國際旅游島背景下完善海南地方人大對行政權監(jiān)督機制研究

【摘要】：人民代表大會制度是我國政權的基本組織形式。中華人民共和國的一切權力屬于人民,人民行使國家權力的機關是全國人民代表大會和地方各級人民代表大會。人大的監(jiān)督權力是人大最主要的權力,也是使用最頻繁的權力,人大監(jiān)督權在我國監(jiān)督體系中占有重要地位。海南作為中國最大的經濟特區(qū),近年來提出了建設國際旅游島的目標。國際旅游島建設不僅在經濟層面,在社會管理方面也應當有適當的創(chuàng)新和突破。海南省人大常委會成立二十多年來,對行政權,監(jiān)督機制不斷完善,監(jiān)督手段不斷豐富,監(jiān)督效果越來越明顯,取得了長足的發(fā)展。但是由于理論儲備不足、發(fā)展歷史較短、現實制約因素較多等原因,離國際旅游島的要求還有一定的差距。 本文除去引言和結束語、后記,共分為五個部分。第一部分回顧了以往的國內外研究現狀,指出了文章研究對建設海南國際旅游島的意義和主要研究方法。第二部分主要追溯我國人大監(jiān)督制度的理論淵源,指出了行政權接受監(jiān)督不僅是馬克思經典理論的要求,也被我國歷屆領導人所強調,而且為廣大西方學者推崇,重點從理論上闡述了行政權接受監(jiān)督的重要性和必要性。第三部分分析了海南人大對行政權監(jiān)督的現狀,指出現有人大監(jiān)督面臨著領導體制不合理、社會政治文化滯后及自身運行機制缺陷等三個方面的問題。第四部分介紹了西方立法機構對行政權監(jiān)督的經驗,指出西方的相關經驗對完善海南地方人大監(jiān)督機制具有一定的借鑒意義。第五部分對如何完善海南地方人大對行政權監(jiān)督機制提出了相關的建議。
[Abstract]:The people's Congress system is the basic organizational form of the political power in our country. All the powers of the people's Republic of China belong to the people, and the organs by which the people exercise state power are the National people's Congress and the local people's congresses at all levels. The supervision power of the people's Congress is not only the most important power of the people's Congress, but also the most frequently used power. The supervision power of the people's Congress plays an important role in the supervision system of our country. Hainan, as the largest special economic zone in China, has put forward the goal of building an international tourism island in recent years. The construction of international tourism island should make appropriate innovations and breakthroughs not only at the economic level, but also in social management. Since the establishment of the standing Committee of the Hainan Provincial people's Congress more than 20 years ago, the administrative power and supervision mechanism have been constantly improved, the means of supervision have been constantly enriched, the supervision effect has become more and more obvious, and great progress has been made. However, due to the lack of theoretical reserves, short development history, many practical constraints and other reasons, there is still a certain gap from the requirements of international tourism islands. In addition to the introduction and conclusion, the postscript is divided into five parts. The first part reviews the previous research status at home and abroad, and points out the significance and main research methods of the research on the construction of Hainan international tourism island. The second part mainly traces the theoretical origin of the supervision system of the people's Congress of our country, and points out that the acceptance of supervision by the executive power is not only the requirement of Marx's classical theory, but also emphasized by previous leaders of our country, and respected by the vast number of western scholars. This paper focuses on the importance and necessity of administrative power accepting supervision in theory. The third part analyzes the present situation of the supervision of administrative power by Hainan people's Congress, and points out that the present supervision of the people's Congress is faced with three problems: unreasonable leadership system, lag of social political culture and defects of its own operation mechanism. The fourth part introduces the experience of western legislature on the supervision of administrative power, and points out that the relevant experience of the West has certain reference significance for perfecting the supervision mechanism of Hainan Local people's Congress. The fifth part puts forward some suggestions on how to perfect the supervision mechanism of administrative power by Hainan Local people's Congress.
