【摘要】： 隨著我國市場經(jīng)濟(jì)的快速發(fā)展,經(jīng)濟(jì)領(lǐng)域中的種種不公正現(xiàn)象漸漸受到人們的普遍關(guān)注。產(chǎn)權(quán)制度的正義問題已成為當(dāng)代經(jīng)濟(jì)發(fā)展以及社會發(fā)展的重大課題。產(chǎn)權(quán)體現(xiàn)的是一種利益關(guān)系,產(chǎn)權(quán)制度是在某種程度上規(guī)范人們利益關(guān)系的具體經(jīng)濟(jì)制度,而產(chǎn)權(quán)正義則是調(diào)節(jié)人們之間財(cái)產(chǎn)權(quán)利關(guān)系的一種價(jià)值觀念和行為準(zhǔn)則。產(chǎn)權(quán)正義的實(shí)現(xiàn)直接影響著一個國家產(chǎn)權(quán)制度的運(yùn)行績效,影響著社會公平的真正實(shí)現(xiàn)。所以,只有保證了產(chǎn)權(quán)制度的正義性,才能促進(jìn)人的全面發(fā)展,推動人類社會的全面進(jìn)步。 本文通過介紹正義、產(chǎn)權(quán)、產(chǎn)權(quán)正義以及三者之間的相互關(guān)系,反思產(chǎn)權(quán)正義的理念與現(xiàn)實(shí)依據(jù),分析當(dāng)代產(chǎn)權(quán)正義的基本原則,并從倫理學(xué)角度出發(fā),提出如何構(gòu)建正義的產(chǎn)權(quán)制度,實(shí)現(xiàn)產(chǎn)權(quán)正義。 第一章為文獻(xiàn)綜述,主要介紹產(chǎn)權(quán)正義的研究現(xiàn)狀,指出其中的不足。 第二章為緒論,主要介紹本文的選題依據(jù)、研究目的、意義、方法和內(nèi)容。 第三章正文開始,主要介紹正義及產(chǎn)權(quán)的起源、概念,分析并概括產(chǎn)權(quán)正義的含義,比較中西方有關(guān)產(chǎn)權(quán)正義的歷史表述,為論述的展開打好基礎(chǔ)。 第四章主要是從理念和現(xiàn)實(shí)兩個方面反思產(chǎn)權(quán)正義的道德哲學(xué)依據(jù)。 第五章主要是在上一章的基礎(chǔ)上,概括當(dāng)代產(chǎn)權(quán)正義的基本原則,即產(chǎn)權(quán)獲得的正當(dāng)性、產(chǎn)權(quán)界定的合理性、產(chǎn)權(quán)使用的主體性、產(chǎn)權(quán)收益的公平性、產(chǎn)權(quán)保護(hù)的嚴(yán)格性。 第六章主要是分析我國產(chǎn)權(quán)制度的現(xiàn)實(shí)背景,提出當(dāng)代產(chǎn)權(quán)正義的價(jià)值目標(biāo),并從保證產(chǎn)權(quán)活動的起點(diǎn)公正、維護(hù)產(chǎn)權(quán)活動的過程公正、調(diào)節(jié)產(chǎn)權(quán)活動的結(jié)果公正三個方面對我國產(chǎn)權(quán)制度的正義性加以提升。 第七章為結(jié)論與討論,總結(jié)主要的研究結(jié)論,并提出有關(guān)討論問題。
[Abstract]:With the rapid development of China's market economy, The problems of justice in the property right system have become an important subject of economic development and social development. The property right embodies a kind of interest relationship. The property right system is a specific economic system that regulates the relationship between people's interests to a certain extent. The justice of property right is a kind of value and code of conduct to regulate the relationship between people's property rights. The realization of the justice of property right directly affects the performance of a country's property right system and the real realization of social equity. Only by ensuring the justice of the property right system can we promote the all-round development of human beings and promote the overall progress of human society. Through introducing justice, property right, property right justice and their mutual relations, this paper reflects on the concept and realistic basis of property right justice, analyzes the basic principles of contemporary property right justice, and proceeds from the angle of ethics. Put forward how to construct just property right system and realize property right justice. The first chapter is a literature review, mainly introduces the research situation of property right justice, and points out the shortcomings. The second chapter is the introduction, which mainly introduces the basis, purpose, significance, method and content of this paper. At the beginning of the third chapter, the author introduces the origin and concept of justice and property right, analyzes and generalizes the meaning of property right justice, compares the historical expression of property right justice between China and the west, and lays a good foundation for the development of the discussion. Chapter 4th mainly reflects the moral and philosophical basis of property right justice from two aspects: idea and reality. On the basis of the previous chapter, Chapter 5th summarizes the basic principles of contemporary property right justice, namely, the legitimacy of property right acquisition, the rationality of property right definition, the subjectivity of property right use, the equity of property right income, and the strictness of property right protection. Chapter 6th mainly analyzes the realistic background of the property right system of our country, puts forward the value goal of the contemporary property right justice, and maintains the process justice of the property right activity from the point of view of the guarantee of the property right activity and the justice of the process of the property right activity. The justice of property right system is promoted in three aspects: adjusting the result and justice of property right activity. Chapter 7th is the conclusion and discussion, summarizes the main research conclusions, and puts forward the related discussion questions.
