【摘要】：本文基于對(duì)后金融危機(jī)時(shí)代的國際大背景下環(huán)境保護(hù)和貿(mào)易保護(hù)主義的綜合考慮,找到了在二者結(jié)合點(diǎn)處的問題,即生態(tài)傾銷問題。本文首先對(duì)生態(tài)傾銷問題所涉及的時(shí)代背景作了詳盡描述,表明了金融危機(jī)剛過,世界經(jīng)濟(jì)已經(jīng)進(jìn)入后金融危機(jī)時(shí)代,根據(jù)這一時(shí)期的特點(diǎn),我們可以得知,在后金融危機(jī)時(shí)代國際貿(mào)易的增速會(huì)明顯放緩,多邊貿(mào)易談判更加艱難,貿(mào)易保護(hù)主義再次抬頭；低碳經(jīng)濟(jì)將成為下一輪經(jīng)濟(jì)繁榮的重要增長點(diǎn),提出生態(tài)傾銷這一議題的研究在當(dāng)今時(shí)代背景下是有意義的,是非常必要的。在理論綜述和文獻(xiàn)回顧部分,本文通過對(duì)所涉及的傾銷理論、環(huán)境理論的系統(tǒng)闡述,明確了不同的傾銷類型,指出生態(tài)傾銷已經(jīng)成為國際社會(huì)的重要關(guān)注方面。在傾銷理論中,明確了“價(jià)格歧視”在經(jīng)濟(jì)學(xué)中的含義。在環(huán)境理論中,闡明了環(huán)境與經(jīng)濟(jì)社會(huì)的密切交互關(guān)系,同時(shí)介紹了環(huán)境標(biāo)準(zhǔn)對(duì)產(chǎn)業(yè)水平的影響以及環(huán)境指標(biāo)體系建立所需的相關(guān)框架、完善方法等等。文獻(xiàn)回顧部分梳理了國內(nèi)外研究生態(tài)傾銷的相關(guān)文獻(xiàn),并認(rèn)為以往的研究沒有明確地從經(jīng)濟(jì)學(xué)和環(huán)境學(xué)來理解生態(tài)傾銷,且在生態(tài)傾銷的原因探究上稍欠全面。隨后進(jìn)行了生態(tài)傾銷的原因探究。我們從宏觀上將其原因歸納為經(jīng)濟(jì)壓力、政治壓力、環(huán)境壓力和社會(huì)壓力。對(duì)生態(tài)傾銷的界定是根據(jù)學(xué)術(shù)界已有的研究和自己的思考所得來的。以往的界定往往只籠統(tǒng)地給出一個(gè)含義,而本文從經(jīng)濟(jì)學(xué)角度、環(huán)境學(xué)角度論述了生態(tài)傾銷,并從社會(huì)學(xué)角度總結(jié)了自己對(duì)于生態(tài)傾銷的看法。在對(duì)生態(tài)傾銷進(jìn)行界定的最后,本文也根據(jù)自己理解,提出了關(guān)于“過于寬松的環(huán)境標(biāo)準(zhǔn)”和“不公平競爭”的理解。本文通過對(duì)紡織品和稀土礦生態(tài)傾銷案例的分析,提出了生態(tài)傾銷目前存在的問題,包括我國的外貿(mào)出口結(jié)構(gòu)不合理,出口企業(yè)戰(zhàn)略偏誤導(dǎo)致惡性競爭,政府宏觀調(diào)控偏向,我國企業(yè)對(duì)反傾銷訴訟的消極應(yīng)對(duì)等。并相應(yīng)地提出了解決方法。主要有改善我國的外貿(mào)出口結(jié)構(gòu)；改善出口企業(yè)經(jīng)營策略；積極應(yīng)對(duì)反傾銷,包括建立反傾銷訴訟的專項(xiàng)資金,培養(yǎng)反傾銷人才,以及呼吁世貿(mào)組織提供公允的環(huán)境標(biāo)準(zhǔn)。
[Abstract]:Based on the comprehensive consideration of environmental protection and trade protectionism in the international context of the post-financial crisis era, this paper finds out the problem of ecological dumping. In this paper, the background of ecological dumping is described in detail, which indicates that the financial crisis has just passed and the world economy has entered the post-financial crisis era. According to the characteristics of this period, we can know, In the post-financial crisis era, the growth rate of international trade will obviously slow down, multilateral trade negotiations will become more difficult, trade protectionism will rise again, and a low-carbon economy will become an important growth point for the next round of economic prosperity. It is very necessary to put forward the topic of ecological dumping in the background of the present era. In the part of theoretical review and literature review, this paper clarifies different dumping types by systematically expounding the dumping theory and environmental theory involved, and points out that ecological dumping has become an important concern of the international community. In dumping theory, the meaning of "price discrimination" in economics is clarified. In the theory of environment, the close interaction between environment and economy and society is expounded, and the influence of environmental standards on industry level, the relevant frame needed for the establishment of environmental index system, and the perfect methods are also introduced. The literature review part reviews the domestic and foreign research on ecological dumping literature, and thinks that the previous studies did not clearly understand ecological dumping from economics and environmental science, and the reasons for ecological dumping are not fully explored. Then the reasons of ecological dumping were explored. Macroscopically, the reasons are economic pressure, political pressure, environmental pressure and social pressure. The definition of ecological dumping is based on the existing academic research and their own thinking. In the past, the definition often gives a general meaning, but this paper discusses ecological dumping from the angle of economics, environment, and summarizes its own views on ecological dumping from the angle of sociology. At the end of the definition of ecological dumping, this paper also puts forward the understanding of "too loose environmental standards" and "unfair competition" according to its own understanding. Based on the analysis of the ecological dumping cases of textiles and rare earth minerals, this paper points out the existing problems of ecological dumping, including the unreasonable export structure of China's foreign trade, the vicious competition caused by the export enterprises' strategic errors, and the bias of the government's macro regulation and control. The negative response of Chinese enterprises to anti-dumping litigation. The corresponding solutions are put forward. It mainly includes improving the export structure of our country, improving the management strategy of export enterprises, actively dealing with anti-dumping, including establishing special funds for anti-dumping litigation, cultivating anti-dumping talents, and appealing to WTO to provide fair environmental standards.
