【摘要】：旅游項目的開發(fā)是在土地的基礎(chǔ)上開展的，，而鄉(xiāng)村旅游項目的開發(fā)有賴于農(nóng)民的土地，近年來，國家出臺了一系列有利于旅游項目開發(fā)的土地政策，尤其是土地流轉(zhuǎn)形式的提出，為鄉(xiāng)村旅游帶來了新的活力，也為其土地利用形式提出了新的方式，這種方式正在被廣泛采用。最近十年，鄉(xiāng)村旅游蓬勃發(fā)展，成為旅游業(yè)的領(lǐng)軍形式，為新農(nóng)村建設(shè)、增加農(nóng)民收入、保障農(nóng)民就業(yè)、優(yōu)化旅游形式結(jié)構(gòu)等方面發(fā)揮出極大的作用。但隨著在鄉(xiāng)村旅游項目開發(fā)的過程中有關(guān)土地問題的矛盾日益突出，逐漸引起了專家學(xué)者的注意，總結(jié)來說，這些突出矛盾有：缺乏相關(guān)政策法規(guī)保護(hù)、土地產(chǎn)權(quán)邊界模糊、土地流轉(zhuǎn)方式不明確、農(nóng)民利益得不到保護(hù)、在流轉(zhuǎn)過程中農(nóng)民的法律意識淡薄等等，這些與相關(guān)法律不健全、制度缺失不無關(guān)系。因此，土地流轉(zhuǎn)中旅游項目開發(fā)引起的法律問題越來越受關(guān)注,問題的解決也受到大家的關(guān)心。對其中出現(xiàn)的法律問題的研究對土地流轉(zhuǎn)中旅游項目的開發(fā)也具有現(xiàn)實指導(dǎo)意義。 全文共分為五個部分：第一章是緒論，介紹了本文的研究背景、研究意義、研究方法及鄉(xiāng)村旅游和土地流轉(zhuǎn)的相關(guān)概念；第二章,介紹了國內(nèi)外土地流轉(zhuǎn)和鄉(xiāng)村旅游的研究進(jìn)展；第三章,對土地流轉(zhuǎn)中鄉(xiāng)村旅游項目開發(fā)進(jìn)行了理論分析，包括對土地流轉(zhuǎn)制度的分析、鄉(xiāng)村旅游項目的分析、鄉(xiāng)村旅游項目開發(fā)中的土地流轉(zhuǎn)模式分析、土地流轉(zhuǎn)中鄉(xiāng)村旅游項目開發(fā)的法律障礙分析；第四章，針對土地流轉(zhuǎn)制度本身和鄉(xiāng)村旅游項目開發(fā)實踐中出現(xiàn)的法律問題進(jìn)行了思考，并提出了相應(yīng)的對策；最后一章，對本文進(jìn)行了總結(jié),包括研究成果和研究不足兩部分。
[Abstract]:The development of tourism projects is carried out on the basis of land, and the development of rural tourism projects depends on the land of farmers. In recent years, the state has issued a series of land policies conducive to the development of tourism projects. Especially, the form of land circulation has brought new vitality to rural tourism and put forward new ways of land use, which is widely used. In the last ten years, rural tourism has flourished and become the leading form of tourism, which plays a great role in the construction of new countryside, the increase of farmers' income, the protection of farmers' employment, and the optimization of tourism form structure. However, with the increasingly prominent contradiction of land issues in the development of rural tourism projects, experts and scholars have gradually paid attention to these outstanding contradictions: lack of protection of relevant policies and regulations, fuzzy land property rights boundary, The way of land circulation is not clear, the interests of farmers can not be protected, and the legal consciousness of farmers is weak in the process of circulation, which has something to do with the imperfect laws and the lack of system. Therefore, more and more attention is paid to the legal problems caused by the development of tourism projects in the land circulation, and the solution of the problems is also concerned by everyone. The research on the legal problems is also of practical significance to the development of tourism projects in land circulation. The paper is divided into five parts: the first chapter is the introduction, which introduces the research background, research significance, research methods and related concepts of rural tourism and land transfer. This paper introduces the research progress of land circulation and rural tourism at home and abroad. Chapter three makes a theoretical analysis on the development of rural tourism projects in land circulation, including the analysis of land transfer system, the analysis of rural tourism projects, the development of rural tourism projects and the development of rural tourism projects. Analysis of the land transfer mode in the development of rural tourism projects and the analysis of the legal obstacles in the development of rural tourism projects in the land transfer; chapter four, Based on the land transfer system itself and the development of rural tourism projects in the practice of the legal problems, and put forward the corresponding countermeasures; the last chapter, this paper is summarized, including the research results and the lack of two parts.
