【摘要】：大學(xué)教師聘任制度的規(guī)范文本表達(dá)的是"法律的邏輯",是規(guī)范制度操作中"有可為"與"有可不為"的指導(dǎo)性文件,是制度的表層。由表及里,可以發(fā)現(xiàn)任何一個制度設(shè)計(jì)背后,都體現(xiàn)著一定的治理理念,表達(dá)著權(quán)力的分割博弈及其運(yùn)行模式,這體現(xiàn)出制度的"治理邏輯"。香港地區(qū)大學(xué)教師聘任制度的"治理邏輯"表現(xiàn)為:學(xué)術(shù)制度運(yùn)作的"分層負(fù)責(zé)制"、學(xué)術(shù)治理"權(quán)力的轉(zhuǎn)授"、"學(xué)術(shù)卡里斯瑪"與"教授治校"、"官僚制"下的"民主制"。這契合了新公共管理理論所倡導(dǎo)的"分權(quán)"、"權(quán)力重心下移"、"公共問責(zé)"和"績效管理"等觀點(diǎn)。
[Abstract]:The normative text of university teacher appointment system expresses "logic of law", is the guiding document of "having something to do" and "having not to do" in the operation of standard system, and is the surface layer of system. From the outside to the inside, we can find that behind any system design, there is a certain governance idea, which expresses the division game of power and its running mode, which reflects the "governance logic" of the system. The "governance logic" of the university teacher appointment system in Hong Kong shows as follows: the hierarchical responsibility system in the operation of the academic system, the transfer of power in academic governance, the "academic Kalisma" and the "professor governing the school", and the "democratic system" under the "bureaucratic system". This is in line with the new theory of public management advocated by the "decentralization", "the focus of power shift", "public accountability" and "performance management" and so on.
