基于合同文件的工程造價糾紛預防及化解研究

【摘要】：隨著我國經(jīng)濟的快速發(fā)展,建筑市場規(guī)模不斷擴大,涉及建筑工程的糾紛數(shù)量也呈不斷上升趨勢。建設工程糾紛大多由工程造價糾紛引起,而其他原因的糾紛最終也大多歸結到工程造價的賠償上。因此,如何減少和避免工程造價糾紛的產(chǎn)生,以及糾紛產(chǎn)生后如何處理,一直是工程造價管理工作研究的重要課題。本文通過具體的數(shù)據(jù)統(tǒng)計和案例研究,分析工程造價糾紛產(chǎn)生原因、嚴重程度與合同文件之間的關系,闡明了合同文件對造價糾紛預防和化解的重要性。在此基礎上,研究合同文件的訂立和在執(zhí)行中能夠有效預防和化解造價糾紛的方法,討論在合同框架下造價糾紛的處理方式和策略。并從建設行政主管部門的角度出發(fā),指出了造價糾紛產(chǎn)生的根本原因——建筑市場供求矛盾造成的發(fā)承包雙方地位不平等,以及管理方式落后和管理人員業(yè)務能力不足導致的合同文件質(zhì)量管理措施不能得到有效落實。分析了施工合同備案工作的必要性以及目前備案方式的不足,提出了通過開發(fā)系統(tǒng)平臺軟件,實施施工合同訂立和履行網(wǎng)絡監(jiān)管的思路,以規(guī)范施工合同條款、落實過程結算規(guī)定、實現(xiàn)計價資料的網(wǎng)絡實時保存,進一步有效預防和化解工程造價糾紛。本文研究可對建設行政主管部門通過行政手段加強合同訂立和履行的監(jiān)管、落實計價法規(guī)、維護建筑市場秩序、促進建筑業(yè)健康發(fā)展提供了一定的參考。對建設工程發(fā)承包雙方有效通過合同維護自身合法權益,提升造價管理水平,實現(xiàn)管理目標有一定的借鑒意義。
[Abstract]:With the rapid development of economy in our country, the scale of construction market is expanding, and the number of disputes involving construction engineering is also on the rise. Most of the construction disputes are caused by the project cost disputes, and most of the other disputes ultimately come down to the compensation of the project cost. Therefore, how to reduce and avoid the emergence of project cost disputes, and how to deal with them after the emergence of disputes, has always been an important topic in the research of engineering cost management. Through specific data statistics and case studies, this paper analyzes the causes of engineering cost disputes, the relationship between the severity and contract documents, and expounds the importance of contract documents for the prevention and resolution of cost disputes. On this basis, this paper studies the methods that can effectively prevent and resolve the cost disputes in the conclusion and implementation of the contract documents, and discusses the ways and strategies to deal with the cost disputes under the contract framework. From the point of view of the construction administrative department, this paper points out that the root cause of the cost dispute is the unequal status of the contracting parties caused by the contradiction between supply and demand in the construction market, and the quality management measures of the contract documents caused by the backward management mode and the insufficient business ability of the managers can not be effectively implemented. This paper analyzes on the necessity of the construction contract filing work and the shortcomings of the current filing mode, and puts forward the idea of carrying out the construction contract conclusion and performing the network supervision through the development of the system platform software, in order to standardize the construction contract terms, implement the process settlement regulations, realize the network real-time preservation of the valuation data, and further effectively prevent and resolve the project cost disputes. The research in this paper can provide a certain reference for the construction administrative departments to strengthen the supervision of contract conclusion and performance by administrative means, to implement the valuation laws and regulations, to maintain the order of the construction market, and to promote the healthy development of the construction industry. It has certain reference significance for both parties to effectively safeguard their legitimate rights and interests through the contract, to improve the level of cost management, and to achieve the management objectives.
