析。全部內(nèi)容共分為五個部分： 第一部分主要介紹生態(tài)旅游的概念,包括國內(nèi)外對于生態(tài)旅游的定義。接著對生態(tài)旅游的理論基礎(chǔ)——可持續(xù)發(fā)展理論進(jìn)行論述,再闡述二者之間的聯(lián)系,介紹生態(tài)旅游可持續(xù)發(fā)展的內(nèi)涵和要求。 第二部分主要介紹國外生態(tài)旅游發(fā)展階段與各國發(fā)展生態(tài)旅游模式選擇。國外發(fā)展生態(tài)旅游的經(jīng)驗(yàn)教訓(xùn)為巴馬生態(tài)旅游可持續(xù)發(fā)展提供了有益借鑒。 第三部分分析巴馬發(fā)展生態(tài)旅游的有利條件和必要性。說明巴馬走生態(tài)旅游開發(fā)的道路是明智的抉擇。 第四部分具體分析巴馬在生態(tài)旅游可持續(xù)發(fā)展中出現(xiàn)的問題。 第五部分在可持續(xù)發(fā)展思想的指導(dǎo)下,針對出現(xiàn)的問題提出有建設(shè)性的法律對策。 本文將以可持續(xù)發(fā)展思想為指導(dǎo),在綜合分析生態(tài)旅游相關(guān)理論和實(shí)踐的基礎(chǔ)上,對巴馬生態(tài)旅游開發(fā)和管理中出現(xiàn)的問題進(jìn)行分析,重點(diǎn)關(guān)注生態(tài)旅游法制建設(shè)方面出現(xiàn)的問題,并提出有針對性的法律建議,為巴馬生態(tài)旅游可持續(xù)發(fā)展提供一個新的思路,為促進(jìn)巴馬地區(qū)的環(huán)境效益、經(jīng)濟(jì)效益和社會效益的協(xié)調(diào)發(fā)展增添理論依據(jù)。
