旅游景區(qū)產(chǎn)權(quán)制度安排模式研究

【摘要】:在旅游產(chǎn)業(yè)發(fā)展過程中,旅游景區(qū)是旅游資源的主要體現(xiàn)形式和旅游產(chǎn)品的主要載體,是旅游吸引力的根本來源和旅游消費的原動力。同時由于旅游景區(qū)在拉動就業(yè)、幫助農(nóng)民增收等方面表現(xiàn)出的優(yōu)勢,使得旅游景區(qū)對中國經(jīng)濟(jì)有著不容忽視的作用。但是關(guān)于旅游景區(qū)產(chǎn)權(quán)歸屬、旅游景區(qū)如何治理、如何有效保護(hù)等問題的困擾已經(jīng)成為旅游景區(qū)進(jìn)一步發(fā)展的瓶頸,更是理論界始終關(guān)注的重要課題。 誠然,建構(gòu)完善的旅游景區(qū)產(chǎn)權(quán)制度是一項較復(fù)雜的工程,包含了較多的內(nèi)容,如產(chǎn)權(quán)歸屬的安排、合約的制定談判、利益的分配、監(jiān)督體制等等。本論文以其中三個重要的問題——產(chǎn)權(quán)結(jié)構(gòu)如何安排、經(jīng)營年限的確定以及產(chǎn)權(quán)合約終止后資產(chǎn)處理為核心關(guān)注點,結(jié)合制度經(jīng)濟(jì)學(xué)、信息激勵經(jīng)濟(jì)學(xué)、產(chǎn)權(quán)經(jīng)濟(jì)學(xué)等相關(guān)理論,對旅游景區(qū)產(chǎn)權(quán)制度模式的完善進(jìn)行了理論研究。首先,以旅游景區(qū)構(gòu)成要素的歸屬及合約的付費方式為標(biāo)準(zhǔn),對旅游景區(qū)產(chǎn)權(quán)結(jié)構(gòu)的安排進(jìn)行了理論探索。進(jìn)而,以交易費用作為分析范式對四種結(jié)構(gòu)安排進(jìn)行討論、比較,提出兩種較優(yōu)的產(chǎn)權(quán)結(jié)構(gòu)模式,分別是:一體化固定合約制和非一體化分成合約制。然后,結(jié)合內(nèi)部收益率建立模型,測算出經(jīng)營權(quán)轉(zhuǎn)讓的合理年限,同時,對經(jīng)營權(quán)轉(zhuǎn)讓年限到期前受讓方可能發(fā)生的違約或與預(yù)期不一致的行為作出了分析,并且提出相應(yīng)的完善措施。以期更好地約束受讓方行為,使產(chǎn)權(quán)的約束功能充分地發(fā)揮。目前對于比較敏感和復(fù)雜的產(chǎn)權(quán)制度,以交易費用為分析范式,并將視野擴(kuò)展到合約期限設(shè)計的研究還比較缺乏。因此本論文起到了豐富理論研究的作用,同時對旅游景區(qū)的實踐管理工作有一定的指導(dǎo)意義和參考價值。
[Abstract]:In the process of tourism industry development, tourist attractions are the main forms of tourism resources and the main carrier of tourism products, the fundamental source of tourism attraction and the driving force of tourism consumption. At the same time, because of the advantages of tourism scenic spots in stimulating employment and helping farmers to increase their income, tourism scenic spots play an important role in China's economy. However, the problems of property ownership, how to manage and protect the scenic spots have become the bottleneck of the further development of tourist attractions, which is an important topic that the theoretical circle has always paid close attention to. It is true that the construction of a perfect property right system of tourist attractions is a more complex project, which contains more contents, such as the arrangement of ownership of property rights, the making and negotiation of contracts, the distribution of benefits, the supervision system, and so on. This paper focuses on three important issues: how to arrange the property right structure, how to determine the operating years and how to deal with the assets after the termination of the property right contract, combining with institutional economics and information incentive economics. Property right economics and other related theories, this paper makes a theoretical study on the perfection of the property right system model of tourist attractions. Firstly, based on the criteria of ownership of constituent elements and payment of contract, this paper makes a theoretical exploration on the arrangement of property right structure of tourist attractions. Then, the paper discusses the four kinds of structure arrangement with transaction cost as the analysis paradigm, and puts forward two kinds of better property right structure models, they are: integrated fixed contract system and non-integration split contract system. Then, combined with the internal rate of return to establish a model to calculate the reasonable number of years of the transfer of management rights, and at the same time, the transferee may default or inconsistent with the expected behavior before the expiration of the term of the transfer of business rights. And put forward the corresponding improvement measures. In order to better constrain the behavior of the transferee, so that the function of property rights constraints fully play. At present, for the more sensitive and complex property right system, the research on the transaction cost as the analysis paradigm and the extension of the field of vision to the contract duration design is still lacking. Therefore, this paper plays a rich role in theoretical research, and has a certain guiding significance and reference value for the practical management of tourist attractions.
